I’ve finally had the dreaded reply to my ‘appeal’. CEL have written me a letter confirming they have cancelled the PCN. I’m so grateful this has been resolved swiftly and I’m so thankful for all the excellent and reassuring advise I got from the folks on this forum. Can someone please update the thread for me to say it’s been dropped. I’ll scan a copy of the letter on on Monday when I’m at work. Thanks again folks I really am so pleased I didn’t just fold and pay up like I was tempted to! Helen

I've typed below verbatim what I said on their online form. "The driver entered this site at night and did not see the non illuminated signs due to the evening light conditions and vehicles parked alongside the railings. The driver was not aware this was a pay and display car car and had previously parked there with no recourse. The signs were unclear on the route the driver took to enter the site and exit on foot. They were unlit and at a height that would not be illuminated by headlights, therefore the conditions of parking were not made clear to the driver from the outset, there was no offer or consideration so no contract formed. Since returning to the site in the daylight the driver notes the sign offering the parking contract belongs to a different company so it is not clear who the contract is with. Also there are no terms and conditions at the pay machine, again making any potential contract void and confusing. Please note I was not the driver at the time of the alleged offence. I do not intend to pay this PCN so please confirm in writing that this matter is now concluded "

Oh goodness I hope I haven’t messed things up for myself. It’s quite intimidating to someone who doesn’t understand the whole process and legal implications. I got a bit confused with the comments and didn’t see all of them as my new thread got merged with an old one I had incorrectly commented on. Thanks for your advise. I’ll keep you posted what they say and hopefully someone can advise me accordingly.

I’ve read some other similar threads since I posted that comment. I’ve based my appeal on the fact that there was no contract offered as the signs were no illuminated, positioned where would not be clearly seen by the driver entering the site and leaving on foot so no conditions were made clear to the driver. Also since returning to the site in daylight it was noted the sign offering the parking contract belongs to a different company so it’s not clear who contract is with, plus no t and c at machine. Loulabell. Thank you for updating for me, sorry if you've got into trouble over it. I too am new to this site and finding the whole process very stressful, no one seems to be commenting on my thread now so I've submitted an appeal based on some of the other threads. Thanks again and well done for getting them to drop it. I hope I get the same amount of advise and don't keep accidentally posting in the wrong place. It's quite confusing to a newbie but like you am very very grateful for all the expertise on here. H

I have read the other threads and have a few pointers. I’m sorry but I don’t m ow what POC means. I have attached pdfs of the pcn above. The pcn claims ‘payment not made in accordance with terms displayed on signage’ I didn’t buy a ticket at all (was dark and didn’t know it was pay and display as have parked there previously and not had a ticket). Technically if I didn’t buy a ticket at all have I entered into any contract with them? I just need a few pointers on the things I should use an appeal and I’ve read I need to point out the contract issues and not my excuses for not buying a ticket. (Sorry if my choice of words isn’t correct)

Thanks so much for getting back to me. I was just about to pay it. I’m so annoyed about it but have a young child and can’t risk going to court or paying more money (even if it Is just an empty threat) I need to do something tonight. I’ll write an appeal and I guess that’ll stop the clock until someone can give me some firm advise on what to do. I’ll jist refer to ‘the driver’ and won’t say it was me for now and see what happens I’m sure they’ll reject it but buys me a bit of time. Thanks for the response. I really appreciate it.

Where exactly [carpark name and town] Lambourne house, bridge cross road, burntwood, ws7 2bx I can't figure out how to out them in a format you can see other than an image, If you ask me the information you need I'll try to answer it.
