What was sold to us was not what we asked for, however we were under the impression it was. Are you intimating that the policy hasn't been mis-sold?? Even though we asked for income protection and ended up with MPPI?? -

Hi all I've started a complaint with Santander about my mis-sold MPPI. We were FTB's in April 2009 and being the cautious person I am asked the IFA doing our mortgage about Income Protection. Low and behold we ended up with MPPI the only covered the mortgage payment and the house insurance not a penny more up to the value of £750, not what we asked for. However I did not pick on this at the time and it only came to light recently while sorting though some old paperwork and came across the policy document. This is where I finally read the small print properly. I've sent back the MPPI questionnaire to Santander only to be told my claim is with the IFA not them as they didn't sell the original policy. ( They took all the payments for 2 years though ). The IFA is no longer trading which they informed me in the letter and have suggested that I may have a claim through the Compensation Scheme. I think I'm being fobbed off. Any help as to how to proceed would be great. I have the original policy letter from them and all bank statements showing payments etc. Regards Ed

Hi All I need a bit a advice with a tenancy question. A friend of mine is living in rented accommodation, she has only lived there for 6 months and wishes to leave. She has found somewhere else to live and has given notice to her letting agent of her intentions. This is where the question is. She has been told she is now on a rolling tenancy as she's out of her fixed term, her rent date is the 7th of the month. She has given her notice to leave on the 10th of the month, with her intended moving out date being the 10th October 2013. The letting agent have informed her that she is liable for the rent on the flat until the 7th November because she didn't give notice correctly. What they are saying is that effectively her notice period can only start from the next full rent period I.e 8th October to the 8th November. Their reason is she is liable for the rent to end of the notice period and that because she has given notice at the wrong time it would mean the landlord was out of pocket for remainder of the time the flat spends empty. I personally think that is crazy. The agent has also said that if they find a tenant to move in between the 10th October and 8th November she'll receive a pro-rata refund of the rent. I have queried with the agent that if it's works for a pro rata refund that it can surely work for a pro rata rent payment, I.e pay for the 3 days into the new rental period. How can it be my friends responsibility to cover the rent for the remaining days in October to early November to prevent the landlord being out of pocket. After the 7th November the landlord may still be out of pocket if there isn't a new tenant moved in, will she be asked to cover the rent then? (Sorry for sounding flippant). Thanks in advance Ed

last payment was april 2005 and no written acknowledgement to date, the letter you drafted for me brig rebutted thier claims of acknowledgment. Althouh they have written to me acknowedging my letter and passing it to citi and also confirming the account is on hold do I still send the failed to comply letter after the 17th septemeber (that will be 12 + 2 working days)? Received a standard reply from 1st crud saying they've passed the cca request to citi to be fulfilled. They say the account is on hold until such time as they send the documents to me. I'm a little confused now. I received a notice of assignment from 1st crud sometime ago, yet they are going back to citi for the documents. Going through some of the other paperwork received from them they say they purchased they debt in 2006?? I just seems like bull all the way through. With a CCA request, what would be they next likely steps on the basis of :- 1. No agreement 2. Recon agreement Or 3. The original agreement

thanks Brig They cant prove the 2009 payment. my last letter to them was asking for proof of the payment, they sent a reply saying they had passed my letter to the appropriate department and 1 month later i recevied the letter enclosing my 2010 prose. include a request for proof of this 2009 payment atleast it will give them something else to occupy thier tiny minds. should i head the cca and sar requests with do not acknowledge statement??

Thanks everyone for the help. Brig, I would like that letter please yes, anything to try and make them go away. Bandit, uncle and dx, I will do as you recommend, cca sar etc. I trust the templates are on here in the library. Bandit, all lett I sent to them since the 2010 letter have been headed that way, shame I didn't look on here first before I shot from the hip. Back then I was under the impression I was dealing with intelligent and reasonable people that would like to try and help me. Instead what I found was that these people are vile pond life so low down the food chain it's amazing they can even go outside in sun light. Thanks again everyone.
