  1. Hi All,I stopped paying MBNA (owe then £8,600) due to the financial situation since last one year. Recently I have received letter from Solicitors of Fedrikson International demanding me to contact thier client with payment plan within 7 days.About 7-8 months ago, I had sent a letter to MBNA requesting a copy an agreement quating an consumar Act as well however when they sent me a reply, letter mention that some of the documents are missing & were trying to locate it. I took out this card in 1998 so I am certain they have got nothing like an agreement.Could you please advise me as to how I should be responding to this solicitor of Fedrikson as 7 days timeline is coming to an end today.
  2. Thank You Stormski for your kind advise.Aaron
  3. Hi All,I am in a desprete situation as I am being swampt with letters from Fedriktion International & others for Credit Card Debt (totalling £25K). all of these debt were taken out long time ago, one going back to 1998.After I lost the Job two years ago, I stopped paying these people. At that time, I came a cross the idea of asking them to provide me with CC agreement & one of the card provider MBNA came back with a letter stating not all the agreement is available at the moment & others sent me those agreements, on most of them didn't have my signatures.I have even changed house wth a hope that I would not be hasseled. To be honest, I can hardly afford to pay this debt although I have a job now. Can someone please give me an idea how I should be dealing with this people? In terms of this MBNA card where they have accepted that they haven't got my signed agreement, can I send them a letter which could compel them to write off this debt.I have received a letter from Fedrikson Int's solicitor (standard templete letter, computarised printed) asking me to contact Fedrikson within 7 days. Please Please advise as last thing I want is a Baileff on my Door where I have my wife with little kids.

  5. Hi All, About 8 months ago, I requested MBNA to send me all the agreement quoting section 78 of the consumer credit act 1974. I have just received a letter from them which states: We enclose a copy of original agreement together with a copy of the agreement currently in placea and signed statement of the account' Unfortunately the copy of the agreement that we have retrived is incomplete, and at the moment, we are unable to provide a complete copy. While we try to locate this we confirm that we will not issue court proceeding against you to recover the amount owed to us. However, please be aware that you should continue to make payments to your account, this is because your debt continues to exist and has not been extinguished, so you continue to have an obligation to pay us. As such, we are entitled to contact you to request payment if you fall behind on your payments. We are also entitled to report your repayment patterns to Credit reference Agency, including where appropriate, registring a default against your name, this has recently been confirmed in two high court decisions: McGuffick V RBS & Carey V HSBC. ---------- Please advise me how do I move ahead in order to get rid off this debt! after receiving above letter from MBNA CC. Thanks, Aaron
