  5. Hi, Thanks for your reply. .The vehicle is BMW 320d 2008. Engine knocking loudly. he managed to rebuild the engine with one year warranty. .after two weeks the engine knocking loudly again . .I sent the car back to him by recovery vehicle 6 weeks ago now, he tried to run away from the warranty by giving new excuse everyday. .He told me to pay half the fee (£200) and when I sent it to him over online banking he changed the overall price and made it more expensive. When I told him I didn't want him to fix my car anymore he refused to send me back my money. .to sum up, he wants me to pay half of the overall costs which he now claims to be £980; £200 now and £280 upon collection. . we had also agreed that the car would be done by wed 4/11/2020 but when I sent the upfront payment he changed the date to 6/11/2020. .I messaged him after telling him that he cant finish on 6/11/2020 due to the lockdown, which he responded to by telling me its done when its done. .On 4/11/2020 he messages me telling me he cant work on the car and that he'll finish it after lockdown. I have all the text messages and bank transactions on my phone, when needed I can present them them to you.

I took my car to a mechanic that I found online and I paid £1200 to get them to fix it, they fixed it and gave me a warranty which is valid for a year, after 2 weeks the fault with the car that they fixed came back and the car stopped working completely. I sent the car back to them for repair under the warranty and he claimed that the warranty was fraud that I made so that he could escape responsibility, when I told him I was going to take legal action he then admitted that the warranty wasn’t fraudulent and that he would fix it but that he couldn’t fix it right away as they were busy. When he checked the car he claimed that the problem was with the injectors (which are not covered by the warranty but when I had taken the car to a different mechanic before they told me there was nothing wrong with the car). he kept using abusive language over text and saying that he was going to leave the car in the street with the key inside but whenever I told him I was going to take legal action he would then say he was going to fix the car. last Friday he sent me a message saying that he would fix it but that I would have to pay half and pay it upfront, I sent him the upfront cost of half the total fee but when I sent it he then decided to ramp up the price , I then told him that I wouldn’t go ahead and told him to send my money back where he then refused and when I told him again that I was going to use legal action again he told me that he never gave me his real name so I can’t get him and that and that the bank account that I sent the upfront cost to was under some one else’s name . We had also agreed the car to be fixed on Wednesday but after I sent the upfront fee he changed it and said it’ll be done on Friday and despite me telling him about the upcoming lockdown, he still persisted that it would be done on Friday. On Friday he messages me telling me that he cant work during lockdown (even though I had warned him about it) and that he will only start working on it after lockdown. Now I don’t know what’s happened to my car or even where it is since I cant travel during the lockdown to check on it, if you guys could inform me about a free legal aid solicitor that would help a lot seeing as I’m not in a good financial situation at the moment and he has taken a lot of money out of my pocket.

  8. Hi All, The Magistrates' Court has issued 6 point from my driving licence + £250 fine. that was in Jun 2017 under MS90 (Failure to give information as to identity of driver etc). In 2017, i worked as a Driver team leader, and my job required me to train 5 new drivers every day. the following day, i was instructed to provide each driver with a new car to start work the next day. All cars come out from the company under my name. one of the drivers, whilst driving their assigned car, drove past the speeding limit and was captured by a speeding camera. the police contacted me, as all cars come out from the company under my name, and took 6 points off my licence and i was required to pay £250. we do not keep record of who drives what car. Now I have about 9 months left for my points to expire, I am 52 years old and I am responsible for a big family. I have an offer for a better job that will help me financially somewhere else, However, they said that I need a clear driving licence with no points to get the job. I think, according to my age, this job offer is not going to be available again in my work life. I am thinking to write a letter to the court asking them to remove/Expire the point in my licence early. What do you think? Correct me if I am wrong/ advise if I am right. Thank you.

  10. The Court issued a judgement of £235 fine and six point of my licence. do you have any idea how I can reduce the six points?
  11. I work for a company that employs more than 1000 Trade plate drivers; we travel all over the UK delivering and collecting vehicles for many different customers. Many of the places we go to are quite remote, airfields and large compounds etc, there is not usually public transport to many of these places. The only way we can complete our work is to work with other drivers, sometimes this is arranged by the company and sometimes we arrange this between ourselves. When there is public transport it can often take a long time to travel between jobs, and quite expensive. Therefore, working with other drivers is normal. I received the notice from Metropolitan police was about seven weeks after the incident asking me to identify the driver of the car at the incident time. On average we will complete about three jobs a day, on that basis I would have driven about one hundred vehicles in average of three to four cars a day. How many drivers I would have worked with is not possible to work out. Under those circumstances I do not know anyone who could remember the details of a specific car or who they were working with at a specific time of the day seven weeks previously. The company do not keep records of who works with who at any time, the only thing they are interested in is that all of the assigned work is completed on time. I have asked many drivers if they can remember working with me on that day, none can. I have looked at any written notes I keep; this has not helped. I have checked my mobile phone to see who I spoke to around that day, nothing I have done has enabled me to identify who would have been driving at the time of the alleged incident. Also the photographs sent to me earlier by the Police wasn’t clear enough to identify who was driving the vehicle at incident time. I understand that the Police will ask for any information that will lead to the identity of whoever was driving, and in most cases it can be provided. I have however read what the law says in this situation. It clearly says that a driver/keeper cannot be guilty of failing to identify who was driving if they did not know with reasonable diligence. It seems common sense to me that the law was written that way because of exactly this kind of situation. The law also says I am not required to keep records. I accept that this is a very unsatisfactory situation, I remain willing to do anything I can to identify the driver concerned but I cannot see what else I can do. Metropolitan Police write to me again saying that I have a legal responsibility to identify the , further action in this matter has been suspended for 14 days. I do not know what I have to do with this, Thanks
