  1. Thanks it’s a hard lesson learned and cost my lad ££, whilst someone has a nice 2nd hand phone in their pocket.
  2. He has his receipt and it does say 30g, but how many of us check that. I appreciate it’s something that’s obvious but they never received anything so am at a loss to understand how they can be so certain. We have weighed his current iPhone and that comes to just under 200g. I’m beginning to suspect a nice little scam by someone at the local post office but again we will never prove it.

My son sold his phone to Music Magpie a few weeks ago, he agreed the price £350 and sent it to them using the pre paid Post office labels etc. After a week or so he heard nothing after a week so chased them. After usual email tennis they are refusing to pay as they say it hasn’t been sent. He has the receipt from post office proving it was dropped off but then disappeared in the system. They have looked into it but because the post office inputted an incorrect weight of parcel as 30g they are saying they won’t pay as it’s classed as fraud because a phone weighs more which is correct. They are therefore claiming he has tried send them something other than the phone, this without evidence as they have never received the actual phone parcel. Any advice please good people ?
  4. I recently sold my amp on eBay and sent it to the bidder using EVRI (Paclink) and paid for the extra insurance. It was packed as per the instructions but I didn't take photos. On arrival it had clearly been dropped from height as the metal case was damages on 2 edges, and the batteries we sent bubble wrapped where crushed. I claimed via Paclink but its been rejected as they claim it wasn't packed correctly. The buyer sent me photos of the damage but hadn't kept all the packaging. I am now being chased by eBay to refund the buyer but what are my rights, if any, as the fault was all of Evri's doing in y opinion ?
  5. No problem, its just the system. Just keep your nerve and await a date.
  6. As I advised, based on my own experience, let the mediator ring you but explain that you don't have the necessary documents to enter into any discussions. They will try and get you to agree as its just a tick in the box but politely refuse. It will then be returned to the court and based on the fact you dont have any of the originals forms it will test the resolve of Merlingen. They will hope you crack at some point and agree a deal, they will not want to go to court unless they have the right evidence. Hold your resolve and play their game.
  7. None of the documents look like originals or even copies of originals to me. Like I say wait until you get a court date.
  8. I'd not bother emailing the court, just wait until the mediator rings you, its all about playing the long game as I have said.
  9. It all depends on the other party really so I would say 48hrs if you have an email but don't do anything until you get a court date and then come back on here for advice. As regards mediation you can only honestly go into it if you have all the paperwork your requested from Merlingen, if you are missing things like proper agreements/Default Notices etc as opposed to copies of generic ones then just tell the mediator when they ring you that you dont have all the info and therefore dont feel confident agreeing to anything and they will return it to the court. This is when you will get a date and Merlingen will have to put up or shut up. Remember they have bought a spreadsheet with 000's of debts on it and the majority wont have any paperwork.

Why not wait until you get a court date before you offer the leeches anything, many of us have won and lost cases like these and from what I have read they dont seem to have much in the way of documents to prove their claim. No harm eating until the last minute, I have offered payment 24hrs before and have had this agreed and court action withdrawn. What they dont want is a CCJ and then someone who applies to the court for reduction in payments that could take years as opposed to someone who offers something decent whilst they can always take it back to court. Its a game of poker, dont show your hand quite yet.
  11. Good news, sort of. After I helped with an offer of payment they have agreed to a £40pm plan and will not ask for the stay to be lifted in case she doesn't pay. Her husband passed away on Saturday unfortunately but at least if she wishes now to move on there wont be any restriction on the house.
  12. From past experience with these leaches, the N180 is yet another way to test your resolve. My advice is fill the form in and return it and just hold out.
  13. My experience of these sharks from last year is just to wait it out as others have advised, they love to send out "aggressive" sounding letters hoping you will bottle it and make an offer.
