  1. Hi I can also confirm that I was recently made bankrupt by CWD due to being pursued by a UAE bank. I have recently had my meeting with the Official Receiver. Interesting that the judge said in your case that the UAE bank should now close any criminal case in the UAE due to the bankruptcy. That would seem fair as the UAE banks are using UK courts and the legal system to pursue people so once the matter is settled they should abide by the decision and not have a case left open in the UAE preventing you from ever returning there. It will be interesting to see if the UAE banks respect that recommendation, I suspect not though knowing how they behave. I have a number of other UAE debts that I haven't yet been pursued in the UK for through CWD or any other solicitor. The OR has stated that all my outstanding debts will be included in the bankruptcy whether they have taken legal action in the UK or not. That is a relief as I was concerned that once discharged from bankruptcy CWD would pop up again with another claim. It would be good to hook up and discuss your case with mine.   3. Nothing further to report on my case as yet but setting up a basic forum via one of the hosting companies should be quite easy to do.
  4. Hi Dalesford I think that you need 10 posts before you can send a PM to another member so I'm almost there. I agree that you have to be cautious of online forums but if a group is setup I'm sure you can protect yourselves and others by having people sign up to a disclaimer etc and getting them to provide proof of themselves and their CWD engagement. Let me know when you hear from your contact and yes anyone else please express your interest in forming a group.
  5. Hi Dalesford Thanks for coming back and providing an update on your situation. I am in a similar position, received the standard letter from CWD just recently regarding one of the banks I allegedly owe money to. The banks and collection agencies have been resorting to all sorts of disgusting behaviour, calling my parents and sending emails to random people in the company that I work for trying to cause embarrassment. I agree that there needs to be some collective action so that people can fight back against these bullies as individually it is very difficult for people. I strongly believe that the legal argument that CWD is basing it's claims on is very shaky, hasn't stood up to scrutiny by a reputable city firm and that they are only targeting people in the main with properties in the hope of bullying and frightening them into entering a payment agreement. I work for one of the largest global law firms, I'm not a lawyer and the firm only deals in corporate law but I am getting some informal advice on the matter. I would like to setup a support group that people could join in the hope of getting some sort of class action together to take the fight back to CWD. I'm sure people in the same position would benefit from a collective approach. I have tried to post an email address on here before but it has been removed by the moderators to protect people so that advice can be given in the open on the forum. I respect that but this is a plea to the moderators to allow people to reach out and communicate to others in the same situation. Could I post an email address please? Thanks

  7. Dalesford this is great news to hear that someone has had a victory against the bully boys at CWD and thanks for posting your experience. Please keep us updated on how things progress. I'm sure everyone who has been in the same position as you will take heart from this. It would be great if you could share the details of the argument you used to have the SD set aside so that those still fighting can benefit and prepare themselves. Although hopefully now that CWD have suffered this defeat it might stop them from continuing cases against other people.
  8. Hi All I have been speaking with a solicitor about CWD and these cases so hopefully this information will help some people on here. He advises that what they are doing is wrong and that legally they have no case to pursue these debts through UK law. It's only the bully boy tactics and the fact that people have not been able to defend themselves with a solicitor that they have been getting these judgments. Ask CWD to provide details of the proof of assignment in any agreement that provides the legal basis on which they can seek judgment in the UK on UAE debt. They will tell you that there has been no assignment of liability which means they can't issue proceedings in the UK because the debt can't be assigned. He says the debts are not enforceable. People keep referring to the memorandum signed between the UAE & UK in 2013 but this is not something that is binding in UK or Common law. A reciprocal agreement is not something written in to UK law. Ask them what Act or Statute that is written in case law states that UAE debt is en forcible in the UK. Ask them to provide the case/quote including full citation and paragraph number Tell them that you will attend any County Court hearing in Northampton and seek to have any judgement that they apply for against you to be set aside. Defend yourself and file a defence saying that it is outside the jurisdiction of the Court. Any agreement must say it is binding in the UK. Judgments are not enforceable from the UAE in the UK. It needs to be governed by UK law. CWD will tell you that the UAE credit agreement states that the terms and conditions are governed by the laws of the UAE. You and we submit to the non exclusive jurisdiction of the civil courts of the UAE. Such proceedings shall not restrict our rights to bring proceedings against you in any other jurisdiction. They can't have it both ways, it's either UAE or not. The UK courts do not have jurisdiction for UAE agreements. You need to say that the Court has no jurisdiction to hear the case. The terms state it is dealt with in accordance with UAE law. A UK Court does not have jurisdiction to hear UAE law cases.
  9. Hi all, I too am keen to find out if anyone has any updates on their situation with CWD as it seems to have gone quiet on this and other forums. Does anyone know if it would be possible to get a group together of those people being targeted by CWD and appoint a solictor to represent all of them. Like a class action I suppose?
