Hello Everyone, After 6 months of tooing and frowing I have finally recieved a letter today confirming that Natwest are refunding the full cost of my premium and the interest which totals £2738 on the basis that it was missold to me. It appears that people are taking a number of routes to challenge the banks re misselling of PPI so here is a breakdoen of the steps I took, it may not work for everyone but if it inspires one or 2 more of you to make a claim then that'll do for me: 22/12/06 - sent initial letter to my branch manager outlining my case. 3/01/07 - Natwest regional manager responded basically saying I had no case 11/01/07 - Sent my responce as a Letter before action stating that her responce was unacceptable and they should refund the full premium plus interest or I would take it further. 17/01/07 - Natwest responded offering me £100 to cover the time it had taken to complain still stating I did not have a case 18/01/07 - responded saying that I would accept the £100 as part settlement and that if they did not refund me in full I would take my complaint to the financial ombudsman. 24/01/07 - recieved a letter from regional manager explaining that after a full investigation she did not feel that any form of mis-selling had taken place and that £100 was there full and final offer. 30/01/07 - sent complaint form to financial ombudsman 11/04/07 - Recieved letter from natwest offering me 50% of the premium and interest as a 'gesture of goodwill' 15/04/07 - sent letter accepting offer only as part settlement and explaining that I was happy to await the financial ombudsmans investigation 2/07/07 - Recieved letter from financial Ombudsman detailing the fact that they recomended that Natwest upheld my complaint and that Natwest had agreed to do so. - RESULT! Its worth ponting out that I did get some interim letters from the FO letting me know that they were dealing with my case and that they would be in touch so they didn't leave me with no infomation. However there were times when I thought about just accepting their 50% offer, I'm glad I didn't now! So for anyone who feels they have been mis- sold ppi insurance then claim it back! You have a case and eventually you will win. I must also pass on my sincere thanks to Ian Reid who's help and support during the early stages really kept me going, so cheers Ian I probably wouldn't have done it with out you!   2. Good afternoon everyone, My claim for mis sold PPi has been rumbling on since december and I have finally started having some success. This is the story so far: 1. Complained to my branch re the misselling of insurance. 2. Following 4 or 5 letter between myself and natwest they basically told me to sod off and offered me £100 as a goodwill gesture (the policy had cost me £2789.99 including insterest and this is what I was claiming) 3. Compained to the financial Ombudsman. 4. Recieved a 'final responce letter' from Natwest offering me £1394.63 (basically half of my claim) So my questions are; Has anyone else been offered a part settlement? and if so what action did you take? Should I push my luck for the full amount and if so are there any examples of rejection letters out there? Any help, advice etc would really be appreciated. Cheers Jonat
  3. Evening Everyone Just a quick update, I feel like I've hit a bit of a brick wall so any help and/or motivation would be appreciated....as always! I have just recieved this letter from natwest the crux of which is below: After a full investigation of all the facts regarding the inclusion of personal loan protection to your loan I do not feel that any form of mis-selling has taken place. I would refer you to my previous letter in shich we state for the time you have taken to contact us and any inconvenience caused we will make a full and final offer to you of £100. I guess my next step must be a compliant to the Financial Ombudsman but any help would be appreciated. Cheer Jonat

  6. Hi there I'm a bit further along the trail but this thread has started to get me worried. Basically I have an account in England however all my paperwork has been forwarded to Scotland. The deadline on my LBA has expired so I am just about to file a court claim. I entered the address (which is in Scotland), from the letter they had sent me letter confirming they had recieved my correspondance, into MCOL and it said it could not deal with claims over the border? Please tell me I haven't dropped a clanger!?! If any of you have found anything more out I'd be interested to know. Cheers Jonat
  7. Hi there I've just recieved a letter offering £1523.49 of a claim for £17771.50. The problem I have is their deadline for replying to my LBA was the 26th Jan and although I only got the letter on Tuesday it is dated the 25th! My Questions are: 1. Can I send them the standard rejection letter, offering them extra time to respond. or 2. Do I have to recover the full amoint via court, and if so will it jepordise my case? Any help would be appreciated. A chuffed CAG'er
  8. Any help for a Money Claim Online Virgin would be appreciated! The story so far... I have gone through all the various stages which ended with a letter before action being sent on the 21st December after RBS had failed to respond to my preliminary letter (Both letters sent Royal mail Special Delivery). The deadline for a responce has now passed and i have saved enough cash to start my claim so any help on where to start, what to look out for etc etc would be appreciated. To rub salt into the wound they have just sent me a letter threatening court action if I do not repay my overdfaft! (Nothing to do with my claim though as the account has been dormant for a long time) - Any help on how to respond to this would also be appreciated. Cheers

Afternoon Guys, Just a quick update, I recieved a letter this weekend from my branch manager basically saying that she "takes accusations of mis-selling very seriously" and please can I give her more time to respond in full. However she is willing to offer me £100 as a gesture of goodwill! Looks like there panicking about PPi almost as much as they are about charges:D. I am just composing a rejection letter and will use the breaking of GI guidlines info to add a bit more strength to my argument. (Cheers pezboy). Congratulations reidnet on your win over first plus! Out of interest how did you chllenge the rule of 78? I'm going to stick to the mis-selling route for now but if that fails I will use it as a backup.   12. No I'd paid it off before I started the claim (ironically with the charges I'd reclaimed from Natwest!) However I also am in the process of claiming from an abbey card, and although they haven't specifically threatened to close the acount they did infer that they would if I did not continue to operate within their terms. What I did was went for the biggie 1st which was my current account, cleared all my cards with the money I got from that and then went after the credit card charges. I had peace of mind then that they couldn't start demanding full settlement etc. hope this Helps.
  13. Schoolboy error I know, but I have been claiming against RBS on behalf of my wife. I sent a preliminary approach letter which they didn't respond to so have then sent an LBA on the 22nd December giving them 21 days to respond (bearing in mind the Christmas period) It went special delivery and was signed for the day after however, as their deadline for a responce is today, I have just had a look at the letter and it is dated 24.10.06! (I had cut and pasted the letter and forgot to change the date). How will this affect my cliaim? i.e. if there is no responce from them when I get home do I start my court claim or do I have to write to them again? One other thing they have written to me apologising for the delay on the 3rd of January, but they only refered to my preliminary approach letter which was sent on the 6th December and not my LBA. Any help would be appreciated.
  14. Hi Fedupwithmybank, I calimed on behalf of my wife for mint charges, we claimed for £197.00 and they settled in full. They sent me a preliminary offer which didn't include any charges after they had reduced them to £12, I rejected it and they settled in full a few days later. So go for it. Good luck

Happy new year to you all, Just a quick update on my case to date, I wrote to Natwest on the 22nd of December using the template supplied by reidnet (my case is slightly different so I edited it quite considerbly) but it was on similar lines. I have recieved a reply back from them which is basically a fob off letter talking about the way they calculate their rebates using 'Rule of 78' and not even mentioning the main just of my complaint which is that I was mis sold the insurance in the 1st place. I am currently composing a 'letter before action' again in a similar style to the one on reidnets thread. I will let you know when I hear something back.
