I feel as if my mum has pretty much buggered herself, especially by going to the citizens advice and filling out the FORM4A and admitting liability for this (which I assume she has) I guess all she can do now is contact them "SHOOSMITHS" and ask for a lower payment each month. She defo wouldn't be able to attend court.

Here is a snipet at the bottom of that form: 5. If your claim is successful, what do you want from the respondent? ⓘ You should select the option(s) that best describes the type of order you would like the court to make if your claim is successful. You can ask for more than one type of order to be made in a claim. ⓘ You can also ask for alternative orders. For example, you could ask for the respondent to be ordered to repair something of yours or, failing that, to give you money to buy a new item. ⓘ You should set out the detail of what you would like the court to order next to each option that you select. ! I want the respondent to be ordered by the court to pay me a sum of money: Also, that was already filled in by ARROW in the forms that my mum recieved from the Sherriffs Officers.
  3. Hello again. Sorry for the delayed reply. Although, regarding the posts from 10th July and 6th August, I never received any emails saying I had replies. Not sure what has happened there, as always get an email notification? a while back, my mum went to the citizens advice and they helped her fill in the form. Putting down all her income and outgoings. They agreed that my mum isn't really able to afford this but , because it needs to be paid, and is a high amount, she will have to offer £50 a month in payments. A few days ago, my mum received a letter from SHOOSMITHS solicitor (Edinburgh) on behalf of ARROWS, rejecting my mums offer of £50 a month. The letter says "Our client has confirmed that they will reject your offer for time to pay instalments at a rate of £50 a month and we will contact the court in order that they can issue you an installment decree in those terms. Once the decree is granted by the court, a copy will be sent to you" They also said that they are concerned about the offer of £50 , as it appears my mum has no income after all her outgoings, and ask how she would be able to pay £50 a month, as it seems this is not affordable to my mum. They then said if she can make £50 a month, please contact them so they can extend her payment arrangement. So what does all this mean? Does it mean they are willing to accept a lower amount from my mum I.E £10 month, or are ARROWS saying they want the money now? Also the bottom of the letter says my mum can phone them and agree an affordable amount each month or, if she wants to, she can contact the citizens advice for help. A bit strange because, it was the citizens advice who helped her fill in the form. Oh, the citizens advice brought the whole you might lose your house if you dont pay this, which got my mum all worried and crying again!!!! Thanks.

I have tried scanning the document, but, I don't know how to use the scanner It's 26 pages long, and on the front it says: FORM 6A The Simple Procedure Notice of Claim At the bottom of the first page it's signed: Sheriff Officer Queens Road Aberdeen. The firm is called: Arrow Global Limited And no, not moved. We still live in the same house we have lived in for nearly 28 years. Thanks.
  5. Hi Andy, Thanks for your reply. The only thing I presume my mum will have received is the usual debt letters in the post. This is the first time we have ever had anything like this, people knocking on our door, and then handing us documents to pay up, or go to court. Thanks.
  6. Hello, We just had the sheriffs officers at the door, for an old credit card debt my mum has/had. It was a Halifax credit card, however, Lloyd's must have taken over Halifax? As the papers we received today says Lloyd's. It says my mum used her card between 2002 and 2008. I told my mum in 2014 to stop paying them as, she "we" couldn't afford to keep paying them. The papers say that the last payment made was 2014, and in 2015 the bank sold off the credit to debt companies. I assume the debt would have been passed to other debt companies during the past 2 years the debt is now with Arrow Global Limited. They say that they sent my mum 3 letters between 27/03/17 and 26/04/17 and because she never responded, this is why the Sheriff Officers are at the door. The amount owed is £3,300.01. They said my mum has 1 month to pay the money, or she will be taken to court. What do we do? My mum is crying and all hysterical and is upset with me because, I told her not to pay the debt, and that debt in Scotland gets wiped off after 5 years. Maybe I was wrong???? She keeps saying we are going to lose our house, as we own our house "no mortgage" The 2 of us are on DLA benefits as well. Thanks.
  7. Thanks for your reply. I was originally on Incapacity benefit back in 2008 till about 2012. It changed to ESA, and I attended a medical. But like many other people, I was awarded 0 points. I appealed it, and after about 2 years (2014), I won the appeal. I was placed into the work group. I was going to appeal but I was told by a few people, there is a chance they might even take me out the work groups and I would lose my ESA. As you have mentioned. I really didn't want to risk that, and didn't want to go through another 2 years of appeals. Just checked my bank, and I did indeed receive my ESA benefit. However, it/s worse than I expected. Instead of the usual £204, I received £3.10. Next 2 weeks will be a struggle. 22p a day. Already lost 2 weeks benefit, apart from the £3.10 they paid me. No idea how they worked out the whole £3.10? £1.55 a week. I have no idea how to appeal this
  8. Thanks for your reply. To be honest, I have never heard of ESA wfg. Only ESA WRAg, and ESA support. Yes, they say the triage appointments are mandatory. She rude woman that phoned me back, did say something about a sanction. I will appeal this if I am able to. Thanks
  9. Been going to Triage for nearly 2 years now, and I am in the work related group. Used to have to attend weekly and fortnightly sessions with other people till they put me onto monthly sessions quite some time ago, as they said they feel that I am not ready for work. So now I attend once a month, and it's a 1 to 1 with an adviser instead of a group. But, I was kept on the same ESA and not put into the support group. 3 weeks ago I had an appointment. It was scheduled for 10am. However, I was feeling ill the night before and didn't fall a sleep till around about 6.30am. I work up about 10.30am, and I immediately contacted Triage. They told me they would have to inform the Social that I had not attended my appointment. This is the 1st time, I have ever missed an appointment. Triage rescheduled my appointment for 2 weeks later, which I attended last week. They then said they wanted a quick chat with me yesterday, so I attended that too. So have had 2 appointments, and attended both since missing the one 3 weeks back. Received a letter from the DWP today saying that my ESA, has been stopped, till I start re attending my Triage appointments. I phone the DWP and told them that I have actually had 2 appointments, and been to both since missing that original appointment. he woman said that, they have had no word from Triage (I phoned Triage after the call and they said that had informed the DWP, but will call me later to see whats happening, to be honest, Triage probably hasn't informed the DWP, as they are not well organized) Anyway, the woman (at the DWP) told me that my payments will restart once they receive word. I said, so have I lost money? She said "Yeah, it's just a weeks payment so far" Just a weeks payment??? I am due Monday (always been paid on Saturday though) Starting to worry I won't even be paid if they haven't been informed from Triage that I have attended since missing the original appointment. But even if I do receive payment, they will deduct a weeks ESA from me for missing that 1 appointment. The first time I have ever done that, not by my own fault, and I phoned when I woke up. But they feel that's acceptable to take over £100 away because of this. Do they have the right to do that to me? P.S Just received a follow up call from the DWP, and the woman told me they have every right to take away 1 weeks benefit from me. I said well personally, that's crazy taking away £100 for missing an appointment. She said well, just like everybody else, if we miss appointments we lose money too by charges etc I didn't say this as it didn't cross my mind during the call but, who the hell would lose a weeks money by not attending a doctors, dentist, etc appointment? She finished off by saying, you only have to do minimum tasks such as attending once a month appointments, and you failed to do that. What a rude woman.
  10. Finally managed to save some money towards a bed, after sleeping in the same bed/mattress for the past 13 years. Went to Bensons For Beds and seen a bed I liked 8 days ago. It was actually the 2nd cheapest in the shop but still cost £400 for a double bed. I am a rather big guy so I do need a double size (in all honesty, I didn't realize how much beds were nowadays) The woman asked me how much I wanted to pay today (at the time) and I just shrugged my shoulders and said "£100?" She ok and took the £100 from me. She told me that, my bed will be delivered after 12 days and that I must pay the remaining £300 within the next 5 days. However, I had an unexpected bill (not quite £300 but, it meant not having £300 at the weekend) and called them the other day and they said ok, just pay us on Monday "which is today" The thing is, I am back to having £300 savings again today. However, got a call from a family member just last night asking me if I want a bed as they are moving abroad and had just bought a bed not that long ago for guests. What is the chances of that?!!!! They said I can have it or they will be giving it to the charity shop. Just been reading the terms and conditions and it said that, after purchase, I had 1 day to cancel my order and if done after that time, they will refund me, minus 20% of the price Where do I stand here? Because I have only paid a deposit, can I get my deposit back? Or will they keep £80 as that is 20% of £400 bed. The £300 I have saved up, plus the £100 deposit I paid, really could go towards helping repairs in my house, as my house is in such a mess. Thanks

  12. Just found out, my mum has been paying money every week to Halifax for years! She just told she she has been paying £10 a week for a Halifax credit card, and £10 a week for a Halifax overdraft! She told me, she has been paying £20 a week since my Father died 8 years ago. She said that, at first she ignored them but they kept adding charges to both the credit card and bank account and she was worried about being taken to court! I just told her to stop it but, she said "You have to pay the banks" and is worried that if she does not pay them, they will take her to court and lose the house (My mum own her house outright, no mortgage) I only found out as, I answered a call from 01224 908402 this morning and a company called idem servicing wanted to talk to my mum. I was in the room while she spoke and the woman was asking why there had not been a payment this month. I could not believe it Should my mum just stop paying them? Thanks
  13. Just been looking though old stuff on my computer and I came across a document I made a few years back 2011, I stupidly signed up via this website to apply for a "guaranteed" loan. However, I was then instead, giving a bunch of loan companies for which I know of anyway and also for who will not give me a loan. I cancelled my account with this guys after 5 minutes. Later that night, I phoned my bank up to check my balance and I was then shocked to learn that £67.70 had come off my account from that company! Never once was I informed from there was a charge for joining you this company Later, I read the small print on the site in the terms and it said: "Cancellation 4.1 A one off joining fee of no more than £74.85 is payable in most cases after you have had an average of 14 days membership and access to the site. If you have not cancelled/terminated your membership with us, you will be automatically charged by a direct charge to the debit/credit card authorised by the member with an ongoing membership fee of £8.89 which is payable monthly until such time as you decide to cancel your membership. 4.2 Under the Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel your application within 14 days of receiving these terms and conditions and receive a refund. By this point, I contacted a company (I cant remember who, maybe the fsa) I got a call back from another company (I also dont remember who but they were based in Aberdeen) who said they would get my money back for me, and that they had to deal with it cos, the amount I was after was not a big amount but they would still need to take a small percentage, about £5 or so and I said ok. BUT, I never did hear anything back from those 2 companies or even the dreaded ezeloan. Yes, my money is long gone and I cant do anything about it now but, I was just wondering, if these people ever did finally get into deep trouble??
  14. I was rewarded lower rate mobility and lower rate daily living care yesterday. Do I need to inform the DWA because, I also get ESA currently? Thanks
  15. Hi, Thanks for your reply. Before the first hearing, the DLA people sent me a letter informing me of the date and it said on the letter that, "You may attend the hearing with or without a representative, however, if you or neither the representative attend, the hearing will go ahead"
