Hello I am hoping for guidance please I have a capital one card that has a few charges on that I really can not afford to pay. I told capital one this and asked them if they would consider freezing the interest and refunding the charges then agreeing to a repayment plan but they said no and that is their final answer. So I then sent them a letter before action for the charges. This was then ignored and I have since received a default notice. The credit limit is only 200. I have a standing order set up for 10 a month and this is all I can afford. But when they are adding 24+ a month in charges plus interest it is obviously not reducing the debt. Are capital one allowed to issue default notice in response to letter before action? I can now afford the court fee this week so where do I start with putting together the information for the claim? Can I now add the charges that they have added since the letter before action? Thankyou for your help Xx
