My employment contract states the two following clauses: 1) You will be required to undertake such other duties temporarily or on a continuing basis as may be reasonably required of you, commensurate with your grade in the company. 2) Variation of Contract Terms: The company reserves the right to vary the terms of your contract from time to time. In such circumstances, reasonable notice will be served and the appropriate consultation process followed. Temporary at my work place certainly means on an ongoing basis until further notice, that could typically be until they appoint someone new or make a decision on whether they want to promote me permanently or not, they are not the fastest and can take beyond a few months to make any kind of decision here. Salary is based on a graded structure and I have asked for the last 2 years to be regraded but they have denied it each time and found reasons to prevent it being so when they have been cost cutting behind the scenes but then finding reasons to give management rises. They have rebuffed my attempts at finding out what salary ranges qualify for the grades which run from F being lowest to A being top, with me being an E and wanting to go into a D with my experience. The finance manager is a male. The workload expected to fall onto my shoulders will be that of a finance manager who sits in grade D while I sit in grade E. His duties are to approve and carry out and conduct where as mine is to assist with in all aspects even though I have been punching above that for years now.
  2. Hi, I am after some advice here. I work in a finance team of 3 consisting of myself (Assistant Accountant), an Accounts Payable Clerk and a Finance Manager. The Finance Manager has fallen out with the company and has been signed off work for 2 weeks with work stress but I expect this is going to go on longer. There is an ongoing legal case between the manager and company ongoing as well which makes things worser. If it does and in the interim, the company expects me to pick up the finance managers workload on double the stress and on my salary and no more extra (which is expected as they recently made a few people redundant and have given people increased workloads with no additional pay except for a few managers), then what are my rights? Will I be expected to do this? - My contract says you will be required to undertake such other duties temporarily or on a continuing basis as may reasonably be required of you, commensurate with your grade in the company. I have no appetite to do those extra duties on my current job title and current salary as despite being promised a promotion for meeting objectives and going beyond duty they were passed off by management last year and i received nothing to account for it. However, none of these additional duties I may be expected to do or coming my way feature in my job description and are quite advanced even though i could quite capably do them, could I then go and ask them for an increased salary, and if they say no, raise a grievance against them? Would that be upheld or would they dismiss it, then following from that, would I have a case at the employment tribunal? All thoughts and similar experiences are much greatly appreciated.
  3. at Seven Kings Station Grotesque, I can see how this would look to them given the lack of barriers present, but I did not do this to simply save pence if thats what it is. I was genuinely late to work that day, the train was about to leave, its difficult getting on that national express east anglia service from seven kings at that time of the day because it is so overcrowded and reliability sucks, a combination of all factors really, but now I feel like a muppet.
  4. Hi, Similar cases have probably been posted before, but I am at my wits end and in a state of panic, please help. I have been very stupid. I live between zone 4 and zone 5 in East London / Essex boundary, and I regularly travel to a particular station on a C2C route to get the train to Fenchurch Street as it is fastest, and I regularly purchase a monthly oyster, and have no problem doing this. On a one off when I knew the c2c was down, and I was between monthly oyster passes so I had a pay as you go oyster, I used a National Express East Anglia station in mid December last year, and this is not my regular station. I got to the station, saw the train there, and being a bit late to work that day, ran for it, forgetting to swipe in. Of course, this train went straight to Stratford, and realising what I did, came off and went to touch in before using the underground, and in doing so, I got caught out and cautioned by a revenue protection officer. Let me point out that I have never broken the law, I do not need to 'cheat' the legal system and I can more than adequately pay for my travel, despite what I think of the poor service and delays offered by the railways. On this morning, it was my own stupidity and naiveness that let me down. I pleaded with the officer that I realised my mistake hence tapped in, and offered to pay any fine he was willing to give me and any record would dent my future prospects, but he would not budge and told me that I would be hearing from them over the course of the few weeks, however I have not received anything to date, however I know these things turn up when you least expect them. I am an accountant in training, hoping to complete my chartered accountancy qualifications in the next 1-2 years, I pay my taxes and my dues all on time, I am still in my 20s and hold a good clean record as well as a good academic and employment record and any conviction on my record will harm future prospects for employment as well as the opportunity to go and work abroad in places like Australia and America, which I am tempted to do at some point. I am willing to own up to this mistake and take what penalty is given as I know I have been a tool, but is it worth consulting a lawyer for advice at this point, as I cannot afford to have this going on my record should it get to court.
