  1. Yes it is 100% of the claim the LBA was posted in December, But I was a bit slow in with my follow up thats why it has taken so long. But got the money 5 days before thay had to reply to the court.
  2. Just recived a letter today from bos saying £903 will be in my account within 5 days as it will cost them more money to defend the action ( Your right it would) than thay are paying out. THANKS TO ALL AT CAG WHO HELPED ME ALONG THE ROAD.

  4. Yes it was the sheriff clerk who told me this, she also said that part 4 of the form i filled in asking for the money and 8% intrest that i had to put in the ammount of intrest.
  5. I went to the sheriff court today (Scotland) to file my papers, my claim was for £746 plus intrest £92, plus £39 costs but i was told the total cannot be over the £750 mark. I thought it was just the inital claim that was to be under £750. Im in the wrong
  6. my total claim is for £1200 but thought it would be more simple to split it into 2 claims one for £750 and one for the rest. with costs i am talking about court fees . Al

  8. I am submitting my court papers this week and am unsure of whos name to use at HBOS do i have to use my branch managers name (which i anm unsure of) or can i use the name of the person i have been in contact with

  10. Just had this letter sent to me after asking for my money back. "We are sorry to learn that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulator, the FSA, gives us 8 weeks to investigate and respond to complaints. Our committment to you is that we will respond to your concerns at the earliest possible opportunity. However, we want to ensure the issues you raised are thoroughly investigated.If, for any reason, we are unable to respond fully to your concerns within the next 4 weeks, we will write to update you of our process." Do I have to wait the 8 weeks or do I give them the 2 weeks that I stated in my letter, then send in my claim with interest giving them a further 2 weeks before I take court action.
  11. Am i allowed to claim the intrest charged to me at the end of each month for being overdrawn, or is this going a bit far
  12. Surprise surprise after my phone call to HBOS a package came yesterday recorded delivery, all statments from nov 1999 up to date. (What a threat can do in person and not by letter) One question can i claim back the 6 years thay have provided me with or im i stuch to the 5 years i have heard diffrent stories ?

Phoned HBOS tonight and spoke to somone who said it was unralistic to expect a reply by the 3rd of jan Due to holidays. explaned my position of waiting from the 25th October for my statments and said i was not prepared to wait any longer and would issue cort procedings on the 3rd if i had not recived all statments by then.will send my letter of tomorrow asking for repament of the last 2 years worth of charges while i am waiting.
