  1. Any idea why it would have become stayed in the first place, i had a lot of debt back then so prob had my head in the sand, dont actually remember ever receiving a MoneyClaim though. How does one of these become stayed in the first place? So just checking legally this is 100 percent statue barred!?
  2. Lowell sent me a letter out of the blue telling me that they had been acquired by hoist finance and are now managing a 532.42 debt from 2013 i had with a new day store card. They had been badgering me with phone calls so i fired off an email saying this is statue barred they came back to me with the below: ood morning, Thank you for your email. Responding to your query I understand you have been contacted in regards to this account. Please see below in regards to your account: Account opened on 27/09/2010 Brand name: New Day Last payment was made on 08/07/2013 for £3.51 Default date 29/03/2013 Your account is not statute barred under the Limitation Act 1980. This is because a debt is enforceable for 6 years from the date of your last payment. The original creditor has informed us that a payment of £3.51 was made to this account on 29/03/2013 Based on the information that I have provided, please confirm how you wish to proceed with the account. So i went back to them saying well according to those dates it is clearly statue barred I understand that you believe this account is Statute Barred, however please note that this account has had a County Court Judgement with Claim number xxxxxx County Court Business Centre issued on 11/06/2013. Once a CCJ has been issued then the account cannot be Statute Barred. Please be advised that we have sent you a Notice of Assignment for this account on 09/03/2023, I have attached a copy of this to this email. Based on the information provided, please advise us on how you would like to proceed with this account. Next Steps I’ve put your account on hold for 30 days to allow time for you to get back to us. If we don’t hear from you in that time, contact will resume. Now interestingly in 2019 i sent this to the court must have been doing my due dilligence "I have had notification from HFUK2HL that they are changing the legal name of a claim through the court but i haven't had any court papers through. They have given a claim number on the letter they have sent but when i have typed this in it is not a valid claim. Thanks" They replied "Good morning, Thank you for your email. Please be advised that this case is stayed. If the claimant wishes to proceed they will need to make an application to the court to lift the sat and proceed. If you require any further information please email us or contact the helpdesk on the below number. Kind regards" Now can anyone advise if this is statue barred Summary No payment since July 2013 Hoist opened a MoneyClaim with the court in July 2013 but never did anything with it - so it is now in a stayed position in the court Lowell bought by Hoist now chasing the debt
  3. Hi all I opened up a barclaycard in 2008, defaulted on it in 2012. In 2018 they sent me a pre action protocol letter which I returned to them asking them to prove the debt was mine. last week they returned some items to me that look like potentially old statements. I was paying them back through payplan with the last payment being 3rd July 2014. as it has been 6 years since that date am I ok to tell them it is statue barred and is there any specific wording I need to use. i was thinking about writing a letter converting to a pdf and then emailing it them as I don’t have access to a printer at the moment. would this be the correct thing to do? thanks
  4. it's still on the report. it's defaulted. Natwest just no longer report it on a monthly basis. I've attached a screenshot a bit further up the thread on it how it looks. Thanks
  5. Ok so as I phoned up and made the offer it’s still stat barred. only reason I made the offer in the first place was I’m going to apply for a mortgage next year and thought it might look better if the balance was settled

  7. i just did it over the phone? well they said they would reconsider if i filled out one of those things proving why i can't afford to pay a monthly payment back and asked where i go t the money from. Should i do it, do we think?

Hi so nobody actually replied once the threads were merged. has what I have done reset the stat barred clock? for the record they said the reason they rejected the offer was because they wanted to know what my monthly outgoings were where I’d got the money and why I couldn’t pay back a monthly amount.
  9. Yes and they are natwest And when I say they don’t report it it isn’t on my credit file they just don’t report it monthly
  10. i have a defaulted current account of 38xx.xx with natwest. they dont report it on my credit file each month anymore but it is defaulted. it defaulted feb 2016. i phoned up to see who held the debt and offered 1200 full and final settlement over the phone, the person on the phone said they would fill in a form for me and send it off. they rejected the f and f
  11. If i offered a settlement to somebody and they rejected it - does this count as acknowleding the debt - or is it if you just made a payment towards the debt
  12. ok no advice.... anyway update: theyve marked it as settled now and offered £150 as compensation for my chasing.

Hello all just looking for a bit of advice really. had two lending stream loans back in 2012 that had defaulted on my credit file. i sent IRL complaints in 2018 and they agreed they were lent irresponsibly so if I have paid the actual loan amounts back they would write it off. now I ignored it for a few months until I realised that they had amended my credit report to showing two active accounts and no defaults anymore with the balances I owed. a bit annoyed I could have just waited a couple of extra months and they would of fallen off I paid the two amounts off to clear the loan and get them to mark as settled. this was early October 2018. Now one if the accounts has been marked as settled but there is another one that shows as still active on my credit report with no Balance. its in good standing so it’s doing no harm but I don’t want it on there anymore. Since October I’ve been going back and forth with lending stream and Experian to try and get it settled. lending stream say they’ve sent the amendment but Experian say they’ve contacted lending stream and the account is right. Experian won’t look again as I’ve already asked twice. what should I do?
