  1. Sent 1st letter 16th March requesting charges, heard nothing so sent 2nd letter (LBA) a bit late, 3rd April, received letter apologising for the hold up and that they were looking at my claim. Sent a reminder to them 24th April stating that I would be going ahead with court action. Read on forum someone had telephoned them too so I got the number from RBS contact thread and phoned too!!!! I was told they had started my enquiry on 23rd March and normally takes 7 weeks after that. the guy said a decision had been made and I would be hearing within a few days!!!! He said the bank was mainly now paying out all charges apart from interest accrued from the money due back. He said I would probably get all my charges refunded but obviously couldn't tell me on phone but would hear soon! Nope! So I phoned again (Wednesday, 16th May)and a very nice lady told me she was sorry for the delay, they have a "high volume" of requests but a letter was on its way to me. Received letter 17th May offering me full repayment of all charges!!!!!! £1,266.50p!!!!!! :grin: I signed the acceptance and now waiting for them to pay it into my account!!!!!!!!!!! Letter states they believe their charges are fair etc etc as usual!! and also add that they will continue to levy same charges if I get into further problems and if I disagree with this then they will look at changing my account into a simple one where I cannot become overdrawn or use cheques!!!! Abbey needing to take a leaf out of RBS book. Still refusing to pay other than the measly £535 from the £4,500 charges. Sent letter to Ombudsman. Good for RBS though!!!!!!!!!! All I need now is for the money to come through in time for my holidays 1st June!!!!!!! Argos paid £700 Abbey goodwill (huh £535) Capital 1 £300
  2. IVE WON!!!!!!!!!!!! AT LAST AND EVEN AN APOLOGY FOR THEIR DELAY!!! I RECEIVED A LETTER JUST BEFORE I SENT OFF LBA. I WAS ACTUALLY A COUPLE DAYS LATE BUT ON THE DAY I WAS GOING TO POST IT THE MAIL ARRIVED FIRST WITH A BEAUTIFUL LETTER FROM ARGOS!!!!!! I COULDNT BELIEVE THEY ACTUALLY APOLOGISED FOR BEING LATE IN REPLYING!!!! OF COURSE THEY HAVENT ADMITTED TO BE IN WRONG, STATE THEIR CHARGES ARE NOT ILLEGAL AND WILL CONTINUE TO CHARGE ANY LATE PAYMENTS BUT I DON'T CARE COS WE CLOSED ACCOUNT DUE TO RIDICULOUS INTEREST CHARGES! ANYWAY, WE RECEIVED £180, WHICH IS WHAT WE CLAIMED!!!!!!! THANK YOU ARGOS!!!!!!!! NOT SO GOOD ABBEY.....YOU'RE NEEDING TO TAKE A LOOK AT ARGOS!!! BUT WE WILL GET ABBEY YET. GOT THEIR GOODWILL OFFER OF £180 BUT GONNA TAKE THEM TO COURT FOR THE OTHER £3000!!!!! JUST SENT OFF LETTER TO ROYAL BANK OF SCOTLAND AND ONE FOR MY DAUGHTER TO BANK OF SCOTLAND. SO i'M GONNA BE BUSY!!
  3. Well Done!!!!!!! Good For You!!!!!! But Wot A Lot Of Work You Put Into It. Definately Paid Off!!!! I'm Really Pleased For You. Abbey Just Keep Putting Us Off Altho Paid £580 Goodwill But We Are About To Start Court Proceedings. Also Phoning The Guy From Watchdog!!!!! Well Done!!!
  4. After all the letters back and forwards Abbey are still denying their charges are unlawful or wrong. They are stating this even although they have paid us £535 as Goodwill. We have been passed through different departments, people and addresses. They have not returned telephone calls and constantly refer us to the Ombudsman. Now, however, we are going to court but as Scottish law is different from English law, I believe we cannot claim the full £5000 in small claims. We have been told it is only £750 but can claim this several times to make up the amount which seems ridiculous to me. I also believe there is another way of doing it but at the moment I am ploughing through trying to find out exactly what it is! So if anyone out there knows, can you please help? I am determined they are not getting away with it. They attempted to charge us another £35 for an unpaid direct debit which we hadn't even set up and when I challenged the woman about this she agreed to refund it! So, what we really need is someone who might already have gone down the road of taking Abbey to court in Scotland. Thanks. Love, Lyn
  5. Congratulations Chilli!!!!! Well done. What a battle tho, eh? But one well fought. Abbey paid us goodwill £535 and have constantly stated their charges against us are fair and are refusing to pay out further. We're trying to sort it out for court cos Scottish laws appear to be different. We are going for our full amount of £5000 but apparantly small claims in Scotland is only £750. Sounds crazy. It's a maze but one we are going to fight through like you. It's really frustrating tho because my son has been offerered almost £4000 from BOS with 2nd letter! Congratulations!! I must find Inga!   6. Our final day is on 10th November!!!!!! Getting a wee bit worried! Had Goodwill payment of 535 and letter offering £570!!! Where do they get that from. A bank that can't even count. Sent letter off stating the money was already in our account before their offer was even made, we accepted it as part payment only and would be continuing with claim. Also sent email stating they had offered £570 but only put £535 into account and could they explain this, letter to Abbey also sent querying this. Letter not acknowledged but we received letter re email stating I had not signed it so could not be actioned on! DUH!! however, a copy of my email was sent for signing which we did and sent off last week. Letter sent to Abbey also stating their last date would be 10th before we would start court claim and did they actually want to go as far as this. Would they be prepared to settle rather than go to court. Has not been acknowledged. Now we will have to find out about how we proceed with taking them to court.
  7. Hi, If you accept their offer just make sure they absolutely know and have it in writing that it is only as part payment and you fully intend going for full amount. They say they are offering it in full and final payment so be careful as this might be seen that you agree if you do accept as you have to sign this. Tempting though, I do agree, especially being so close to Christmas but think, if they are willing to jump so much from £830 to £2685!!!! what will their next step be? Full payment? Let's hope so.

    Hi, Apart from taking your letter straight into your branch you can send it to any of those two address's. Complaints, Abbey, PO Box 5129 Milton Keynes MK9 2YN Or Abbey, PO Box 382 Prescot Street, London, E1 8RP We sent our initial request to the address given on bank statements Abbey, PO Box 1109 Bradford, BD1 5ZJ We got our statements back really quickly but then other letters from them were addressed Prescot Street and the final one offering goodwill has an address for Complaints one!!!!!!!! So take your pick. Any other corresspondence I expect will come from the Complaints addy, thats who we replied to accepting the goodwill payment which was a ridiculous amount compared to what they owe us but we stated in capital letters at least 3 x that we were only accepting it as part payment of the full amount due. Good luck with statring off!!
  9. Hi, I say YES accept what the Abbey offers as "Goodwill" payments but write immediatly stating clearly that you are accepting this amount as PART SETTLEMENT of full amount claimed only. This must be in the letter. We received an offer of £575 yesterday (ashamed to say this is no where near our amount over the 6years claim!!). The letter was dated 20th October and we received it 27th. We sent a letter back accepting it but stated in capital letters that it was only part payment and we were still claming the full amount. Obviously less the payment made. However, last night we discovered they had already paid the goodwill money into our account. All dated 25th October £30, 25th October £20 etc. However, despite their offer of £575 we only received £535!!! A bank and they can't even count!!!! We hadnt even received their letter offering this before they paid it into our account!!! So yet again I wrote to them today making it perfectly clear we were accepting the 535 and pointed out it wasnt even the amount offered as goodwill. I ensured they would fully understand that it was only accepted as part payment. (as read that others have been stung by not stating this.) We then made out a list stating it would ensure there would be no misunderstandings on either of our parts. I also pointed out that they had their last 14 day deadline as from the 26th October then we fully intend taking further action. I stated that no letter saying they were passing it onto another member of their team would be accepted. They did this before. We copied and pasted their payments into our account from our online statement and sent that too. With every other letter we have enclosed a statement of charges levied against us. So my advice is take the goodwill payments but make it perfectly clear to them that it is only part payment and you are still going for full refund. If you decide to accept a further % payment ensure the % is of the full amount not the full amount less the part payment. That's my advice anyway and what we are doing. What do you have to lose?
  10. Hi, Just wondered if anyone has applied for refund of charges from Argos store card? We have had the card for just over a year and the interest and late payment charges have just snowballed. We don't know if we can claim against interest as we started off by knowing the interest rates although I have to admit not really thinking exactly what they would be. I lost my job through becoming disabled and we decided to stop using the card. If we make the minimum payments which we can only pay some months the interest is phenomenal. We also, unfortunately have been charged late payments. One of the reasons in the past was due to me making the payments online before it clicked this was the reason as it takes so long to reach them. So we started making payments by cheque which obviously takes longer too. It's ridiculous because the money leaves our account on the same day as paying online but can take up to 5 working days before they get it. So, along with late payment charges, and interest we now have charges because we are over the credit limit!!!!! We have not used the card for ages but with all this getting added on it's a nightmare. We have never purchased anything to make it over the credit limit!!! Of course, it would solve all the problems if we could pay it off and be done with them but unfortunately we are not in the position to do so. They refuse to change the payment due date to make it easier for us to get the payments to them in plenty time. This month there is a charge for them telephoning regarding the account. I was in hospital and unable to take the call so they phoned twice!!!!! 2 calls, still unable to take the calls so another even bigger charge for the letter. £17 charge for 1 letter! We are not missing the payments out, only paying the minimal charge but struggling to pay the extra charges. It's a vicious circle. We would probably be better taking out a loan to pay them off as was suggested by them!!!!!! "Do you have anyone who could lend you the money?" :o This was when I telephoned them and asked if they could withhold the interest rates to give us a chance. Has this happened to anyone else??
  11. We sent our 1st letter requesting bank statements and microfilche and £10 cheque in September expecting to wait until nearly time up before receiving them. What a surprise when we received the first 6 months worth of statements within a week and then the microfilche several days later! All the bank statements arrived in seperate envelopes and with about 3 different ads in them!!!!! So we worked it all out and sent it off to them. The period for their 28 days would be up next Thursday. However, we received a letter from them today stating how sorry they are that we have been so unhappy that we felt we must complain!!!! (As if we were the only ones to ever complain and lodge this against them!!). It goes on to say they have passed our complaint to a member of their team to investigate as high quality customer service is of great importance to them. They state they will do everything they can to resolve our complaint in a "timely and satisfactory manner" They say they know it is important to us that they resolve this quickly but they do want to be "thorough" and this can sometimes take time. However, they claim to contact us soon but if not they will write in 4 weeks to let us know what is happening. "Although I do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with" Yes Mr Head of complaints we will be happy but only with a full refund!!!!! So, they have brought forward the 28 days by a week! Wait and see, fingers well crossed!! Do you think we will hear by Christmas? However, the last sentence finding a solution we are happy with, doesnt sound to me as if they intend paying out in full. Will keep you updated.
  12. Good luck! We received all our statements for 6 months within a few days all in different envelopes then the mictofilche a few days later. Abbey now have until 26th October to reply. Lets hope there's no fight!!!! Ha Ha! We can dream but look at the other people who have got their money refunded. Good luck and keep posting! Love, Lyn

  14. :mad: I am disabled and have blue badge for car. We parked the car last Christmas Eve outside M&S Dundee in loading bay (honestly believing this meant we could park while we collected our Christmas shopping). I require assistance from the car and into wheelchair and while I was being helped by my partner a traffic warden stood beside us. I remember thinking, he could at least have helped! Ha Ha We went in, collected shopping and 15mins later back out to car. What a shock I got to see a parking ticket on the screen, from the very guy who had stood and watched us getting out of the car, me into wheelchair and off to the shop. I was raging mad:mad: He must have watched and waited before pouncing. Must have been needing his Christmas bonus boosted. It wouldn't have been so bad if he hadn't been standing by watching us. He could have informed us we were not allowed to park there but oh no. Not this wee creepy guy! He must have thought his luck was well up. I did telephone and was advised to write in regarding it. I did so but got a letter back saying no I had to pay the charges. I hope he had a Merry Christmas and that he can sleep at night! It didnt affect us but some people might have really had to struggle to pay that fine when all it would have taken to prevent it would have been a few words. Even a snarled "shift" would have been better than wot this character did. Thank you Dundee traffic warden. How much do they get for every ticket they write? Must be worth it to be that sleekit!!!!!!!
  15. Hi, I just joined today. We have claimed against Abbey and was really surprised how quickly they sent all our statements to us. We sent of recommended letter and £10 cheque. Received a letter back a couple of days later (!!) acknowledging it and that they would send out 6 months statements but the rest of 5 and half years on microfilche so they would use £10 for this which would be sent out seperately. All the 6months worth of statements arrived, all in seperate envelopes and all with at least 3 advert leaflets in! Approx 1 week later the rest arrived as computer printout! So we have calculated (much to our shame!) charges over 6 years! How could this have happened and we didnt even realise!!!!!! So it all went off yesterday and we are now in the wait and see wot happens period! Fingers crossed everyone, please. Love, Lyn
