  1. Thanks. What about following it through after sending the SAR? I could save a tenner if we know not to go further with it?
  2. Cheers, no way of awakening the debt? I've not heard off them in many years, probably the 6 or so since it has been 'settled'.
  3. Thanks for the reply. I started the mortgage in 2001 when I purchased my first flat. I was told at the time I needed to take out the PPI as I had not long finished Uni and only had 18 months of full time work. I lost the property as I had to give up my business to take care of my Mum who had Dementia. This was in 2008 but by the time it was repossessed it was 2009. The property would have been worth around the same value as the mortgage but I'd have also expected them to add their costs when it was repossessed. As the situation with my Mum was difficult, plus also being scared of what was happening, I put my head in the sand with it all. Only in 2016 did I start to look into it all and found that there were marks for the mortgage. In 2009 they had default marks and by 2010 it was marked as settled. When it reached the 6 year anniversary it dropped off completely without me asking them to do it.
  4. I had my home repossessed in 2009 due to a change in circumstances. The mortgage was with HSBC who marked the debt as 'settled' on my credit file in 2011 although I owed them money. This was removed from my credit file at the start of last year since it had been 6 years since the settlement date. I am certain that I had PPI on this mortgage. If I try to reclaim this PPI will it awaken the debt? I have seen the rule of 6 years for standard credit card and loans but wondered what would apply to the mortgage?

  8. ThanksDX, I have donated to the site via your link for your help and others earlier in the thread. Yes I think it would be HSBC as they didn't sell the debt for the first 6 or 7 years. Rob Way have had it for 3 or 4 years but no CCJ from them. I have just spoke to the court and they said it was purchased by a company called Hoist in September 2007.
  9. Sorry dx, I'm not sure on the claimant. I assumed it was HSBC as that who the debt was with originally. Is there a way I can search for this CCJ? I was assuming bailiffs would be their next tactic if I ignore them.
  10. Thanks.If the bailiffs come round can I point them towards something that says CCJ is out of date and you need a reissue?
  11. HSBC. I didn't actually receive the CCJ myself but it was possible at that point it went to the old address, which HSBC repossessed and had my current address prior to that,so say 2008-09 ish.
