The bank have refused to send information under a DSAR as the person is deceased so do I now try to get the information under the Freedom of Information Act. Thank Tlk
  3. Thanks dx100 uk, I think assurant are trying to pull a fast one. Tlk
  4. Hi all, so after all this time assurant ( d and d home care) have agreed to pay back the the premiums for the years I wasn't covered but are refusing to pay 8% statutory interest on the grounds it wasn't missold. Am I right in thinking that if the policy was non cancellable and non refundable then it contains an Unfair contract term so therefore should included the 8%. Any views would be appreciated. Tlk
  5. Hi, I've received an email from the FOS stating that UKi have rejected the complaint on the grounds it is out of date and the FOS are looking into their jurisdiction and the fairness of Uki's claim. Does anyone know what the FOS jurisdiction is in this matter please. As I said previously the single premium mppi was taken out in 2002 and the FOS where looking at the administration of the policy . Thanks TLK
  6. Hi all, just an update on this ongoing saga re d and d home care ppi. After Assistant so kindly sent me the documents relating to this policy UK insurance ltd (NIG) have finally admitted they were the underwriters, after point blankly informing me that they had never underwritten such policies, hard to deny when it's in black and white. The FOS have now opened a case against them, not under mis selling but the way the policy was administered and the fact that the policy non cancelable and no pro rota refund offered. As I said think I said before the policy ran for 5 yrs and covered a mortgage, after it running for a year I then gave up full time employment after having my first child, so I had therefore paid upfront for a policy that was of no use what so ever. I also remortgage within that 5yrs so again useless. Will keep you all updated when I get a response, fingers crossed.

  9. Hi all, I tried reclaiming ppi I had with an old pre 2005 principles card. The ppi was sold to me over the phone, I never received any terms and conditions so was not really sure what it entailed. As it is I never needed the insurance as I was working full time and was entitled to 6 months full pay and 6 months half. Santander have now written to me asking for prove of sickness benefit as they have had to go back to the insurers and will not uphold the complaint unless I can provide this. Unfortunately I left the company 14 years ago and they have since ceased trading. Can anyone help me on what to do next if anything. Thanks Tlk
  10. No Ford, I had all the info I needed for the other complaint, statements and agreements etc. I'm usually quite anal about keeping paperwork hence still having bank statements dating so far back. Unfortunately this loan was taken online and if I was sent an agreement I can't find it anywhere. Lloyd's are going to be glad see the back of me after my last success with them which ended with them having to payback nearly £30,000 in interest and charges.
  11. Thanks everyone, will get on to it straight away. Tlk
  12. No I haven't sent an SAR yet, I didn't think I had ppi on this loan it was only after I phoned them regarding ppi on a 1997 loan that they gave me the account numbers of other loans I had with them that they say had ppi and this was one of them. Will get on to it straight away.
  13. No nothing, only old bank statements. Lloyd's haven't said a definite on the refund yet Im just living in hope. Just interested in what sort of figure I would be looking at if they do uphold. I know I'm probably jumping the gun but I'm well aware of the little games they like to play.
