  1. hi i was successful in claiming back my ppi payments from a credit card company, a total of £1672.00 but because i still have an active acount they want to offset the payment against my outstanding balance which is £1960.00, the account is not in arrears and is with the original provider, can they keep the money and offset it or can i demand it is paid directly to me? many thanks for any help or advice
  2. hi my son took out his own car insurance policy with Admiral, he was insuring a 'y' registration ford Ka, he was offered fully comp insurance for a wopping £140.00 per month with a £400.00 excess, he was 23 years old, after 6 months he has crashed his car and wrote it off, virtually no damage to the other vehicle, my son admitted liabilty as he ran into the back of the car in front. the insurance company has cancelled his insurance as they say is normal in these cirumstances, He has now been offered a settlement figure of £400.00 for his vehicle. BUT he has a £400.00 excess and because the policy has only ran 6 months Admiral want the remaining amount of installments paid which comes to £705.00. the question i have is why was my son sold fully comp insurance when it had no benefit to him, he would never have been compensated for the loss of his vehicle, surely this is mis selling, any ideas what i can do about it? thanks in anticipation of your replies airodek

HI i am about to start a claim for missold PPI and have sent a SARS request to the yorkshire bank using a template from this site, i requested all information held relating to my account along with a £10.00 cheque, i have held the account for 15 years and have been paying PPI on a credit card for all of the fifteen years. To-day i recieved an envelope containing statements going back six years and nothing else, just a covering letter saying ' i refer to your letter of 9th april 2011 in relation to the above mentioned act and now enclose the relevant information', as far as i am aware i am entitled to claim all 15 years worth of Missold PPI, and it would appear i have not recieved all the information i am entitled to, What do i do next? thanking you in anticipation of your response airodek
  4. Hello everyone i am about to start a claim for missold PPI, the PPI was on a Credit Card account and was taken out 15 years ago, how far back can i claim as i am unsure if the 6 year rule applies or not. many thanks in anticipation of your replies
  5. My first letter was dated 26th september 2006, is there any case law that supports your interpretation of the statute of limitations or do you know of anyone who has argued his case and won.

Update i eventuall y got my £4149.00 back but refused to accept it as full and final settlement, i decided to continue my claim for the £690.00 that cobbetts say is time barred, i supplied my evidence that i intend to rely on in court to both the court and cobetts as the judge directed, cobbetts supplied nothing, all parties should have submitted court bundles before 28th march 2007. To-day 11th may 2007 i have recieved a witness statement and an application notice from cobbetts the witness statement says: i make this witness statement in support of the defendants Application dated 5th April 2007 for an order that the claimants claim be struck out. The grounds of the application are that the defendant believes that the facts reffered to in the claimants claim do not disclose any legally recognisable claim against the defendant. In the background to the claim they say The claiment is time barred from bringing a claim of unauthorised bank charges prior to 6 dec 2000 by provision of section 5 of the limitation act 1980. does anyone have any advice on how to handle this, the hearing is on 23rd May 2007

The engine on my Saab 95 was siezed due to lack of oil, i decided to have the engine fully reconditioned but to get the best price i shopped around, i live in Liverpool and the best deal i could find was in Essex, as the engine was no use i paid for a transporter to take the car to the garage workshop in essex, the engine was fully reconditioned and guaranteed for two years, when the car was ready i caught a train to essex, paid for the recon £1285.00 and drove home, after eight weeks the car has developed an oil leak from the rear crankshaft oil seal, which should have been replaced during reconditioning, the oil is dripping out onto the exhaust front pipe which could lead to a fire. I contacted the garage who repaired the vehicle and they say they will repair the fault free of charge but i must get the vehicle to them, and as it cannot be driven that sort of distance, it needs another transporter and all the costs that go with it that they say must be paid for by me. Does anybody know whos responsibility it is to get the car to the garage any advice would be greatly appreciated.
  8. the underfloor heating used under laminate is different to that used under tiling, i have used both, the laminate underfloor heating should be filmic, ie a very thin strip like matting, under tile heating is round in section and as you say needs to have no airgaps so it will not burn out, where did you lay the flooring, was it in a dry area or a wet area? and what underlay did you use, it shoul have been thermal underlay at least 6mm thick.
  9. I am in the process of claiming £634.00 from Barclaycard. Iam at the stage where documents you rely on in court are supplied to all parties concerned. I have supplied mine to the court and Barclaycard {230 pages} all documents were supposed to be supplied to all parties no later than the 8th March 2007. I have not received any documents from Barclaycard. Can anyone tell me what this means?
  10. update i decided after much deliberation to inform cobbetts i would accept their cheque for £4149,00 as part payment only and i would continue my claim for the remaining £690.00. i explained i did not agree with their interpretation of the statute of limitations and that i would let the judge decide who was right. I banked my cheque into the account indicated on the cheque and waited. After 3 days i checked my balance, and what do you know the money has dissapeared and my overdraft has been frozen. what will happen next i do not know. i will keep you informed,
  11. Hi yes i was sent a cheque from Cobbetts last week, it was made payable to myself into bank account No *******, which means i can only pay the cheque into my rbs account that generated all the charges. Have you been refunded by cheque

Update having taken some advice from this site, i have decided to accept the payment of £4149.00 as an interim payment, i will continue my claim for the £690.00 they say is over six years old. i have found an interesting thread which sites Opinions of the lords of appeal for judgement in the cause Cave (respondent) v Robinson jarvis and rolf (a firm) on 25th april 2002 ukhl18 the thread is a recent one by progenic7, entitled Limitation Act 1980 s32(1),a,b,c + (2) Actual Case Law, the question i have is can i accept a cheque as an interim payment when it has been sent as full and final settlement. an interesting point is the cheque has my name on it followed by my bank account number it seems i can only pay this cheque into the rbs account that the charges have been deducted from. is that normal?
  13. Re my last post, Has anyone got any advice on the six year rule, does it apply to everthing or if you are unaware of something and then 8 years down the track become aware ie unlawful penalty charges, can you only claim 6 years back of eight?
  14. Update on claim against RBS, St Helens Branch. I need some advice on a letter i have recieved from cobbetts, my claim against the rbs is for £4616 with court costs comes to £4736.00, In an earlier letter cobbetts stated the first 15 charges on my account were not claimable as they exceeded the six year limit, the charges in question totalled £690.00, To-day i have recieved a letter and a cheque, the letter states the same thing about the six years back and the cheque was for £4149.00 as full and final settlement. The question is: are they correct in their appraisal of this situation or is it some cobbetts tactic to reduce my claim, i am inclined to reject their offer and continue my action but if they are correct and i cannot claim for the 15 charges that go further back than six years from the date of my claim i would be better off accepting the money. Please advise
  15. i am claiming £554.33 plus costs from Barclaycard, i have had all the usual letters and am now at the point where i have my court date, i am in the process of assembling my court bundle so i can send it to the relevant parties. I have been informed my case is Listed in a group with several other cases, a tactic used to enable an earlier court date, i may be barking up the wrong tree but will all this group be claiming bank charges or can they be any type of case? If anyone reads this and is in St helens county court on 11th April between 10am and 2pm let me know.
