  1. I have not received a letter. however, if I do receive one, i will scan it and upload immediately. if not, i will ignore them.
  2. This is the same phone call. I have not spoken to them since the time of the first phone call when i initially posted this message. I did not know that it was them as I haven't spoken to them in over 4 years. Unfortunately not. However, assuming that I am wrong and the balance was not settled 4 years ago as I believed it was, can they take legal action for a balance on an account that I defaulted on with the lender in 2009
  3. Thanks, but do i need to pay it? I was under the impression that it was settled anyway, but assuming it isn't - if i don't pay it, can they take legal action against me?
  4. They haven't sent any letters to me at all on it at this stage. So, to clarify, if the whole account has dropped off my credit report they can't chase me for it - even though i was still making payments on it through them until 2013?
  5. I have just been contacted by Lowell portfolio about two accounts. The second one which relates to barclaycard is below. An account with Barclaycard that I owed around £1500 on. They said i had a repayment plan set up with them which cleared the bulk of the balance (only £70 left). They said my last direct debit bounced but I have had no contact from them in the 4 years since the direct debit bounced. What is the situation with this balance? it does not show up on my credit report. If i refuse to pay, can this be added to my credit report (despite the initial default - with the actual lender - being in 2009) Any advice gratefully received.
  6. The T-mobile (now EE) was paid already. They took out a CCJ and I had the CCJ set aside and paid the balance. This one they're chasing me for now is an o2 account. I have no recollection of this at all.
  7. Hi, First of all, I apologise if this was posted in the wrong place. I have just been contacted by Lowell Portfolio about two accounts: 1. An outstanding balance with o2 for £500 odd. I have no recollection of this account. I had an account with T-mobile (now EE) which I defaulted on and have no paid up. This account was taken out in 2010 and defaulted in 2011. Therefore, if i did have an account with O2 it would have been prior to this and would therefore be statute barred? The person that I spoke to could not confirm the date of the default and have gone back to O2 to request more information - however, they have confirmed that I have never made any payments to Lowell on this account 2.   9. Reposting from elsewhere as I think I've posted inaccurately Hi, I had a loan written off by Wonga in 2014 for their failure to carry out proper affordability checks. I was told this would be wiped from my credit file. However, I have since found out that although it was removed from two agencies, it still exists on one. I contacted Wonga and they told me that in actual fact, I defaulted on two loans at once (I don't understand how this happened, how I was able to take out two loans at once, but that's for another day). They wrote off both loans, but only removed the default from one. I requested a statement of my account from the lender and had taken out 11 pay day loansicon in a two year period, some ranging up to £1,000 a time. On a number of these loans, I needed to take out a top up on the loan. I have complained to the Financial Ombudsmanicon that the nature of my borrowing history should have been a clear indicator that I was in financial trouble and that by ignoring that, Wonga have failed to act as a responsible lender. I have also included copies of my bank statements which indicate that for that entire period, I was living in my overdraft. Can anyone suggest whether this is likely to be a successful approach in removing the entries from my credit file?

  11. Hi all, Final questions The judge agreed the order based on the above: 1. Is the CCJ now set aside - how long do I need to wait before it comes off my report 2. It says I have fourteen days to pay from the date it was sealed. Is that from when the judge agrees it or when I receive something in the post etc 3. I called the management company (BW Legal) and they said that their agent hadn't confirmed the outcome yet and they'd be in touch. Granted it was only a few hours after the proposed hearing. Any advice on how to proceed?
  12. To be honest, I'm just happy to draw a line under it, hence paying it straight away. In your opinion, is this sort of arrangement likely to be accepted by the judge to ensure that the judgement is scrapped?
  13. Applying for set aside on a number of grounds - Firstly no communication was received. I have this issue a lot. There are two properties on my street with same number. One is an unoccupied flat. Secondly, it happened at a time that I was seriously unwell. I had a very high number of surgical procedures in that year and was suffering from depression. Haven't had the consent order yet. Will update once I receive it by COP today The letter says their client believes that my application is unlikely to be successful but their consent order makes 5 points: 1. The default judgement entered on (date) is set aside 2. That the defendant pays the sum within 14 days of the order being sealed by the court 3. The registration entry be and hearby cancelled 4. The claim is dismissed 5. No order as to costs Does this sound right? Grateful for any feedback on this
  14. Because if I owe the cash then I will need to pay eventually. Will entering in to a consent order increase the chances of judge approving set aside. Also, the lender has said there will be no need to attend hearing them as it will be dealt with by a judge before then. Is this true? Conscious of not taking the lender at face value but short of other outlets for advice.
  15. Due to have a hearing to set aside a CCJ next week. Lender got in touch tonight saying they would be happy to arrange a consent order and not contest my application. They are due to email me the evidence against me and if I agree then I'll pay up. What ramifications does this have on my hearing next week. Do I still need to go? What are the next steps Thanks in advance!
