  1. How can I have abandoned the property when all my stuff is in there? I've read that a Landlord cannot keep my property legally. Could you explain a bit more in depth for me, rather than just state the above as it's help and advice I'm looking for.
  2. I haven't taken a reading as I was still moving out and wanted to vacuum etc. I pulled up a few days ago only to find out that the landlord has allowed workmen working on another building to plug into my outside electricity point!
  3. Yes, I have pictures showing the state of the house when I moved in. The Landlord came in to look at damp etc, but I have no written proof I'll draft a letter and send it as I know where the Landlord lives. Thanks so much ericsbrother
  4. Help please. My Landlord is being really awkward after I moved out! Here's the background. I moved out on 4th December after my Landlord told me they were giving me notice. A few months ago I lost my job and fell behind with payments, but recently caught up to the point where I owed £400 plus my deposit (£895). The landlord said they were coming to give me notice and so I did what I thought was right and found a cheaper place to live. I was paying £895 per month and found a house for £500 per month. So, I thought this would be ideal as I could keep paying old Landlord back without £895 per month racking up. At this point I have to say that the Landlord has never protected my deposit, made me get the Aga serviced if I wanted central heating, let the roof continue leaking and did nothing about the crumbling walls (damp) and the water coming down the front of the chimney breast each time it rained. I also had no smoke alarms at all and the electrics were really old..................no idea if they'd been checked. Me being me, I just cracked on with the house. I also should add that before moving in I'd had to help paint and strip all the carpets. The landlord promised she'd pay me for the help......never arrived! I did sign an agreement, but it was never copied and sent to me. Ok, so today the old Landlord came to my house and took the key to the old house. I still have stuff in their which they knew about. He won't answer calls or texts. He was abusive and then went straight to my new Landlord, telling him I'm an unworthy person. What can I do please? The items in the old house are required. The landlord (a Husband and Wife) can get pretty nasty, and to be honest, I'm beginning to get fed up with bullying etc, especially as I'm not someone who would just up and leave. Any feedback and advice appreciated.
  5. No, I don't think I have at all. I can see that they are linked with VERY and Littlewoods, but I've never signed up for an account. I cannot find out how to flag it up on the Noddle site so I guess I'll just have to call Shop Direct tomorrow

  7. I'm sorry if this is in the wrong section. I checked my Credit report today on Noddle and noticed that a Credit Application check has been run on my maiden name of over twelve years ago, and an address which I haven't lived at for the same amount of time. The check was carried out just days ago. This concerns me as I'm worried someone is trying to obtain credit in my name. The company that ran the check are called Shop Direct. Obviously I will need to contact them, but if I could have people's thoughts on why this may have happened I'd be very grateful.
  8. Another question. Recently at a Court Hearing I asked my Duty Solicitor if my landlord could use my Deposit to help pay off my arrears. She advised that it was best to keep quiet about this and leave it for the Landlord to bring it up with the Judge, which, they didn't. The Judge has ordered the total amount of rent arrears to be paid, so my question is Can the Landlord use my deposit for this? It does state in my tenancy that it can be put towards rent arrears and so I'm unsure what the Solicitor was getting at. If they use the deposit, then how is it recorded with the Court that the deposit amount has been used and should be taken off the amount claimed?
  9. My Landlord has recently been granted a possession order for the property I live in (it's my own fault, I just didn't have the money and then rent stacked up). I've been ordered to obviously pay the outstanding rent and also costs. The hearing was rushed through and a duty solicitor spoke on my behalf. I didn't even think about asking this question and need to know how I apply to the court to be able to pay the outstanding off in affordable amounts. Advice would be appreciated. Many thanks
  10. I recently fell behind with some rent payments, which I'm now paying back. My Landlord issued a claim for possession through the courts and the hearing date is in April, however, today I received a form 6a from the Landlord and I'm really confused! Does this go hand in hand with the Court hearing? It appears tactics have changed. How do I stand with a 6a as it states 'no fault possession. The Court claim says it's due to rent arrears. Please could anyone shed some light on it for me?
  11. Hi The work wasn't done directly for me. It was carried out for the landlord. The landlord has no 'clout' about him and so I'm having to deal with it. I've submitted my invoice and warned that if they kept ignoring then I would take it to court. After checking out the company I feel I'm dealing with someone who knows what to do to avoid this
  12. Hi A few days ago I posted on here about a Company who installed some pipework above my Café ceiling and caused the ceiling to come through due to water damage. I raised an Invoice for loss of earnings and food waste, but the Managing Director has ignored it, as well as an email asking him when payment would be made. I am now a little suspicious of this particular director as I have since found that he has another five limited companies all registered to the same address, plus, a dissolved Company which was also recent. All of the listed companies are registered to the same address, however, none of the Directors home addresses show. So, can I only raise the summons against the Ltd Company that carried out the work or, can I also include him as an individual if I find his home address? I'm just worried that a CCJ may mean nothing with a dissolved Company and six others on the go. Any advise please?
  13. My little Café was due to re open after Christmas on 3rd Jan. On that day I went in to find no hot water and a huge brown stain on the ceiling. I called my Landlord who came over to try and sort the boiler, but to no avail. He said the water from the ceiling could be part of the problem. The space that I rent is from a Landlord, who then uses and agent, Fischer German. So, that day I could not clean or trade. The next day I went back and found a chap working on the boiler. He went up into the roof and found a valve which had been left loose by anther Company who had installed pipework just a few days before Christmas. He was instructed by the Landlord's Agent to tighten the valve, which he did, but, at the same time put his knee through the ceiling and down came all the water! I have been unable to trade and have contacted the Company who fitted the new pipework and caused the leak. I've asked for £150 per day whilst the premises cannot be used, a £200 food wastage fee and the cost of a deep clean (as the insulation is fibre glass). They have agreed to repair the ceiling and pay for a deep clean, however, they dispute any other charges and say it's down to the man from the boiler company as he put his knee through the ceiling! I'm not sure which way to turn, I'm earning nothing and do not have an insurance to cover business interruption. In my eyes, the people who caused the leak should be the people who pay. Even though someone has put a knee through the ceiling it was still holding a large amount of water and so too was the insulation. Please could someone give me some advice on this?
  14. Hello all I'm just about to apply for Decree Absolute, but before I do I really want something in writing from my Husband concerning payments for the Children. I have not gone after anything which he owns and am not interested in doing so - after what has happened I just want to get away from his as much as I can. The background is: He has his own house (still mortgaged), his business (service and repair of motor vehicles). He also owns a racecar which is valued at around 12 - 15K. He apparently earns minimum wage, but also gets paid cash on some jobs (which I cannot prove). My background is: I live in a rented house with two children ages four and six (both are his children). I have a business which I started in September this year, but cannot draw a wage yet. I receive working tax credits. I am also about to apply for a DRO as when we split there were some debts and I also had to send our caravan back which left a big financial hole! I went onto the CSA site and from the basic wage info I was able to supply it calculated that I should be paid £29 per week for both children. This has been set up. My problem is this. I am not the best when it comes to remembering to include everything and I need something in writing that can be followed by both of us before I file for Absolute. I also struggle to put down on paper whatever is in my head, so I've probably missed important information on here too. Please can any of you people give me some guidance about this situation. I need to put something down on paper which lists payments which my Husband should make and, maybe, some kind of consequence if he doesn't? I am unsure if I can make any claim against him once Absolute is granted. Can his racecar be made into some kind guarantor if he's lying about his income or doesn't make payments? I really don't have the money to employ a Solicitor and just want to sort this as soon as possible. Thank you all in advance
