  1. Hi I am living with my partner in a house that she co-owns with her ex. At present I am paying half the mortgage and the council tax. The ex would like to sell to me and I would like to buy. By my estimation the house is worth £200k. And there is around £100k to pay. He would like half of his deposit (£20k) and half the equity Around £25k. This is all sounds reasonable to me. How do I go about things? I am still officially married to my ex. Do i need to be divorced to move forward? Could she possibly make a claim on the house? If she did...would she need to involve a solicitor?.....She wouldn't have the funds to do this My credit history is less than perfect so is a concern? Will I need to add my own deposit? I can put down around £15k I presume this will be a new mortgage? Do I go to my bank or a mortgage broker? The mortgage is under one bank and I bank with another....is this still ok? Ie will I need to change banks? It's been all very amicable, I pay him monthly...that's as far as our relationship go's. He has given us til September 2019 to have a plan. Either sell or buy from him. Ideally we would like to stay put. I have little or no knowledge of mortgages and how they work so any help is greatly appreciated
  2. thank you all, I will now get a "prove it" letter out to arrow and see where it goes from there. My feeling is that it is statute barred and they are chancing their arm
  3. so in summary I ignore this letter? Continue to pay stepchange for my dmp which includes 2 creditors?
  4. Brilliant thank you Dx, checked my credit file and it is not on there. Do overdrafts normally show? I only have one creditor listed on there and I am paying two. Does this mean anything? Thanks again
  5. do you think its an idea to check my credit file? Not done so for years as it was costing me £5- £10 a month. I have not cca'd my other 2 creditors and have been paying them religiously for years. Please can you explain what is to gain from asking for this?I am not disputing any debt with these.
  6. Hi dx The original creditor is Hsbc I couldn't tell you the last time I personally made a payment to them. I have been on a dmp with stepchange since around 2005, my statement says that I owe hsbc nothing with the same account number. I would guess that the last payment to them would have been pre 2005 but cannot be absolutely certain. I would say the debt is from around 2003 and this would have been the last payment by me. The 1st I heard of this was around october, this is when I sent a cca request. Something doesn't seem right to me as they are stating that this is for an overdraft. ...I would never have had an overdraft for over £6k. Sorry if my memory is a bit hazy.   7. Hi Everyone I am currently in a dispute with arrow global regarding a debt, I have recently sent a cca request and received a response. In regards to the letter I have never had a overdraft for this amount £1500 at the absolute max. Could this be charges? surely not? Please can you read the letter and advise of what to do next. Dear Mr xxxxxxxx DEBT OWED TO Arrow Global Limited ASSIGNED BY Phoenix Recoveries Uk We thank you for your recent letter and acknowlege your request for documentation pursuant to the consumer credit act 1974. We do not accept that we are the crditor as envisaged by the above statute. This account arose under an overdraft facility. Even if this account was regulated under the consumer credit act 1974, part V of the act does not apply to this facility and there will accordingly be no executed agreement. In additon we confirm The total sum paid is £613.87 The total sum outstanding is £6421.54 and the amounts which will become payable comprise interest and costs,depending on what enforcement action is taken against you. The account is being managed by NCO Europe,please contact them to make arrangements to pay your account. Any advice would be greatly appreciated. Thank you
  8. hi everyone Thank you for your very useful comments/links .I have decided to continue as I am for the time being, I get very few letters from creditors these days and this is all thanks to cccs .I quote their number and that's the last I hear of it. It was great to get some feedback from other people and help me see things a little clearer. Perhaps I underestimate what cccs do ,it's great to come home from work and not have a stack of threatining letters, which was the norm a few years ago. When I think about it properly......I keep thinking 6 years and then I am debt free. Totally debt free before 40. I made a lot of mistakes when I was younger as credit was so easily available. I had some great times but boy have I paid for it, 12-15 years paying it back. I have learned an extremely hard lesson. A lesson I can pass on to my wonderful sons when they are old enough to understand. I will feel a huge sense of achievement when it is finally all paid back and will have come out of this a wiser and better man. Thanks again people
  9. Hi all I have been viewing this website for a while with regards to my own debt problems .If anybody has had a similar experiance to me your comments would be greatly appreciated. I am on a dmp with the cccs and have been for 6 years, I am now getting to the stage where I feel more confident about possibly going it alone. By and large cccs have been great, I started off witha around 26k worth of debt and am now sitting at around 18k. When I 1st started they were extremely helpful and my monthly payment was a very manageable £86 a month. As time has progressed and I have done well for myself at work I am now paying £287 a month. I still have around 6 years or so worth of payments to make at the current rate but I am sure this will go up at my yearly review. I am thinking of stopping payments of my dmp but I am concerned about all the aggro this could cause with creditors. How long would it take for creditors to contact me? Would all creditors contact me? My thinking is, is that if I stopped paying I could possibly save enough money for full and final payments. This has been troubling me for months,at present things are sweet and I am getting no letters/phone calls etc. But on the other hand it feels like my £287 is just disappearing to a black hole. I get a statement from cccs each month but nothing more. A while ago I received a phone call from a creditor saying they would accept £2k as f&f payment, cccs never followed this up. It just seems that cccs wanted to drain every penny away from us even to the point of child allowance, which is the only money my wife gets, which takes care of bits for the kids. I made this clear to cccs but they still included it. They kicked off when I said I was paying £12.50 in to a pension. Like I said they are not all bad and will be eternally grateful to them for getting me back on my feet. I am in two minds of what to do for the best, carrying on paying cccs for 6/7 years or try and go it alone I look forward to your responses
