  1. Spoke to EDF. They were happy to accept 10% of total debt and 24 mth repayment plan to stop action!. I was amazed and accepted their offer.Still can't believe it to be honest. Thank you for your kind support and replies.
  2. £1800 on Elec and probably similar on gas. I think I last tried to sort it out about 18 months ago and would have been making payments at that point. It's all a bit vague I think I contacted them to sort out some arrears and they wouldn't discuss them until I took a new tariff. They then told me I had to sort tariff on web, and when I couldn't get it to go through, were going to investigate and come back to me. I chased a few times and then forgot. Letter only mentions electric.

Had a letter this week, no date on it and it looks like it came with post, saying Grosvenor Services are applying to the magistrates court on 19th Sept for a warrant of entry to install a prepayment meter. We do owe EDF a fair whack. I will take the blame for most of it but it has to be said EDF have failed to respond to calls and requests from me when the DD originally failed. However, I am not disputing that we owe the money but need time to pay it. There is no way I want a pre-payment meter installed. I will be at best divorced and possibly dead if OH finds out (Slight over dramatisation - I am safe really) I have not been contacted by EDF other than for meter readings, so I didn't realise we were still not making any payments - no excuse I know, but just wanted to outline the scenario. The letter says they have tried to gain entry previously, but I have had no correspondence about this or seen any evidence to suggest this is true. Could it be this letter they are referring to? Is there anything I can do to avoid a pre-payment meter? I don't have a lump sum but could probably clear the debt at 70-100 per month. Do I call them or write? Please be kind with replies, I haven't been well, I was incredibly stressed without this and I know it's (mainly) my own stupid fault Thanks
  4. We had a failed business 13 years ago and our personal finances crashed as a result. We defaulted on a loan and over draft with Llloyd's that they combined and obtained a Charging Order against our house for. I was very ill at the time but have a vague memory that they may have got it through even though it fell below some limit allowing them to do this... but I can't remember clearly. 6-10 years on (at least) they've never had a single penny off the debt - seeming to be happy to wait for it to be paid in full when we ever sell the house. Never asked us to set a repayment or anything. But now I have a letter from Moorcroft... If it was ordinary debt I'd know how to fend them off (I'm sure this fell under the 15 k limit originally. ..) but they are referring to the CO in their letter and asking me to let them know 'what our current repayments are' Should I contact them?
  5. The last day to avoid it registering is Tuesday. I thought it was 30 days but even if it is 28, that is the day Shoosmiths have said it will register. I'm toying with paying the court fees for a N244 on the basis that Shoosmiths never replied to the CCA but I have no proof that I sent it.

  8. Hi all, I think I know the answer to this but I just wanted some advice/confirmation if possible. I had a M&S card many years ago that I was paying off but defaulted on LESS than 6 years ago - probably around 4 years ago. The debt has now been pursued by Shoosmiths who put a CCJ application in before Christmas. I contacted Shoosmiths, who told me they would not apply for judgement to be entered whilst they put my offer of lump sum to Arrow. The total debt was around £700 and I offered £250. They took ages and ages to respond - way past the point of being able to enter a defence to the claim, and then wrote to me declining my offer and asking for my proposals. I responded with a CCA request and heard nothing else until the CCJ arrived in the post. I have been bombarded with letters from Shoosmiths offering me a 'substantial' discount to settle in full, but if I ring they will only offer a 10 % reduction which I can't afford. I have had a terrible credit file for years but it is finally clean and I really do not want a CCJ on there now. The 30 days from judgment falls on Tuesday - is there anything I can do to stop this, given Shoosmiths never responded to the CCA request - which they are now denying even receiving I have scraped together £500 now but they are saying that Arrow have 2 weeks to respond to my offer and so the CCJ will be registered even if they did accept that. Is there anything I can do to prevent this or do I just need to take it on the chin. I've had some serious private problems that meant I didn't see my post as quickly as I should - hence the delay my end. Sorry for the rambling post, but I would appreciate some advice even if it is 'you are stuck with this' Thanks
  9. An update: I contacted a fabulous firm of solicitors after googling as suggested above. I also sent off a CCA request. This week Lowell's admitted they have no evidence and settled my costs. The debt is totally unenforceable. I am delighted and relieved and would advise anyone in a similar position to do the same as me. The solicitors were an absolute Godsend - as was all your helpful advice on here. Many, many thanks.

I have googled as suggested and will contact the most prominent result tomorrow I have a statement from another debt that was being paid from the same voluntary arrangement and that shows the last payment received as July 2008, so I think it would be the same for this one. What I am wondering, is if I claim that it is statute barred (as I hope/wish!) and that stops action, what happens if (and I think it could be a big 'if') they are able to prove it is not statute barred after all? Am I in a worse position, or does the clock start ticking for the 18 days again? We are able to pay the debt now - but only in small monthly amounts and I am frightened to phone them and get into a conversation about affordability etc... We had an awful time years ago and it's took us a long time to get ourselves straight. I still get panicky and tearful just thinking about it. Would I be better to just negotiate with them?
  11. Hi all, Years ago we had a failed business and were left with massive amounts of personal debt. We had an arrangement with payplan for about 12 months before we could not even afford to pay that. I think the last payment to payplan was around July 2008 (just under 6 years ago...) I have been served with a stat demand from Lowells for a Lloyd's card with a balance of 4.5K. At first, I researched on here and thought I could just reject it as out of time, but now I am thinking it may not be. Any advice would be greatly appreciated. It was served last Saturday, so 8 days ago. Whatever I do now, how will the bank holiday this week and next affect the time scale too? Thanks in anticipation. K
