  1. Hi Andy. Ok thank you for replying. I was wondering whether sending them a copy of the notice of discontinuance would get them of back for good. Is it pointless?
  2. Hi I had a disputed debt with Sainsburys. Foolishly i paid £10 in 2009 after being hounded and not knowing my legal rights. In june 2014 after years of harassing me, i finally got them to send me to small claims court. I defended in full. In april 2015 They sent me a notice of discontinuance but refused to remove the default on my credit file. That ended two years ago this coming Nov. I have suddenly started receiving texts, calls and letters again from them clanking the debt is still outstanding. Could someone please tell me my rights regarding this and how I should respond. Right now i am unwell and the stress of this on top yet again, is getting to me. Do i have anything to worry about?
  3. Hi, I'm not sure I'm on the right subforum so my apologies if so. I am asking for advice about a survey report that was done when I bought my house back in 2003, at the time the sinking floors came up and I had to havea specialist report done as there was concern that it could be Sulphate Heave. A company came in to do a visual report and advised us that it was not the case and that it was simply cosmetic, due to this reprt I decided that I would still proceed with the sale as It would be an expensive job to level it off. However, I put my house up for sale this year and when I finally had an offer, the buyers survey brought up the same problem ( we had levelled it ourselves and laid laminate flooring but it gave slightly at the doorway to the kitchen and this is why it came up again). I then had to pat for another reprt on the floor as they would not accept the original one and they also wanted a sample testing 9 which meant we had to take up some of the floor!!) The sample report came back that would Sulphate Heave would be possible if it was to get wet and that in todays market it would prevent sale of the house, obviously I would not of bought the house if this was advised when i bought it as it would cost thousands. I had the report done the second time with the same company so they will be aware of the contradictary reports they've done, I have not heard from them regarding it. I am wnting to know if I have any chance of claiming against them as there is no way i can afford to fix this and it doesn't look like I can sell my house without. Any advice is appreciated.
  4. Hi, I have been in dispute with sainsbury's for 18 months due to them firstly dealing with my account and then adding charges whilst it was in dispute. I have refused to pay anything till they take all the charges off that they have applied. I have had an offer from them to take off some to get me to my credit limit which at first I was happy with After doing some sums I realised they were very short of what they've added. I sent them a letter saying I was refusing it and asking for the correct amount to be taken off after which I would pay 60 pounds per month to clear the outstanding amount. I have sent that letter three times and had no reply (the last was recorded) I have however been receiving threatening phone calls and letters from debt collection agencies, some of which I have answered and explained the situation. As a result they freeze the account for a couple of weeks. I'm stuck as they won't reply now I want to reclaim back all the charges applied to the account since it was opened, is this still possible and can anyone advise me how to go about it given the situation, thanks carrie
  5. Hi, please bear with me, this is my first thread. I got into financial difficulty in 2005 and as a result I missed two or three payments. The finance agreement was with MG Rover on a 3 year payment term after which I would pay the outstanding amount in one lump some, give it back or trade it for a new one. I had no difficulty paying until the last few payments. The finance company sent me a letter saying they were sending someone round to discuss my options, by the time he came I had managed to get the money together to pay what I owed however, he said that he was unable to except anything less than the full outstanding amount and if I couldn't pay then either I'd would have to surrender it or they would get a court order and take it. I was so upset that I agreed to let it go. They then put it through the auctions and I am still paying the difference back to them. The reason I am now posting this thread is because someone has just told me that I have been misled and I could of paid only the arrears, If this this is the case does anyone know what I should do? I still owe £1200. Any advice would be appreciated. carrie

  9. Hi, I'm new to the site so please bear with me. My ex-partner has been suffering with insomina, depression, anxiety, anger manangement problems and social phobia, he is unable to concentrate on simple day to day things nevermind look for and learn a new job! His doctor and counseller both agree that he is definately unfit to work not to mention the five times we have been to A&E due to these problems. He has been for the "medical" and he scored a big fat 0. It seems to us that this so called medical examiner did not listen to a single word from his patient. And has made his judgement based on phyiscal ability. He has been back to his doctor who has said he is still not fit for work however he has had to sign him off with his hands instead of his depression as he will not qualify for ESA otherwise. (his hands are injured due to self harming, i.e; punching walls). Due to this decision he has obviously gone worse and I am terrified he is going to do something to harm himself, i know mental illness does not have physical symtoms that can be seen but surely his GP's and counseller's opinion is proof enough!? Please can someone offer me some advice??
