£55K in debt, need advice?

Can this be done now, before a DMP? And also, due to the fact neither of these have gone into default, will that make any difference? Thanks again for your help -

Thanks for this information, I will look into every card and get dates, but at present I do know that 2 cards in my wife's name were taken out in 2002 and 2004 respectively. At the time she was not working, and she has had some credit increases over the years. One of these cards was sold to her while shopping in Tesco The cards from 2002 and 2004 are still active, but would it still be possible to CCA these? -

Hello all, This is probably going to be quite a long post, so I hope some of you will bear with me to the end, as I could really do with some advice as to what I need to do regarding a large amount of debt, Firstly, I should point out that everything I tell you in this post refers to both myself and my wife. We have outstanding debt worth approximately £55,000. It has slowly built up over the past few years and unfortunately neither of us has tried to take control of the debt, but now, we know we have to as the debt is becoming less manageable. All of the debt is in unsecured credit cards, and some catalogue, store cards . There are no loans,and we have never defaulted on any payments. I was diagnosed with Cancer a couple of years ago and unfortunately I have been unable to work since, due to treatments, hospital appointments, tiredness and feeling generally unwell. My wife also doesn't work as she is my main carer. We receive benefits, this includes PIP, ESA, Carers Allowance, and Child Benefit, and up until now we have just about managed to pay the debts each month but it is now getting to the point that it is becoming a struggle. Bills are always paid on time, Gas/Electric, Water, TV License, Sky (minimum package) and BT for phone and internet. We own our house outright so there is no mortgage or rent to worry about and we are exempt from council tax. So my question to the forum, is should we now consider a DMP, as we know that in a few months, our outgoings will surpass our incomings, and we would be in the situation of not being able to pay all of the debts each month. The other option we are looking at is to sell our house, however, we would need to be able to buy somewhere at a reasonable price, so that we could use some of the sale money towards paying off the debt. If we start a DMP now, and say in 6 months we have £25000 left over from the sale of our house, can we stop the DMP and try to arrange full and final settlements with each of our creditors? Would the credit card companies be willing to accept a reduced final settlement figure or because we have always paid on time, they do not see us as a bad debt? Any advice will be greatly appreciated, and for the DMP we are thinking of using Stepchange.

Hi all, I am looking a little bit of advice once again, so I hope someone can point me in the right direction. I have been on Long Term Sick Leave for nearly 2 and half years now. I have recently found out that the comapny I work for, has lost the contract that I would have been working on, and the work is transferring to another part of the UK. My employer wants to offer me another position, albeit temporary for now, until a permanent position becomes available. The thing is, I will not be able to ever take up this post due to my ongoing illness and treatments, and I only recently sent in another sick line to work for another 6 months. Obviously if i do not take the position offered I understand that my contract will transfer to the new company. With my continuing illness, it is highly unlikely that I will be returning to work at any time in the near future. So my question is this, should I allow my contract to transfer and then accept redundancy if it is offered. Many thanks in advance.

Well, Success.... I contacted them today and told them that this possible charge was never made known to me and that there was nothing in my contract regarding this type of reduction in wages. I also quoted part of the Employment Rights (1996) and they came back to say that they agreed and thanked me for pointing out their error. So, no £140 owed now at all. Thanks for the replies everyone

Hi, I have a couple of questions that I hope you can resolve for me. I have been off work for just over 2 years due to ongoing cancer treatment. I have just applied for my Holiday Pay for those 2 years and been told I will be getting it in 2 installments (March and April). Absolutely delighted about that, and got the advice from this website. Now, I was supposed to attend an Occupational Health Appointment on January 20th 2014. I was due to go until there was a death in my extended family, and I had to attend the funeral that day instead. I did notify my work, but did not give 24 hours notice. I have now been informed that I will have to pay £140 cancellation fee, which they are going to take out of my Holiday Pay entitlement. Should I have to pay this charge, or is there away to refuse. Basically I am trying to find out my rights regarding this issue. I should point out that I have not seen a receipt or a copy of the charge, just been informed they are taking it out, Should I ask for proof before agreeing to the payment, if I have to pay it. All replies appreciated. Many Thanks

Hi Emmzzi, Just an update regarding the work capability meeting. They have rearranged it for Tuesday 3rd December. However, they have intimated that this time, they will not accept any excuses for not attending and will conduct the hearing whether I attend or not. They did promise that they would send me to the Occupational Health,which I am more than happy to attend, but as yet this has not happened. As I said previously, I have issues regarding my new body image, and do not like attending crowded places, etc. I am however, happy to attend, if it brings closure to this matter. I imagine as I am not ready (nor will I be for a while) to return to work, they will terminate my contract. What questions do I need to ask, regarding holiday pay accrual etc.. and also what rights will I have if they terminate the contract. Will it be on the grounds of medical capability, or something else. And if it is on medical grounds, does that mean that I will never be able to work again. Once again, thank you for all your advice to date, but any further advice will be greatly appreciated.
