  1. Hi, not sure if this is similar to the above post. I have received an email from Advanced Collection Systems Ltd offering a 30% reduction if I repay my debt to them. The debt was from 2012 through Toothfairy finance. Should I ignore these as the debt isn't on my credit file so I'm not particularly bothered, but the debt isn't statute barred.
  2. Even though the contract says the order is non cancellable? Would you advise I just ring back up and say cancel the insurance as it's unwanted? What entitles me to do this?
  3. Hi all, I was looking for some advice. I placed an order with ScS for a sofa on 31/12/16. We were unable to get finance for the sofa but the sales guy happily told us we could haVe sort of reverse finance and pay monthly before we got the sofa - happy days we thought. We have so far paid 1500 of a 2000 bill with the rest due in April 2 weeks before delivery. However, we added on an insurance that was 250 that we do not want anymore. We would like to a) just take off the insurance or b) just cancel the whole order and start again somewhere else as we have changed our minds. However, after speaking with the salesman today over the phone he said we couldn't cancel the contract. He did however offer to discount £100 off the insurance. The fact that he is able to do this tells me that he is able to do more and perhaps even cancel the contract. Has anyone had any experience with ScS and getting n order cancelled?
  4. Isn't there a very low chance the ombudsman will disagree with the adjudicators?
  5. Advice would be appreciated - I don't really agree with the FOS.. Surely 10 consecutive loans screams irresponsible lending?! This is the FOS response: your complaint You feel Payday Express was irresponsible by lending to you. And that the loans you took out were unaffordable. You’ve said you rolled your loan over several times as well, which helped to put you in a spiral of debt. my findings You first took out a loan with Payday Express on 25 October 2011 for £200. You entered into a running account credit agreement. This agreement works by allowing you a credit limit (of £300 in this case) and you’re able to borrow up to this amount over time. From October 2011 to May 2012, you borrowed ten times from Payday Express for amounts of £90 to £290. You stayed within the £300 credit limit of your agreement throughout your borrowing with Payday Express. On 1 June 2012, you borrowed £290. Interest was applied to this amount when it was borrowed. On 11 June 2012, you emailed Payday Express to say that you were in financial difficulties and were unable to make your loan payment. You also mentioned that you had debts with other payday lenders and would like to arrange a repayment plan. On 14 July 2012, further interest was applied to the loan along with a default charge due to non-payment. From August 2012 payments of £20.21 were received towards your balance on a monthly basis until 31 July 2013 and you had informed them of your involvement with a debt management company. After your last payment to Payday Express in July 2013, a balance of £227.69 was left on your account. Payday Express has shown the credit score check it performed back in October 2011. At the time you took out your loans, the lending guidance at the time was by the Office of Fair Trading (OFT). OFT lending guidelines were less strict on the affordability checks that needed to be performed compared with today’s guidelines. The credit score check that Payday Express performed was acceptable at the time to meet the affordability check requirements under the lending guidance at the time. I’ve also looked into how Payday Express managed your account. I can’t see that you went over your credit limit when borrowing from Payday Express and the borrowed amounts were paid off on time. So I don’t think Payday Express ought to reasonably been aware you were in financial difficulties from how your account was managed until you told it in June 2012. Payday Express’ offer Payday Express has offered to refund £87.50 of the additional interest and charges from your remaining balance. This will bring your payable balance to £140.19. my conclusions After you told Payday Express of your financial difficulties, it applied one more month’s interest and a default charge. However, this wasn’t paid as your following repayments didn’t cover the initial £290 borrowed in June 2012. When a financial business learns of its customer’s financial difficulties, it should act positively and sympathetically. But by positively and sympathetically, it doesn’t mean it’s obliged to refund interest and charges, just that it should work with you to get the debt paid off. I can see Payday Express accepted a repayment plan from August 2012. I think Payday Express’ offer is fair and reasonable in the circumstances. For my reasons above, I’m not in a position to ask Payday Express to refund any further interest and charges. I’m sorry this isn’t the outcome you may have been hoping for, but I hope you can understand my reasons why I’ve come to this conclusion. what happens next You now need to let me know if you agree with what I’ve suggested. If you do, then please sign and date the enclosed form and send it back to me by 18 May 2016. I’ll let Payday Express know so it can arrange to process what’s been agreed. But if you don’t agree with what I’ve said – and you have any new information you’d like me to look at – then please let me know as soon as possible. If we don’t hear from you by 18 May 2016, we might not be able to look at your complaint further. So if you want to reply but you think you’ll need longer, please tell me as soon as possible. In every case, both the business and its customer can ask an ombudsman to make a final decision. But I think it’s unlikely the outcome would be different – unless there’s any important information that you haven’t already given us.
  6. Hi, I received generic email after generic email from Quickquid. I filled in absolutely no other questions they gave me and sent absolutely nothing else off to them. I just kept asking if their latest email was their final response. They finally replied saying that they have 8 weeks etc and will be in touch. That deadline passed yesterday so referred to FOS now, fingers crossed! Send them nothing else - though may be handy to keep hold of your credit report to sent to FOS to help your case if it goes that far! As for your other complaints, I received a decent offer from Wonga after about 10-11 weeks of waiting for their final response, without going to FOS. Payday UK is currently with the FOS. Good luck!
  7. My update. Wonga - refund of interest, fees plus 8% statutory interest - £619 (took 10 weeks to get a response but I got there and no FOS involved) Quick quid - final response due tomorrow Payday express - offered a measly £87.50 when FOS got in touch before they investigated, I refused and told FOS to go ahead and investigate Payday UK - FOS investigating Moneybox 24/7 - received an offer the day after I submitted to FOS - offered to write loan off and remove entries in credit file - that'll do for me! Pounds to pocket and wageday advance- still waiting for responses. I only started claiming irresponsible lending mid January so don't think I'm doing too badly! Hopefully we can get these companies closed down together!
  8. Hi, I suppose it really depends on how much the loan(s) were for and how much interest you have paid as it can be quite a lengthy process to complain, wait 8 weeks for a final response which you may or may not get, then complain to FOS, so quite a long process but if there's a lot of j threat and fees been paid then worth it!
  9. I received this exact response and all I replied with was just saying you don't require any of the information you asked for to investigate my complaint and is this your final response. I then received another reply saying without the information they asked for they can't investigate properly but would do their best. I also included the date I sent the original complaint to them and stated exactly when they have until to respond for the avoidance of doubt. Hope this helps!
  10. Just out of interest fkofilee (as you seem to know your stuff) what would the situation be if a) gambling was involved and b) if you did use incorrect info to get the loans?
  11. If I take something to the FOS before their 8 weeks is up, what will happen?
  12. Hi Neil thanks for your help, sorry I've already asked I should take their standard cut and paste response as a final response to which they replied with this, almost a week later. What shall I say to them?
  13. Hi, I have recently come across these payday loan refund and thought I'd give it a go, however, quick quids response has me a little confused about with what to reply with. Thank you for contacting QuickQuid. The contents of your email were duly noted. We apologise if there was any delay in responding to your complaint. Your query raised several questions on loan affordability. In order to better assist you, we ask that you fill out the below information so that we can thoroughly review and respond to your complaint. Questionnaire 1) What is the funding date of the loan(s) for which you are complaining? 2) Recently, we have seen an increased number of complaints where the complainant has obtained a template from a website or blog. Did you use a website template? If so, can you please provide the name of the website? 3) Did you tell us that you were experiencing financial hardship? If so, when did you tell us of your financial difficulty? 4) Please provide a copy of a bank statement from the time of your loan(s). 5) Please provide a copy of a payslip from roughly the time of your loan(s). Once we receive the information back from you, our complaint team will diligently review and assess your complaint. As you will see from our complaint procedure, we have eight weeks from the date we receive your complaint to send you our ‘Final Response’. If at that time you are still unhappy with our decision, you will have six months from the date of our 'Final Response' to refer your complaint back to the Financial Ombudsman Service for them to adjudicate in the matter on your behalf. Any help would be greatly appreciated! Thanks guys
  14. You will get your Halifax account number and sort code in a letter after a few days. The card will then follow a few days later. I know this as I have just set one up and have received details and debit card, just awaiting pin number. It has only taken 5 days
  15. Sidhu_82 I am in the same situation as you regarding all the payday loans. I have debts totalling around £3000. After burying my head in the sand, I decided to face them and tackle them to finally get myself free from these! First of all, you need to cancel your bank card and request new details and say that your pin number is no longer secure. They will send out a new card to you. However, it would be sensible to open a new bank account just in case and have your wages paid into that.bIf you have trouble opening a bank account, try Halifax easycash account. So not the payday loan companies cannot access your cash and now you have the power and control over the situation. If you have complete control over your wages, you will start to think much more clearly. Secondly, you MUST contact CCCS! It is the single best thing I have done. They will ask for you to complete a budget sheet and list your payday loans etc and then will then work out how much available expenditure you have to pay off your creditors. I have been with CCCS for over 2 months and paying £135 per month to them and they work out how to distribute this evenly between your creditors. Their service is completely free and confidential. The majority of payday loan companies will freeze interest and charges whilst on the plan as it shows you are actively tackling the debts and intend on paying them. Any more questions and I'll be happy to help Good luck
