  1. I've been in contact with FOS and he has been telling them since early November to change it. I have rung them also. The woman told me do what you want we have already been fined so go ahead back to FOS. The guy at the FOS wasn't impressed. I just want it sorting I'm looking to move and they just put my account from query to arrears. Had I have know they would of taken so long I wouldn't of accepted their token gesture of £50 and I have expressed this to the FOS who said I should accept! I think the 14 days letter by recorded delivery and a conversation with the ICO may be the way to go. Thanks for everyones input. I will also contact Experian with my letters from both shop direct and FOS stating what should happen. I guess if I take it from every direction one might work! Thanks again.
  2. i have an update on this. I went to the financial ombudsman and they agreed shop direct should of applied a default 5 1/2 years ago. This was in October. The issue I have know is getting shop direct to update my file. FO are in contact but just wondered if anyone has any advice. I have the actions in writing from both FO and shop direct. thanks in advance
  3. Hi Firstly thanks for reading and all replies are gratefully received. I have been on two special arrangements with my catalogue Very and littlewoods for 5 years. Today they tell me that I pay everything off in full or they will issue a statuary default notice. The special arrangement has already had an impact on my credit file so surely they then can’t do it again for another 6 years. I asked them 5 years ago to do the default notice! They have also told me today that I shouldn’t of had the arrangement for that long anyway. Is there anything I can do to avoid the default being placed today. I want to downsize my house but if they give me two defaults it will a further 6 years when realistically it should only be 1. Thanks
  4. What's the worse case that could happen here. I have my bank statements etc and cannot possibly of been in the store at any other time that day. If I prepare for worst case then it can only get better although I will fight every step to prove my innocence too. Thanks for all the advice so far though.
  5. They have already told Tesco that. Tesco have appealed it hence why I have to be interviewed. The police officer said he was happy with my bank statement being proof of purchase and said it was case closed. He then rang me 6 weeks later to say Tesco had appealed but not to worry he could still use my bank statement but I had to be interviewed. I'm petrified. I will try get the bank to get the details for me though.

I have taken a screenshot and have a bank statement too which shows there store number and date of transaction etc I also have a work receipt showing me miles away at other points of the day. The police officer said I was to spin the interview around. Its not to prove my guilt its to prove my innocence. He has told me not to worry but I'm distraught.
  7. Hi I'm after some advice. The Police rang me a few weeks ago Tesco had reported me shoplifting and putting the items in my car. They contacted me from my reg plate on car. I am clearly shocked they say they have cctv which shows me walking out without paying. I did go to the toilets which are at the back of the shop after I had paid and then left the store. As it was over 4 weeks prior to the date when the police contacted me I didnt have my receipt but I sent a screenshot of my bank statement which shows the store and amount. The police said this was OK and no further action Tesco then appealed it as they couldnt find the transaction. (I paid part cash part card). I know have to go to make a statement and am very worried. I have read up that Tesco its not that tesco cant find the transactions its that they wont as they then show the security teams up. Ive never been in trouble before and am worried that I will be blamed for something I didnt do. I have receipts from the rest of the day to say where I was as I work all over the country. T he police have been really good and said he will get it sorted and put it behind me. I havent eaten or slept since. Any advice is greatly received.
  8. Hi I am after some advice please. I currently have a mortgage with santander they won't give me any special deal as I have debts. I have never missed a mortgage payment though. I currently have 2 accounts with santander and they have changed the overdraft charges which means I am being pushed further into debt. Would santanader be able to put me on a payment plan and freeze the interest on these bank accounts or be able to add to my mortgage. I have already opened another bank account to put wages etc in with another bank. Any advice is appreciated. Thanks for looking greenk04

  10. Hi Nationwide have issued a ccj for a loan which is being paid on a monthly basis. I had to have it redetermined due to northampton bulk centre setting as a ridiculously high amount. The judge was fantastic and set it to the amount I requested. He also denied the request to change it to forthwith as he said that Nationwide shouldn't keep demanding more from me and applying more charges which just increase the debts. They have a ccj which has been paid and he saw no reason for them to be then able to put more charges on to seek a charging order. He also refused costs! Today I receive a letter from Nationwide saying that the law changed in Oct 2012 so they can apply for the charging order anyway this to me makes a mockery of it all. Just wondered if they will stand a chance of having this rejected to if or if they are being successful in getting the order. Thanks in advance.
  11. hi yet another update spoke to someone in the complaints department as they still haven't sorted my SAR out. They reopened my case sent me £70 for my inconvenience! Today I have received a letter saying the the documentation I have requested has been removed from their system. It guess it must be the CCA they are talking about as they previously told they didn't have it. Where do I stand with this do I send a dispute letter to Halifax direct. (I have bypassed Blair Oliver scott as they are useless). I have pp all the forms in name as loan was in hubby's so they cant scan his signature anywhere. I feel as if we just go around in circles! I have been given a different address to ask for the SAR which I am unsure to do or to just leave things alone. Please advise. Thank you
  12. quick update I have had a letter from halifax saying they dont have the cca but its still enforceable as I wouldnt of got the loan without it!! Their complaints department have also said the same thing. They still havent responded to my sar and have asked if I still wanted it! Erm yes please... I have written another letter saying unless I receive the cca and the sar by 30th Jan 2013 I will be seeking advice from the financial ombudsman. Is this correct though for halifax to say the loan is still enforceable. I have also stated that until I get the things I have requested I will only pay £1 per month. Please advise. Thanks
  13. yes they have had the dispute letter then I received the letter asking me to drop it!
