Hi you helped me to get back all my bank charges from Abbey for which I will forever be in your debt. I have been ill and not on the site for some time however I want to start trying to claim back charges made to my mortgage account firstly by GMAC and secondly by Kensington. Kensington finally forced me to sell my house and lose everything or be repossessed in total I have been charged about £7,000 in charges by both mortgagees and £12,000 in early settlement penalties. Is the situation still the same that it is safe to claim back the charges and go to court but ERC are still a bit of a problem. If so where do I start please and is there an interest calculator on line as there used to be a couple of years ago I will be willing to make a donation for all help given. Hi there Thank you so much for your help, I have done the usual preliminary letters where they offered a stupid amount. When I have done my calculation I have taken the charges and used the on line calculator spreadsheets frighten me!! do I then add another 8% on top or is that it, also I am still confused as to whether I claim back this retail interest they have charged me each month although I havn't used the card for yonks. Sorry to be so thick but I have been ill and have lost my way a bit and need to get back into the swing of things. Many thanks CatherineBear x

Hi there Congratulations have just read all your thread. When you do the particulars of claim do you fill in on the Form N1 and then attached the typed Particulars. Also I am still confused can I claim interest on the charges together with interest on the retail interest they have been charging, dont understand how you have charged some interest and then some more. Would appreciate any help please as just starting this one although we won £13000 through this site from Abbey. Well done to you and all the other people who make this site the good thing it is. Dave took out thiscredit card in 2000 with a limit of £3000. Although we last used the card in 2001 due to non payment and interest we now owe them a grand total of they say £3580 we say that most of this is made up of charges for non payment of direct debits etc. Can you try to get back promotional interest or is just the interest they are entitled to on the amount you owe them even though you dont use the card to purchase anything. Can anyone let us know the best way to proceed they have ignored the standard letters is the next step to issue in the County Court? Help!!! Regards CatherineBear xxx:(

Hi we took out a capital credit card in March 2004 we have since been in financial difficulties which has led to us now being told by Capital that we owe then an outstanding balance of £1300! However, when we received the statements we wrote to them setting out the charges that they had made and the interest which amounts to £1290.86. Therefore we do not see that we owe them anything and that the money they are claiming is made up solely of charges for late payment etc. Do you think its best to go straight to the County Court on credit card charges or write to the Financial Ombudsman? Also does anyone know can you claim back for them charging purchase interest every month ev en though you have not purchased on the card or is this just the normal interest the bank would be entitled to under the terms of the card? Good Morning Everyone Have been off site for a long time due to ill health and my computer broke! am now returning to do battle against Kensington, GMAC, MBNA and Capital for charges relating to non payment of credit cards and mortgage payments can anyone let me know the best way to go forward as I am a bit out of touch with everything. Also I am trying to get a friend of mine to join the site she had a credit card in 2000 and they have now come after her for non payment is there a limit on time that they can pursue you so I can advise her which way to go. Hi there all We have had success with Abbey and SPPlL and have now decided to issue MCOL for Capital card we owe them a balance of £1,300 but have worked out that they owe us similar amount in charges so want to try and get the account paid off and any default notice removed. Hi there Sorry to hear all the bad news wish you all the luck in the world Kensington are real b..........s!! We had fallen behind because my husband lost his job I was ill with spinal problems and facing major surgery we like you had loaned money off of friends to keep the Repossession at bay eventually we had to sell we had no choice Kensington could not have cared less they have no heart or compassion at all for people and the circumstancs they find theirselves in. We were lucky that we managed to complete just prior t repossession but they charged us £7500 in ERC we went to Ombudsman who was no help at all. Just hope the day comes when we can claim back ERC! However they did charge me £2500 for non payment of dds etc. so am about to issue MCOL for this. Hope to hear you have better news soon. Catherine xxxxxx

Hi Zoot Sorry for the delay in replying have been away from home. Yes I did take Kensington to the Financial Ombudsman but they said that although their methods were underhand there was nothing they could actually do about it! Did not take GMAC though, perhaps I will give it a try its only the cost of writing a letter and posting it and at least the more complaints we make the more it will help our cause to get these things changed so that other people do not fall prey to these vultures as we have done.
