  1. Hi guys, Thank you for your replies. Just to clear it up, this was my first offence ever in any sort of way. Never had a criminal record prior to this, but my reading was 147 from what I can remember.
  2. Hi I got caught for D&D back in July 2017. I also had no insurance and no MOT. I received a 3 year driving ban, and an 8 week prison sentence suspended for 2 years. I was out of a job for a while and a lot of issues were going on in my life at the time. I was wrong and I hold my hands up. It is not something I have done again, or would even think about doing again. Anyway, I managed to get myself sorted. I went to AA meetings and managed to get myself a job. I've been in this job for about a year and half and I have not drunk alcohol for the same time. I got banned from driving for 3 years, but I read online that there is a possibility that the judge may reconsider and wave the final year of disqualification. I understand this has to be done by writing to the judge and explaining why I feel I need to be able to drive. Please note that after checking my DBS, it does say "disqualified from driving - obligatory 3 years". Would this mean I have to serve the full ban because it is "obligatory"? I have a few reasons all of which I'm not sure the judge will find strong enough to wave the last year of the ban, but my reasons are: I was on JSA for a long time before I got this job. Now I'm doing a job I enjoy. However, I have to use public transport to get to work and back, and because public transport is so unreliable, I have been 5-6 mins late 4 yimes in the last 9 months. The company has a policy that they can dismiss you if you are late 5 times in 1 year, so I am cutting it a bit fine. The company also has opportunities for driving staff. This would be a step up for me and it is something I want to persue. I would need my licence for this. Though, I'm not sure if the judge would think I'm more of a liability, so it may work against me. There are few other reasons such as I want to start a family and I wouldn't start one until I can take wife/kids to the hospital when required. And I also need a car to get to the hospital for my own appointments and also to take my mother who also has various health related issues. I can get all this infomation from my solictor. I had contacted him as he did handle my case when I went to court. I had legal aid then as I was unemployed, but now he wants £50 for the consultants appointment, and then a further £360 to write a letter to the judge. Even then the decision is up to the judge, so it may be money wasted. I've been told I can write to the judge myself, which is what I'm thinking. So I just need a bit of guidence into what to write and what to avoid writing to give me the best possible chance of getting me back on the road. Any advice would be much appreciated.   3. Hi, I have a vehicle parked on my drive. I cannot drive it as I have been disqualified from driving for 18 months. I still would like to keep the car insured in case of theft, fire or damage. Is there anyway I can get insurance? Note that I've looked at laid up insurance policies but they seem to require a valid licence. Any help appreciated.
  4. Hi, Could someone give me some advice please? I started working for a company in May 2018. I started as a temp from an agency with a weekly payment. This was supposed to be for 3 months, then if we performed well, they would interview us, and potentially keep us on. I was told I was given an interview in August, and they decided to offer me a permanent position, advising I would go permanent from September. I was then told as it was so close to the payroll deadline, they would ask the agency to keep me on as temp for the month of September, and would actually make me permanent from October instead. About midway through October, they asked me to fill in a couple of forms and email them back within 2 days, stating otherwise I'd cut payroll cut-off and would not get paid. I filled these in and sent them back on the second day. I got an email back saying I had missed payroll as I should have sent it before 5pm. There was no such detail in the email I received. I had also asked my manager to send the form back for me as it had to be signed, and my manager had sent it after 5pm. They then said they would look into organizing an emergency payment for me. Then I got told they had not sent me a bank detail form by their mistake. I filled it in and sent it back straight away. I was never sent the bank detail form so it was clearly their fault. I had presumed they would get the details for my bank details from my agency who had been paying me previously, so it didn't raise a concern for me. Now the company is saying they will go to the CEO and see if he can authorize the emergency payment. The company seems to be putting the blame on me, even though I have done nothing wrong and it is completely the company's fault. If the company comes back and refuses to pay me for October until the following month, what are my options? Any advice will be much appreciated. Aaron
  5. I briefly told my GP about it, but as I had discussed another matter earlier, he booked me an appointment to see him on 21st Sep because I told him the headaches had returned since I had been sitting in the lit area if the office.
  6. Thanks for the replies guys. I've spoke to my employer, and they've basically refused to make any contribution to the cost. Also apoke to my opticians, and they confirmed I was told I had astigmatism which they think could be the cause and asked me to use glasses more often and contacts less so. They said they can write a letter saying I have astigmatism but it'll cost me £55. Renegade - how does it work if I ask employer to refer me to occupational health department? I had a uick Google search earlier and it seems it still means I would have to pay for their service? I've just finished work with a blinding headache. I'm certain all the lighting is the cause. By the looks of things, I'm calling in sick tomorrow. Just want to cover my head in a blanket and bury myself in bed as soon as I get home. It's like a dull thud hitting everywhere around my eyes and the top of my head. Is their any other way I can get my employer to let me sit in the dark area without having to provide a better from the GP/opticians? Surely there must have been an employee health act or something that protects the employee from this.
  7. Hi, I have been working in a call centre for almost a year. I have always sat in an area where there are no bright lights as the lighting would sometimes give me headaches. Prior to a couple of weeks ago, no one had questioned why I sat there. Two weeks ago, my team was appointed a new manager as the previous manager had moved to a different department. My new manager has made me move to an area where there are bright lights and the headaches have returned. My manager has told me she can let me sit in the designated dark area (area specifically designed for people that suffer with issues caused by lighting) as long as I can provide a note from my doctor. I went to see my doctor but he just fobbed me off by saying he couldn't write a note to my employer as I had not mentioned the issue previously. He also advised me that if he was to provide a letter, it would be chargeable at £35 per letter as it's non-NHS work. I told my manager I could get a letter from my GP but it would cost £35 and asked whether the company would pay for the costs, to which she said they would not. I think my GP would write me a letter since I have explained I've had headaches since I've been sitting in the brightly lit area. Is there anyway I could avoid the £35 fee, or somehow force the company to pay for it since they are the ones that want it? Or any other way I could get them to allow me to sit in the dark area? Are there any working rights I can advise my manager of that look into working conditions and safety of their employees? Thx
  8. Yeah he gets council tax reducation whilst living with the family member. At the moment, he has not informed the council that he's left his own house and is still paying full council tax. That's why he wants to know if he will be able to get council tax reduction on his own house as well whilst he's not there. Essentially, as he's getting ESA, he would like to get council tax reduction on both places; his own property, and where he's living temporarily.
  9. Hi guys, just a quick couple of questions. 1) Person A owns a house. He cannot live at the property temporarily. He is also signed off sick by his doctor and gets ESA. Because of this, he is living with a family member. The family member is on income support. They get countil tax reduction. What he wants to know is, would he also get council tax reduction on his own mortgaged property as well?
  10. Hi guys, I hope someone can help. I've checked the forums but my situation is different. I bought a property on 14th March 2017. There were tenants already living there until 31st August 2017. They didn't pay me any rent and in the end I had to give them a section 8 notice to evict them. At this time, I was living with my parents. I moved in 2nd September. I got a letter from the Council saying I owe them £600 for "long term empty". I phoned them and told them there were tenants living there up until 31st August, and I gave them the name of the person, and informed them I had no idea where they had moved to. They requested I send proof that I had moved into the property on 2nd September 2017, in the form of energy letters or something. I sent this by email the same day as the telephone conversation. I then received a letter on 31st October 2017, saying I no longer owe them £600, but I now owe them £190, for the period of 9th July to 31st August. I phoned and told them I sent in evidence that I moved into the property on 2nd September, so I have no idea where they plucked this 9th July 2017 date from. They said they have my email, but it's been backlogged, and hasn't been checked yet. I then received a "1st reminder" letter on 6th December 2017, again asking for the £190. I phoned them again, and same story, she said my email hasn't been read, and not to worry about anything. Now today, 12th January 2018, I received a Magistrates Court Summons to pay off the £190, plus £18 for "costs". It does state "You are therefore summoned to appear before the Magistrates' Court at [address] on Thursday 1st February 2018 at [time] unless the said sum(s) (or balance) be paid, before the day of the hearing. Failure to pay in full will result in a Liability Order being requested at the hearing." Now, the last conversation I had with the council tax department was that my email had not been read, so they hadn't yet checked my evidence, and told me not to worry. Another point, I received a "1st reminder", but nothing after that. During the date mentioned relating to the fine, 9th July 2017 - 31st August 2017, there were people living at the address, and I told the council tax department over the phone on more than 1 occasion. During the date mentioned relating to the fine, 9th July 2017 - 31st August 2017, I was on ESA benefit, so the council tax for the duration should have been around £60 anyway, and not £190. So now I've been summoned to court. What are my options? I was talking to a friend who suggested the best route is to pay off the £218 before the court hearing to get them off my back, and then sue the council in small claims court for incorrectly charging me council tax, and then having to make payment because of being summoned to court, and also sue the council for causing stress and anxiety. He said it's important for me to pay off the fee firstly, because I have a suspended 8 week prison sentence, and though unlikely, the court could activate a previous suspended prison sentence. If I was to follow the route of paying them off, then suing the council in small claims court, how do I go about this? Do I need to get a solicitor? I assume I would get legal aid. Or do I just write to them explaining what happened? Or should I go through the financial ombudsman? I don't really have surplus cash to pay solicitors initial fees, etc. I currently am on JSA, but have been signed off by my doctor with depression from 2nd January 2018, for a month. I am taking medication, and having counselling help. This issue has added to my depression. My first step is to go to the Council Tax department on Monday morning, and ask them the questions I mentioned; why I didn't at least get a "2nd reminder", why I didn't get any letter after my email had been read and evidence had been checked, if at all they have yet, why they didn't take into consideration I was on ESA, and why they didn't check as I had asked, that I was named on the council tax will whilst living at my parents, etc. So the reason for this post is to get opinions of what I should do. Any help will be very much appreciated.
  11. Hi, Yes I've started my claim for JSA again, but I haven't as of yet signed. My first date would have been on Xmas day, so couldn;t sign on, so my first sign-on appointment is on 8th. My doctor signed me off for 1 month for my sprained ankle. Can't really walk for long periods on it as it's swollen. I actually did get a sick note which I realized yesterday as I must have popped it in the medicine bag. I'm still on JSA, not moved to UC. Also not claiming housing benefit as I have a mortgage, but have claimed for council tax reduction. The reason I'm so annoyed that I don't get paid in the month after my contract finished at work is because when they closed my claim down after week 1 of working, they said if I leave my job soon and it's not my fault, I can make a "RAPID RECLAIM" and my JSA would start back straight away. No mention of checking payslips or anything. So when I got laid off work without it being my fault, I did a "RAPID RECLAIM" and now they're saying they can't pay me during the first month as I've earned too much the last month. I might as well go send in my sick note, but I'm worried they'll make up some more lies and then when it comes to get paid on the 8th February, they'll turn around and say as I haven't signed on, I wont get paid again.
  12. Thanks for the quick response. My claim was closed after week 1, as the job center called me in and asked how many hours I had worked. Since I had worked 24 hours in week 1, they said they would have to close down the JSA claim immediately. I have found out that I do live in a Universal Credit Full Service. Also just used the Entitled To calculator, and it says I should get JSA and council tax reduction. But it doesn't ask anything about my previous job or wages, I suspect it would be the same case that as I got paid £545, I wouldn't get any benefits for 1 month. As a side note, I went to my doctors on 21st December, and he was willing to give me a sick note as I had suffered a sprained ankle on 17th December. I still kept looking for jobs and sending my CV out, thinking it takes a while to land a job anyway. I rejected the sick note as I told him I was not working. If I had taken the sick note and applied for ESA instead of JSA, would they still check what wages I was paid to see if I could live off that, or would they have started giving me ESA benefit money straight away?
  13. Hi guys I searched the forum but couldn't find any info on the situation I'm in. I was on JSA from October to mid November 2017. I got a part-time job which guaranteed me 12 hours a week. I started that on 14th November. They gave me a contract until 31st December. However, they cut that short as work had diminished. i left my job on 14th December. In the four weeks I worked there, I worked 24 hours in weeks 1 and 2, and 12 hours in weeks 3 and 4. After week 3 had finished, I called JSA to see if I could get extra benefit money as I had only worked 12 hours, and had been looking for a second job with more hour or a full-time job. I had an interview booked for 15th November. When I went to the interview, I explained that when I initially called them about low hours, I was not aware that my contract would be cut short, and explained that I had now left my job the previous day, and showed them proof of my termination letter due to diminished work. They came to a conclusion that I was entitled to £10.19 for week 4 and could not backdate as I had not shown enough reason for the delay of my claim, even though I explained them during the initial conversation that it was not possible for me to do so, as I could have been handed more hours towards the later end of week 3, since we did not have fixed hours of work. I decided there wasn't much point in arguing about not being paid £10.19 for week 3. I assumed I would start getting JSA from 15th December as I continued to look for work. I was asked to show my last payslip which I sent it. I got a call saying as I had earned £545 as shown on my payslip for the month of December, I would not be entitled to JSA until a month after I got paid. I got paid December 21st, therefore thy said I would not get any JSA support until after January 21st, as they expect me to use my earnings of £545 to get me through December 21st - January 21st. However, they expect me to keep signing on and continue to look for work, otherwise there would be sanctions. my question is, is this all correct? They're saying that after I was forced to leave my job on 14th December, I should use my earnings to cover a 1 month period, without getting any JSA support. They also expect me to continue looking for jobs and signing on. It all seems wrong as I'm seeking a job, and not getting job seekers allowance. In fact, I actually don't get my first JSA payment until 8th February as they pay 2 weeks after the month up to 21st January has finished. Any help would be useful.
  14. Hi, Thanks for the quick reply. My gripe with them is that they never informed me of the charge. I genuinlly thought it would be a free service, paid for on the NHS. If they had told me at the time that it would cost me £30, I would have told them to forget it, and informed my bank that I would not be paying for the letter. Considering they never told me the fee, I shouldn't be forced to pay up for it I'd assume.
  15. I got a voicemail from my doctors’ receptionist saying I have a document waiting for me to be collected. Had no idea what this could have been. Went to the doctors after work, and the receptionist hands me a letter, and says it will be £30 please. I remember that I had a medical form from my bank which I gave to the doctors to fill out back in September. But I never returned the form to my bank, and the bank just moved on, without ever asking for it back. When I handed in the letter to the doctors, the doctors never mentioned there would be a charge for it. Plus, it’s been 3 months since I handed the form in. I have no need for the form now. Can I just forget about the form and move on? I don’t want to pay for it as I have no need for it. I should not have to pay for the letter because I was never told there would be a fee, and it’s been 3 months, which is ridiculous. If they keep calling me about the payment, I can easily switch to a different GP. Had been thinking about it anyway. Would they write to my address requesting the payment? How far can this go?
