  2. Yes the mortgage is completely up to date. There is no reference to the mortgage it says loan. No account numbers no arrears as there are non, and no explanation as to why they want full payment. I also thought it looked generic... I intend to write this weekend and get some clarity. Thanks

  4. I wonder if anyone can please help or advise about this situation. I have a home that I currently rent out and the mortgage is paid up to date etc. I had some financial difficulties when everything crashed in the late 2000's. I missed one or two mortgage payments due to being out of work a long time ago, probably 5-6 years. The arrears were paid up almost immediately and have been on time ever since. I have lived with my girlfriend for 4 yrs and have let the house for that period. Today I received a letter from HSBC for the full balance for the property, a FINAL DEMAND. I dont know why they would send such a letter as, like I said I am all up to date. I am wondering if because I should have let them know I was letting the house I am now in default, and should have been converted to a buy to let mortgage. If anyone could shed any light on this I would appreciate it. Thanks
  5. Hi Thanks for your reply. no I havent paid anything on the debt as yet. Prior to the CCJ I did make them an offer to settle for £1850, but it was rejected. The CO hearing is on the 14th May, should I try and get a CCA again and will I have time.? Thanks
  6. It may be a little late but I have only just found this site and hopefully someone can assist me with the best course of action / defence to a final charging order on my home. Firstly I now live in the USA, I married a US citizen in February and have no immediate plans to return to the UK. I do still have a home there that is let to a tenant. Basically a CCJ was obtained in January 2012 for £3745 to HSBC for a visa card I been unable to pay due to unemployment. The card was obtained in 1999, and was paid punctually until the recession and failure of my business. I recieved an enforcement letter stating that they had applied for a provisional charging order against my UK home. At that point I looked on line and found this site at the beginning of April. I then thought I could defend the claim and request a CCA from DG solicitors which I did on the 1st April. I faxed the request but due to being in the states did not send the £1 fee. Time has now passed and I should have recieved the CCA from them. Would not paying the fee be good grounds for them not to send it? Basically have I left it too late to defend the claim, ( out of my own ignorance) or do I have a chance or getting the claim and the final charging order on my home dropped. Any constructive advice would be gratefully recieved and any assistance with drafting letters alos. Many thanks.
