  1. OK a little update I finally had my Appeal at Tribunal today and WON!!! Tribunal awarded me 21 points and over turned the ATOS nurses assessment which awarded me 0 points. I have been put into the WRAG with the suggestion that I should not be assessed again for at least 18 Months from todays date. It took 16 months from first being signed off by my GP to get to todays decision but I WON so there is still a little Justice out there I also got the distinct impression that the Doctor on the panel at least was disgusted by the ATOS assessment of 0 points I was in the Tribunal for around 40 mins Judge and Doctor were really nice they Told me after we spoke to wait in the waiting room while they discussed my case between them. Literally 10 mins later the clerk said please come back in so i thought the worst being such a quick decision I was worried it had not gone my way but was given the Good news they said there was little to discuss and the decision to uphold my appeal was easy. So take heart everyone going through the ESA grinder it takes a while but fight the Good fight and there is light at the end of the tunnel

Wow scary stuff indeed I am currently awaiting a PiP assessment and this News if true is almost guaranteed to fail me and leave me on the Tribunal route again (Currently appealing ATOS assessment that passed me Fit to Work) PiP was my last hope of being able to have any sort of quality of Life. I am now so worried after reading that post that I am actually feeling physically sick I don't know if I can survive another case going to appeal I have been told December will be the earliest my Fit for work Tribunal appeal and if PiP fails it will be next year before that gets sorted. All told I will have been waiting a total of 20+ months since the beginning of my Claim I am astounded that 21st century UK care for its disabled population has sunk so Low.Its a war of attrition and DWP is winning
  3. Hi there. The current wait time for getting to an ATOS medical is between 36-44 weeks so I don't see you getting it any time soon Sad to say the Medical assessment itself is a farce anyway IMHO the best you can do is phone ESA/Atos once a week every week to try and move things along. As one ATOS call center adviser told me He who shouts loudest gets heard meaning phone once a week not scream down the phone As to getting longer sick notes Only your GP can do that for you have a word with your Doctor to see if they can be extended though your Doctor may only be issuing you 1 month at a time as there is an expectation that your condition may improve? I'm sure the wiser posters will be along soon with some Advice too.
  4. OK as expected I received my MR decision in writing today 2 copies only 4 pages in total will be going to CAB tomorrow to start my appeal and get some help with the forms. I have requested a copy of the WCA transcript of what happened at my ( SO called Medical assessment) ESA 85 i believe its called. Do I also have to request an in depth transcript from the Decision Maker as to why I was awarded 0 points from my ATOS assessment. I was expecting a Big envelope from the decision Maker explaining how the reconsideration was reached not just 2 paragraphs on 1 piece of paper? Any advice gratefully received as I want to be fully armed when I go to appeal also do I need to wait to get all information in and have my case built to send with the initial request for Tribunal appeal or will I get some time to gather the info and refute the total Misrepresentation of the ATOS Nurse then send it in after the first request for appeal?
  5. UPDATE:- So after a 6 week wait I finally heard from a Decision maker today He was very adversarial from the start. He said he had received no further information from me regarding my case and wanted to know why I wanted reconsideration So I told him I was going to refute everything the Nurse had said in the report as what she had written bared no resemblance to the truth and was in my assessment a complete fabrication. He asked for an example so I said about the first part of the statement Nurse asked me if I did Shopping and I told her yes I just about manage to go shopping once every two weeks to which she replied how long does that take 10 minutes I laughed and said no it takes maybe 45 mins with either the assistance of my son who is a virtual unpaid carer and on the odd occasion that I can't have my Son go with me I had to rely on the Shop staff to help me from start to finish. I also told him that I must keep stopping whilst doing so because of Pain and exhaustion and most times will have to take a seat while my Son / Staff collected what I needed. Nurse wrote Mr. XXXXX states that he can regularly walk for 45 minutes around the supermarket and that she observed me walking for 15 meters from examination room to waiting room using only 1 stick real distance maybe 8-9 meters and from that observation and my "Typical day"? I have NO problem walking 200 meters without any disability with any area of Physical functioning. DM said why did you not tell the nurse you had significant difficulty and required someone to be with you to which I replied that I did indeed tell her I need help of of my son / Staff to help DM also stated I had told Nurse that I have no problem using public transport getting to the supermarket and that it was 75 meters from the Bus stop I told him the Bus stop is less than 30 meters from my house and stops right outside the Supermarket and when i got there i needed to rest in the coffee shop there to regain the strength to be able to start shopping and I also needed to take a taxi home afterwards as the sheer exertion of getting there managing to do my shopping once every two weeks was so exhausting and left me in such Pain I would not be able to cope with public transport back home and if (Rarely) I had no one to go with me I relied on the Taxi driver (a firm that knows me well and is bend over backwards to help luckily ) to bring my shopping to my house. I also stated that this activity would leave me in such pain and exhaustion I would need 3-4 days to recover from it. DM then said that none of this was told to the Nurse on the day of my assessment so I said it was all said that day to which he replied Why would the nurse not have put it in the transcript as ATOS are an independent body and Have no vested interest in not telling the whole truth and have not got any targets or incentives to Fail anyone. DM then went on to go over a few other things in the original Decision transcript all points which I was disputing and basically told me the Nurse had no reason to lie or embellish the truth and that I was the one being untruthful! DM then said that nothing I had said would make him change his mind over the original decision so did I want to carry on with the MR or just drop it there and then. I said I did indeed want to carry on with the MR and he said "Then I will write to you within 7 working days with his decision which would uphold the original decision and you can "TRY" to make a case for the tribunal" and just put the phone down no thankyou or goodbye. I am terribly upset over the whole conversation with the DM and his out rite open hostility towards me and his unwavering defense of ATOS and its Nurse doing absolutely no wrong and his condemnation of me as a liar and a fraud (Not said in those exact words but heavily implied) I hope I get fairer treatment at Tribunal when I finally get there in 6-9 months as the last 11 months since I was signed off by my Doctor has been absolute Hell being treated like a parasite, scrounger and a liar has had a major impact on my well being the Only good thing about todays conversation is that the MR has been made and soon I will have the paper work to send to the Tribunal and can be put back on assessment rate ESA while I wait to be heard in the Courts as the Last 6 weeks I have been forced onto JSA as the only avenue for ANY money coming making my various conditions 10Xworse jumping through their hoops even my Doctor said if I was to carry on I would put myself in Hospital and do serious damage to my health. Sorry for the wall of text but I needed to tell the story of today to stop me breaking down in tears. I will keep the post updated but have been told by CAB not to expect a resolution for atleast 6 months. Maybe my claim for PiP will go better though with ATOS doing those assessments and at last phone call being told that it could be July/August at the earliest before I get my appointment (Claim made beginning December 2013) and their obvious predisposition to twisting, making up their own Truth I can't say I'm hopeful of getting any kind of result in my favor. My Advice to anyone reading this thread is hope you don't get ill we are the New social pariahs and are treated in a shockingly inhuman fashion!

These forums are designed for people seeking Help from the community and threads like these are Helping no one Unless you think inciting a "Possible" Flame war between opposing sides of the Coin and generating genuine Stress and Anger is Helping? Just my 2 penny's on the situation you may think I am too sensitive and you may be right but it is how I feel about the OP

It states in my JSA agreement that I can work 20 hours maximum a week so my Adviser is trying to fill that 20 hours a week with courses and now it seems a Work placement too She knows I cant do anywhere near that being as ill as I am but I was left with absolutely no choice it was make a JSA claim while I wait for Mandatory review of the Decision that I am fit for work or absolutely NO money for the 2-6 weeks it takes the DM to do it. As until I can Appeal to Tribunal I cannot get ESA I can only get JSA or nothing. Yes I had to lie on my Agreement Yes the Adviser knows I had to lie to get JSA untill I acn lodge an Appeal with Tribunal and she is piling on the pressure to force a Sanction I just can't believe that the most vulnerable in society are being treated this way I suppose I will just have to take a sanction and hope I dont starve before I get my Decision and can appeal
  8. Sorry I am confused are you saying they can mandate me to a Work placement without any discussion on the matter? As I fail to see what a letter from my Doctor will do as I have been told it will just be ignored along with any sick note I will of course ask my doctor for a letter but I think she wont be inclined to do so unless I pay the practice 15 pounds for it.

I have a sick note from my Doctor that covers me till July but DWP told me as I have been assessed Fit to work by ATOS it is invalid and Doctor has no right to issue any more if I am unhappy with that decision I should get it reviewed which I am doing but untill that decision has been made and I can appeal to the Tribunal and be put back on ESA while it goes through I am classed as Fit to work and must comply with all they tell me I must do.
  10. Started a new thread as this is a fresh concern. A little background I was found Fit for Work by ATOS and have to wait for a Mandatory consideration before I can appeal. The only way I could get any money coming during this time was to sign on for JSA. Most Advisers will be understanding and sort of Park you till the decision is made and can get an Appeal going at Tribunal and be put back on Assessment Rate ESA. My Adviser however is not one of those and wont take my Medical condition into account when I saw her she put me straight onto a course starting next Monday and continuing till Wednesday 9AM start till 11.30 with the National Careers Service to build confidence I told her my condition could well prevent me turning up 3 Days in a row as my health cant take that much activity her reply was "You have been found fit for work so I can't see any reason why you cant attend if you don't I will sanction you and you will get No money for 4 weeks" Today I get an automated phone call stating My work placement has been set up and I must attend a Charity Shop Thursday for said work placement this is the first Ive heard about any sort of Work placement can my Adviser set this up and Mandate me to do this with out any discussion first? I have no idea why this is happening DWP know I will appeal the Fit for work assessment decision at Tribunal and ask to be put back on ESA while it goes through. There is no way I can get through 3 days of the course at 2-3 hours a day let alone start or do any type of Work placement and I don't know what to do or how to cope as Ive been told the DM could take up to 6 weeks to make a Mandatory review decision. I think they are trying to cull me if I am dead through starvation or my mental health gives out with all the worry and stress and I end it all atleast it will be one more person off benefits Any advice would be welcome.
  11. So after having No other choice I signed on JSA while waiting for Mandatory review. Had an Adviser interview today I tried to explain my situation to her and the fact I was on JSA ONLY till I can get my appeal lodged at Tribunal she said she was only concerned about Work related details So off to a good start there "Long story short" she has placed me on a course where I have to turn up to the JCP Monday Tuesday and Wednesday at 9AM till 11.30AM with the National carreas service to teach me confidence and other related Work advice. When I told her my disability could well prevent me from turning up 3 Days in a row as 1 day of activity could take 2-3 days for me to recover from She said well if you don't turn up you will be sanctioned, you have been passed Fit to Work so I can't see any reason why you can't attend and its a Mandatory Requirement. So it looks like I am going to get a sanction as my state of health just wont stand up to 3 consecutive days of strenuous activity and by that I mean just getting to JCP which is a 40 min journey by Bus and a considerable distance to walk between getting to the bus and from where the bus stops to JCP let alone having to sit in a classroom environment for 2-3 hours. I was wondering if I would qualify for Hardship Benefit when that happens as having No money at all would have a serious affect on my health and well being?
  12. Hey Margaret many thanks for the reply. Reading through the Link you provided it would seem that I not only should definitely qualify for Standard rate Mobility I should also qualify for Standard rate Care too as by the requirements on the Link i score 10 (possibly 12) on the Mobility and 12 (possibly 14) on the Care. I cannot tell you just how much this would go toward affecting my Quality of Life for the better. I will be sending a copy of 4 weeks worth of Dairy to the PiP people assuming I dont get given an Appointment before that time I will take it along to the Assessment if that happens. I would also like to take a minute to Thank the People of this site I wish I had found you months ago The advice is great the people are just lovely its so nice to be treated like a human being instead of "One of those ****** benefit Scroungers" My heartfelt thanks to you all I will keep you posted on my progress as it happens.
  13. Hey all So I am trying to keep a diary of my need for help does anyone know of a Guide to help me as in what to put down and what PiP will want to see? Also do I take this diary with me to the Assessment, will it even be looked at because when I went to Atos for my WCA the nurse only wanted Yes/No answers and every time I tried to give an explanation on the background to them she kept cutting me off saying we will get back to that or I will ask about that in a minute but never did. Then she wrote a complete fabrication of what happened and what she "Observed" at the Assessment for DWP.

Many thanks for the further comments I do appreciate them it is good to know there are somewhat different requirements for PiP but I won't hold my breath if someone as obviously disabled as me can be passed Fit to Work I cant see Atos who are responsible for the PiP assessment passing me for even the Lowest rate of Mobility. I will of course keep a diary of my day to day care requirements but the Mobility cant really be put into a diary because apart from Doctors, Food shopping done once every two weeks and now the JCP appointments for JSA while awaiting mandatory reconsideration I really never leave my house Living on top of a hill I can only go anywhere on Public transport (that itself has its own difficulties ie Can I get someone to come with me. is there room to sit and having to rely sometimes on the kindness of strangers/Bus driver for help) and simply cannot afford the little I do so any diary would possibly only contain me leaving my house 3-4 times in any 2 week period.

Hey guys thanks for your replys I went to JCP today to sign on for JSA while waiting for Mandatory Review from DM the Lady I saw was very understanding and we made a Job plan with the lightest requirements she could put on there she also made the comment that JCP was more like a GPs waiting room than a Benefits Office for the last few months and she would not be surprised to see someone on "Life Support" being wheeled in there to be signed on for JSA. Now I just have to wait for DM to refuse me ESA again so I can go to Appeal! Am exhausted and in significant pain and dreading next week as I will have to sign on Monday then Tuesday have to go in to see an adviser and possibly be given the mandate to go round and sign up with recruitment Agencys either that day or another day Dont know how I will cope with that as 1-2 hours activity usually leaves me in such pain that i need a day or two to recover from it. Also the Money situation is not good having stopped all my benefits and no likelihood of any money coming in till a week thursday I will not have the 7 pounds it will take to get me to the JCP for signing on and Adviser the next day going to see if my local CAB could either help there or recommend a charity to help as one missed appointment means Sanction and 4 weeks loss of benefit. Yes I have applied for PiP but I understand the requirements are the same as the WCA and if I was passed Fit for Work I will not even Qualify for Low Rate mobility as these assessments are also made by Atos. The PiP claim was made early December and can apparently like the WCA take up to 6-9 months to be dealt with. I will keep you posted as to how things go and what if any, Help I find.
