  3. Karnevil, thanks for that, didn't look before i posted reply to Glenn UK. I am just heading off to look at other court forms in the library, although the letter doesn't mentioned anything about other forms.

The paragraph in the letter say; "Each pary shall deliver to every other party and to the court office copies of all documents (including any experts report) and including a witness statement of their own evidence on which he intends ti reply at the hearing no later than 20 October 2006. HTH
  5. Hi, Still doing his on behalf of sister My sister has received her court date of 21 December 2006. she has to send some information off the the court by 20 October 2006, this includes a Witness Statement. What exactly does she have to put in a witness statment Thanking you in anticipation

  7. Apparently the default judgement was rejected as Abbey got their defence in the same morning she requested the default, she has now received the defence from Abbey, and has asked to fill in questionnaire by 27 September.
  8. Hi, Having claimed back my charges (NatWest) my sister has been going through the process with Abbey. Having done the standard letters etc, she then made a claim. Abbey did not enter a defence, so she requested default payment. Since then, she has received two letters, one from Abbey direct stating that they had paid £560 directly into her account as a goodwill gesture (she has checked this evening and the money has been credited back to her account) The second letter has come from Abbey's Solicitors, they have said they would pay 50% of the claim, some £530 pounds, as full and final settlement. When these two figures are added together to they roughly the amount she has claimed. What does she do. send a letter to Abbey direct acknowledging, half of it, and accept the settlement from the solicitors, so has the full amount. Or not saying anything about the directly credited money and accept the the solicitors offer. Do abbey and their solicitors actually speak to each other, because they have effectively offered her 50% settlement twice!!! Sorry if i'm rambling, i never encoutered this problem, so couldn't advise (sisters computer is down this is why i am asking the question, so she can decide what to do next) Any help would be appreciated.
  9. Hi, Just a quick update. It has been two weeks since i requested and was granted a default judgement. I hesitate in executing the warrant because i was away last week. I nearly did it last night, but decided to wait for a few more days. Then today a registered letter from RBS (owner of NatWest as you probably know) arrived in the post. It contained a cheque for the full amount of was requesting. Yippe!!! Letter said " we write with reference to the Judgement in default which has now been entered into against the Bank and, in accordance with the Judgement I enclose a cheque in the sum of £XXX. A copy of this letter has been sent to XXXXX County Court." Once again I would like to thank all members of this site for all the information provided and inpsiration gained. Unfortuately for me my bank claiming journey is at an end because i have no more left to claim, but i will still be following this site with a keen interest. Thanks once again
  10. Have logged onto money claim today and the judgement has been granted and the that the order has been sent to the defendant. One thing i didnt mention earlier was that when i applied for defualt judgement i was well passed the 28 days by about a week, so surley not even Nat West can claim they didnt have time to enter a defence. Well will just have to see what happens next
  11. Hi, Having succeeded with one bank already, i decided to have a go at Nat West. I went through all same procedures as before, Nat West filed an acknowledgment stating they were defending the claim. This is where it differs from the last case. Before i received my cheque within the 28 Days. This time i have not. So i have just been onto Money claim online, to ask for a judgement to done by default. Obviously this bit is new to me, and wondered if anyone else had got this far and can tell me what i can expect next. PS - previous bank was RBS, so assumed NatWest would work the same way as they are one in the same. Thanks in advance.
  12. Hi, Having been looking at this site for quite a while, i decided to fire off my letters to RBS. I start at the begining of April. I received the standard letter back etc, but sent them the seven day letter to threaten court action. This I did and started the claim on line. They acknowledged and stated they were defending the claim. Today, some 1 and half weeks from acknowledgement, i received at letter with a cheque for the full cost of my claim £726.00, as final settlement (without them admitting anything) and stating it was because it would not be cost effective to defend the claim. Justed wanted to stay thank you to all on this site for all your help, and good luck to the rest of you. And watch out Nat West i'm on my way to get you next!!!
