I was tryin to sell my house, mortgage @ 160k, was sellin for 150k, mate was helpin me put the rest towards it. Now a car finance company took me to court and attached an order for 14k to the property. Can i still sell, there is no equity to pay them.. Where do i go from here? Have not got the extra 14k they need...

All its says it will not pursue therest of the balance and will update my credit file. Nothing else, no clauses -

Yes i have it in writing.. When they accept full and final settlement, does that not mean technically the balance is cleared? Therfore no money owed on account? -
Had a credit card with halifax for about £4500. Was offered a settlement (full and final) of £1200, which i paid and they accepted. However the account remains open to date. I went about seeking a refund of charges. Agreed to £350 refund. Waited for a few weeks and nothing came. What they have done is refunded it back to the credit card account that they had already accepted full and final settlement on a few months earlier. I have wrote to them, but they say, yes they were correct in doing this. I don't wanna have to go the court route as it would prob be stayed. Any other options for me?

I would like absolute answers to what is the situation, when a creditor, whether the original creditor or not, produce an agreement that has not been signed by the creditor. 1)the opinion of oft, trading standards seem to differ to some opinions on this forum? Who is correct? 2)what way will a court look at, if you go for removal of default etc on these grounds (has anyone actually done it) 3)can the dca take you to court and win? What are the grounds for them winning. 4)as i personally have had no success from any regulatory bodies on any issues, i would prefer to not use this route. 5)do the same rules apply when a debt has been sold on, ie new creditor same as old?

they did produce the original agreement, but it was not signed by creditor. Suppose this means its unexecuted? therefore they have still not complied. Spoke to trading standards before, but they said cabot don't have to comply. Trading standards, belfast.
