  1. We weretold that sick pay needs to be added to gross then deducted again to enable employer to claim back? £418.00 for 89 hours work = £4.70 per hour at the very most, well below the national minimum wage for a 22 year old.
  2. My daughter started work on a two week trial on the 21 June 2007. This was in a first class country house hotel and involved waitressing and kitchen duties. She went down with a diarrhoeal (!) infection and was off sick 4,5,6,7, and 8 July for which she self certificated and her employer was kept informed daily. Two rostered days off (9 & 10 July) and she returned to work 11 & 12 July. On the 13 July she had an appointment with her doctor and was given a 24 hour medication and a sick note to cover that day because doctor wasn't happy with her condition. She made a phone call to that effect to her employer immediately after her doctor's appointment. She returned to work 14 July for her shift to be told she was dismissed. Her employer told her he didn't believe she was sick even though she had a doctor's note. (sorry for rambling!!!) Now then - is she entitled to pay in lieu of notice? She has been paid £418 (minus live-in costs of £51) for 89 hours work (no deductions for tax and n.i. as she had been out of work for a month). As she is 22 years old and entitled to minimum wage of £5.35 per hour at least, this cannot be right? (I make it £476.15) Is she entitled to sick pay? I don't have her pay slip to hand but it says:- Salary 1 @646.00 Deductions Tax - 0.00 NI - 0.00 Live-in - 51.00 Sick pay 228.00 Total payable - £367 Anyone shed any light or offer advice as how to follow this up? Have written to employer, but as yet no reply. Cheers x
  3. Hi Ricardo! Just an update re smaller building societies. As you know I have an ongoing claim with the cumberland due in court 14 June. Well, handed the court their copy in Penrith and sent cumberland's rec del Mon 21 May at 3.30pm. Bundle signed for by cumberland Tues 22 May am, money back in my account that very same day!! Got the usual drivvle from cumberland "to avoid wasting management time, will pay, not in the wrong, etc, etc". Me a happy bunny:D xxxxxxx All I need to do now is work out how to donate cos couldn't have done this without CAG!!!!

  5. Pay £50 a month to Capital One (attachment of earnings from employer). Sent an SAR to them 17 February, no reply as yet. If they don't respond by end of March, what would my next step be? Obviously, the AoE will still be paid but as my credit limit was £1000 and the amount payable under the ccj was £1837, I would like to know what charges I may be able to claim back. I have been paying the AoE since April 05, default date was July 04. I need to do this properly and would appreciate some advice!

  8. got an AOE notice from Crapone 04/05 my employer pays £50 per month for this from my pay my question is: having no account number or card number (had my head in the sand at the time!!!!:-| ) can I still question any charges on the account? Can't even remember what my credit limit was!! but the amount on the AOE is £1800ish Have now paid £1100ish and was wondering if I could haggle the outstanding amount? Can't remember getting default notices or anything, but as I say, my head was well and truly buried!! Have a default on my credit report (experian) a BIG 8!!
  9. The £109 charges were 5 separate charges on 5 separate dates between 01/2002 and 05/2006. They were refunded (reluctantly) after complaints from myself, back into the account. I haven't included these on my claim so can they actually counterclaim for "goodwill refunds"? Goodwill refunds are their words, not mine.

  11. It's a small Cumbrian, member owned building society - I guess they may not be "au fait" with the consumer action group!
  12. I am in the process of claiming back bank charges through county court - bank filed a defence AND put in a counterclaim for £109 worth of charges previously refunded to me as goodwill gestures - anyone come across this before?
