MCOL help not being paid for job
FTMDave replied to Lorenz's topic in The building trade and installers
Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court. If you Google "Form N180" you can see a blank copy on government web pages. -

Well done on reading the other threads. If ECP haven't got the guts to do court then there is no reason to pay them. From other threads there is a 35-minute free stay after which you need to pay, with the signs hidden where no-one will read them. Which probably explains why ECP threaten this & threaten that, but in the end daren't do court. As for your employer - well you can out yourself as the driver to ECP so the hamster bedding will arrive at yours. Get your employer to do that using the e-mail address under Appeals and Transfer Of Liability.

Andy and dx are spot on. We find that if someone fails to file the DQ/N180, then the court gives them a second bite at the cherry. It's only after a second failure that the defence is struck out and the case lost. So you'll be alright. However, this failure to respect court orders has to stop. You're in a legal battle. If you're away from home for an extended period make damn sure someone is checking your mail.

I've been on this site for eight years and I haven't seen one PPC case where a DCA turned up at the motorist's door. Even if they did they couldn't do anything, but in any case it's never happened. If you read this short thread you will see all the stages of the legal procedure all the way to winning in court, which is highly unlikely to be necessary in your case https://www.consumeractiongroup.co.uk/topic/406892-highview-parking-anpr-pcn-claimform-urban-exchange-manchester-claim-dismissed/#comments

Your letter is superb. A couple of months ago it would have led to instant victory. The problem is that since then there has been a tsunami of these cases and Starbucks have got fed up. However. nothing ventured ... I've made a little addition in red above so they know that you know that they have the power to intervene and have done so numerous times in the past.
