  1. Hi Guys, I need help dealing with Brachers LLP regarding a Corporate Amex Debt. With regards to debt on a corporate card, long story short - I work as a travelling consultant during the week, I was based on a client for 6 months paying my expenses within the rules on my corporate amex card... after my 2nd month, my manager refused to sign off on my travel expenses, i took the matter with HR who said the manager was the budget owner for that project and it was her choice. In order to keep my job, i still showed up on client site and did my work as I was new to the company. Eventually £7.5k was racked up on my corporate card, Amex came chasing and essentially I was brought into a disciplinary meeting where I was told off on record that I would be sacked if I didnt take ownership of the debt...This in itself had a whole legal chase behind it, however would still have ended with me losing my job...and I like my job so I gave in to the corporate machine and their legal poweress. now that I have taken on this debt, I agreed to pay £200 a month to Brachers, I stuck with this for a few months, then I split from my ex and moved to london where my expenses increased to £860 p/m. I have now missed the last two payments on my debt to Amex, because I couldnt afford it after restarting in London. As of this week, I have said to Brachers that I can afford £100 p/m for the next two months and then I will increase my repayment to the £250 mark if not higher depending on circumstances. Reason for this, is that I am getting a significant salary increase in November, so will be affordable. However they wrote back and said that £100 was unacceptable and that they will now proceed with legal action to recover the debt owed along with all legal costs and expenses. Any advice on how I should appraoch this, is there anything I can do to protect myself from this crap? I will make it absolutely cleared I am more than willing to pay off this debt, however I do not want to put myself in a position that I am struggling to make ends meet by repaying more than I can afford. Any help and/or advice would be massively appreciated
  2. Had it been paid with my CC could have probably raised a dispute, but because it was paid by debit card, wont be able to challenge it.
  3. Thanks again BankFodder, once again your input is truly insightful! I completely agree with you on the Ombudsman front, and find that their system is flawed to some degree. Whilst i have had some great success with the Ombudsman services in the past (against BT...4 times and Vodafone most recently) I believe in this case its a bit confusing. I thought under the Consumer Act 2015 that refunds for digital orders (or orders made online) had to be returned to the customer within 14 days of the agreed cancellation? One of the reasons i started emailing was so that i could have a paper trail (or digital trail) which the ombudsman services have accepted from me in the past. Luckily i do have a record of the time and dates i called origin, however no recording. On my old android phone i had an app called ACR, which automatically recorded every single one of my calls, which was extremely useful, however i have not seen an app like it for the iPhone which i now have...any suggestions? To cover all bases, i was going to write a formal complaint/request for my refund today and send it 1st class recorded tomorrow and see what happens. I will follow up with any significant updates.
  4. This is brilliant! I recently won a case against Vodafone Fibre broadband with the Ombudsman services. Whilst overall the service was actually really good. My broadband went down for almost a month and no one was doing anything about it, it was clear the communication between Vodafone and BT Open started to get a bit hasty and i suffered being in the middle. Follwoing the resotration of my services, my fibre was intermittent and never hit the promised speeds of 76mbs again, was more like the 40mbs cap. I called, emailed and posted recorded delivery mail many times to sort the issue but it fell on deaf ears. As a result the Ombudsman service asked Vodafone to pay me £250 in compensation, clear my bill, and allow me to move to a new provider without penalty. Meanwhile they cant cease my services until i do. The added bonus was that my mobile phone with a year still left on the contract was part of that account and i was allowed to move that and keep the phone, so i got a flagship mobile for a bargain too. None the less, this whole process took ages to sort out, but im glad the the ombudsman has finally made it more of automatic thing, which should also in theory prevent issues like this happening as often!

Hi Guys, On February 22nd I placed an order with Origin Broadband and paid £27.99 up front as they had a really competitive deal....However that night i decided to read reviews (my bad for doing it in that order, usually i read reviews first!)...Anyway i discovered so many many bad reviews about the company that it made BT look as though it was the king of Customer Service. So naturally i decided to cancel the following morning when the lines opened. So i called up (February 23rd) and after waiting 43 minutes in the queue, i was able to cancel my order and would told my refund would be back in my account within 10-14 days....On March 14th nothing appeared in my account from Origin, I called again, but this time i just hung up after 26 minutes in the queue as i had things to do. I emailed in and no reply to this day. Since then i have looked around, Facebook, Forums and Review sites and there are a lot of people saying they have been waiting 2+ months for their refund. I did try to submit a complaint to Ombudsman, but they wont touch it because it hasnt been ongoing for 8 weeks. To me it is clear that Origin are not going to issue the refund, based on what i have seen from other people. I thought about small claims, but after fees it would cost slight more just to take them to Small Claims, what can i actually do here? Whilst it is only £27.99, im not the type of person that can let a company get away with something like this....it urks me! Any advice would be greatly appreciated
  6. HI Brassnecked, I sure did send them an I&E, even showed them what assets i owned (which is practically none). However they continue to be as stubborn as a soggy cardboard box and refuse to budge with this loan repayment. I do have a solicitors appointment today to give me some advice on the situation. Because the loan is unregulated it is a Civil matter. What is annoying though i do not have money to fight it, i have to wait and see what their solicitors do before i can ask for legal aid.

  8. Hi All, Need some help, sorry if this is not in the right section. In September 2015, i started on the Graduate scheme with EY (Ernst & Young) as an IT Risk Consultant. As part of your starting package you are offered a £7,000 interest free personal loan, which is provided for by EY. This loan as far as i can tell is unregulated, i.e not covered by the consumer credit act. I took the loan which i used to consolidate every last penny of debt i had as it was interest free and i thought it was a clever. However as a new graduate i found out i had to sit and pass my Chartered Accountancy exams to keep my job, even though i was in IT based role, but thats a different argument of mine. Well 2 months later and i failed my exams and as a result i lost my job. My entire last months salary was deducted from my loan and i was left with a balance of £4113. At this point i was left unemployed with no income and unable to claim benefits as my partner earns too much, however to make it clear too much means we are scraping by every month with no disposable income. EY have since sent me countless emails asking for repayment in full. I have responded explaining my circumstances countless times and even gave them a repayment plan which i did plan on honouring. "As a gesture of goodwill" they offered me the chance to repay the loan over a 6 month period which equates to £685 per month, which even if i were still on a good salary would be unreasonable and would leave me without basic living money. EY have now said that as i have refused to pay them what i owe, they have now passed it onto their solicitors of which i will be liable for all legal cost. Can anyone offer me any advice on how to deal with this mob? Because the loan is unregulated it appears that they can do whatever they want and use their financial strength over me to bully me with lawyers as i obviously cannot afford one myself. So i am all ears for any advice. J

Hi Dx, As previously mentioned in my earlier post, i tired to go with a free DMP, however i went with Stepchange who made my situation worst, subsequently i received an apology from them a few months later. So in the end i went with a fee paying DMP as they were able to quickly get this on the way for me, which i found out was not the best option. As far as the list go every one those mentioned are on my credit file. However BT is not and Sigma Red is not.   11. Hi DX, Thanks for your response to my thread. However i was wondering if you could give me a bit more info and detailed help i have read the forum up and down on different individuals and how they dealt with settling their debts however finding it difficult to relate to my debts and settling them. i am getting a loan from a family member to consolidate every penny of debt i have. I will detail everything below as best as i can for you to look at. However the majority of my debts are registered on the DAS register in Scotland in association with my DMP with Wilson Andrews who i refuse to pay or let deal with my debts any more as they take me for a ride. Will DAS have any effect on me dealing with my debts outside of the DMP by Wilson Andrews? My current debts which are up to date and paid normally are as follows: Capital One: £197 (Up to date, use and pay monthly) Amigo Loans: £4647 (Up to date always paid on time) JD Williams: £100 (Up to date always paid on time) ******Unpaid Debts********* Provident: £800 Vanquis: £570 Very.co.uk: £2010 Vodafone: £128 (Sigma Red claim to own this, although Vodafone is the owner on my credit files) Aqua: £343 (Lowell Portfolio) Peachy.co.uk: £458 Smart-Pig: £700 (Original debt was £300) My jar: £388 247 Moneybox: £340 O2: £197 (Lowell Portfolio) BT: £350 (Sigma Red claim this again) 1. As the majority of these debts are still with the original creditors can i still negotiate with them? 2. What does requesting a CCA do or achieve? 3. As a few of these debts are now marked on my credit file as defaulted, is there any realistic point of paying them? I know you should always pay your debts but if you are marked as being defaulted that default will stay even if i pay my debt. 4. Most importantly what would you do in my case? Thanks

Hi Guys, A year and a half ago i entered a DMP with Wilson Andrew for my debts of £7,000, however after paying 2 months worth of payments to them i came to realise they were really taking me for ride, pocketing £150 out of the £300 p/m i was going to be paying them, which i though was a joke, so i stopped paying them, a year and a half later i am still benefiting from being in a DMP, without actually paying a penny. However i am now in the position where i can pay my creditors off, and would rather do this directly with them rather than with Wilson Andrews, as i dont feel like being robbed anymore. Some of my debts are still with the orginal creditors whilst some of my debts have been passed to Lowell Portfolio and Sigma Red. What i wanted to find out was does anyone have any good hints and tips to share when negotiating full and final payments? What sort of discount % should i negotiate with? TF
  13. Well just to put this thread to bed with the final case of story. After first posting to thread, my case hit the media on in the Daily Mail and BBC Radio 4 Money Box show. I took my case to the FOS who in the end successfully got my refund, originally it was £112, however asking for a breakdown from Experian, they 'got the figures wrong' and instead sent me a crisp Barclays cheque for the amount of £150.00 (£8 more than i was due after interest ) However to my disappointment, the FOS refused to adjudicate the case, in other words make a rulling declaring whether i was right or wrong and whether Experian were actually mis-selling insurance (which they ARE!). the FOS will deal with any similar cases on a case by case basis. after my success and my new found wealth of £150 i urge others to make their claims if you have ever had a Credit Expert membership, its £6.40 per month + 8% interest, so its worth it if you have had it for a few months.
  14. Hi Guys, A while ago i posted a thread asking about reclaiming my insurance premiums from Experian which can be found here. Well a few months later and the FOS has agreed that i was to be reimbursed my premiums (which form part of the £14.99 you pay to Credit Expert every month) + 8% interest. You can see more of the story here. Everyone who has had the Credit Expert package is entitled to ask for a refund, so i would suggest you get claiming as it works out about £6.47 + 8% for every month you have been a member of the Credit Expert services. If you would like any advice on getting started, please feel free to ask and i will be more than happy to help you based on my experience. TF
  15. Thats funny how you are on the cheaper package but yet still have the insurance element still included... I was £14.99 as standard and when i called to cancel it was £9.99 without the insurance...But when you look deep into their site, insurance is £6.40, which still does not add up! Honestly dont get Experian they seem to be running a funny business.
