  1. I was pretty sure I’d updated Topaz when we moved 9 months ago but couldn’t find proof of posting so I wrote again just to make sure. Husband didn’t sign the letter just putting his initials and surname. They’ve replied back saying they can’t verify his signature so need to call them. I’m guessing this is just so they can talk to my husband. Does he just send another letter informing of our address and sign it. Thank you
  2. It’s the actual mortgage company that’s writing to him. Will they likely pass to a DCA? We have had the same letter about 3 times before just stating their intention to claim the money back but we’ve just ignored them.
  3. Thank you Im just worried about the stress that debt brings. Apart from a secured loan from Picture all other debt is long statue barred. Im guessing as they have 12 years to chase they can still try and get a CCJ even after 10 years
  4. Apologies. I looked under my Username and I could only see my topics about Picture and Police contacting my daughter about an alleged accident. Ive read through the post and now I remember they couldn’t supply the actual application form and they sent a blank once and a copy of the T&C’s. Is it worth me writing to them stating I don’t want any field agents calling and to keep all communications in writing and maybe asking the to supply a copy of the completed application form.   6. Please try not to worry. I had a problem a few years ago where I was working and my husband was on the sick. I hadn’t realised that after his SSP ran out I wasn’t eligible to claim childcare. There was over a year of being overpaid. They worked it out for me, wrote to me and took payments from my future tax credits awards. It took a few years but it’s all been paid back. No threats of prosecution or prison. They just wanted the overpayment back.
  7. I’ve had a look and don’t think I’ve posted about this. In 2014 our home was repossessed. No payments made since May/June 2014. Husband became unwell, lost job and everything went wrong. Ive kept them updated each time we have moved and yesterday my husband (was a joint mortgage) received a letter from them chasing the outstanding amount of roughly £50,000. It was an interest only mortgage. Im unsure how to deal with this. I deal with everything on his behalf due to his physical and mental health problems, They are asking for us to pay the outstanding or come to an arrangement to pay. They have enclosed an income/expenditure form to complete and if we don’t respond in 14 days they’ll send a field agent to the house. They have also said they’ll contact his employer or apply a charge to our property. Husband hasn’t worked since becoming unwell and we rent through a housing association. Could I have some help please in responding to them. I’d rather nobody called round and we have nothing to offer them. We live off Universal Credit, ESA and PIP. Many Thanks
  8. Yes she has a record of the chat. The DVLA said roughly 6 weeks to respond confirming she’s not in any way attached to the car. She did email the officer back but she’s on leave until 17th October but I’ll tell her to email again attaching the transcript. When it’s resolved can she make a formal complaint and where would she start. Thank you
  9. Further update. Officer named on the letter sent to daughter regarding a RTC has replied saying they got the information from the police database that is updated by the DVLA and that her details are connected to the car as the logbook/V5 has been completed using her details. Daughter has used online chat with the DVLA who have stated that she is not down as the owner/keeper of the car and never has been and if she sends a letter to them they’ll reply confirming this. Ill get her to send a letter to the DVLA tomorrow. In the meantime do we just wait for the police to contact her when they receive the s172. Thank you
  10. I knew one day it would catch up but at the moment we are trying to find a new home as our landlord is selling so got enough to try and sort out. 1 last question though. Would Link know the debt was originally a secured loan?
  11. Actually come to think of it Picture did pay the other creditors but I can’t remember who they were. Is it worth doing a SAR to find out?
  12. Thank you. Does the fact that it was secured (not anymore) and not regulated due to the amount make a difference to how they can pursue it. If I remember we took it out in 2006 but in 2007 we wanted to move and originally they refused to allow the sale of our house to go through unless we paid it off which we couldn’t so they said if we consolidated other debts increasing the loan we could so that’s what we done (we were desperate to move as my father had cancer and we lived 200 miles away) The last payment I think was around 2014.
  13. Just a quick update. Daughter spoke to advisor on 101 who spoke to officers at the police station that sent the letter. They are at a loss as no reference number on the letter but the officer named does exist. They’ve just advised to fill out the s172 and return which I’ve done today. I’ll update when we hear further.
  14. In 2007 we had a Picture home loan secured on our property. In 2014 the property was repossessed and since we haven’t made any payments. I have kept them up to date when we have moved home. The loan no longer shows on my credit file. I received a letter from them a few days ago saying they were transferring to a company called Asset Link Capital (No.7) Ltd. Today I have received a letter from Asset Link introducing themselves and saying nothing will change other than they will be collecting payments now. What is likely to happen now? I guess they’ll be asking for us to restart paying but we don’t have the money to pay. Can they also mess up our credit files which are now good and show no debts. I do remember being told as the loan was secured they have 12 years to chase the outstanding debt. Many Thanks
