  1. The catalogue is probably manageable not ideal to still have a ccj though. Honestly couldn’t say if I informed them of change of address we have managed to deal with most of our debt while over here hsbc I thought was dealt with and I forgot about this one. How would I prove to the courts that the hsbc debt was statue barred? Actually would I be going down the unenforceable cca route as well? Is that still an option?   2. Ok post 4 Last payment can’t remember likely early 2013, it was for fashion world we fell out as they agreed to freeze interest then didn’t. If I remember rightly there cca was enforceable. The ccj was acquired in 2016 it will not have been statue barred it does not seem to be loaded with charges like the hsbc one. Would my next step to be to find out the details of the judgement? I don’t think I’m able to check my credit file from abroad. Thank you for the help.

Iirc with the hsbc debt they admitted to having no agreement and I think they sent a reconstituted one which I was advised at the time wasn’t enforceable in the slightest this was back in early 2010 I’m certain payments stopped in late 2008 early 2009 at the latest so this was statue barred I believe a good year before the ccj was obtained. Hsbc sold the debt on. I’m confused as to why it has gone up over 6k as well. Perhaps if we return I should just go bankrupt!
  4. I have just made the discovery that I have 2 ccjs against me from 2016 totalling circa 20k. I left the uk in 2014 1 a credit card that I had been fighting hsbc with as there was no agreement this had been in dispute since 2009 and I believe likely statue barred before the ccj date. This has grown dramatically from a debt of around 11k to over 17k on the judgement. 2 an catalogue debt that is around 4K not likely to have been statue barred before the judgement date. These were obtained by using my last uk address. We are now having thoughts of returning to the Uk but what happens when I return? The hsbc debt had ppi on that I have never reclaimed it would be a large amount by now I would have thought. Do I need to attempt to get these set aside? We would be moving to Scotland but these debt were in England if that matters? Can anyone help please?
  5. Hi everyone, My mum has received the data from the SAR she was adamant that she had not taken any ppi out and if she did she would have cancelled it after one month when she discovered it. However the details show that she had signed for the ppi. where does this leave us? at the time the loan was taken out she was a company director of her own company and would have continued to be paid even if she was sick/ill, she says that she was not salaried but made drawings every month with the other director. Is it possible to reclaim this ppi? it runs into many thousands.

  7. MY mum has received a letter about PPI from M and S explaining that she had it on a loan from them and asking her to fill in a questionnaire. She thought that she did not have PPI on the loan and that is why she never did anything about it, she would not have knowingly taken it out at the time. What is the best way to fill in the questionnaire? alot of the questions she can not remember the answer to. Is this the best way to go about reclaiming? will they be honest? Thank you.

My old thread seems to have died lol recap, hsbc no cca been chased by MCS now being chased by DG did have a company who cliamed to be able to clear it off, but they have got nowhere in nearly a year and are now advising me to make token payments! So im goignt to have to try do something about it myself. I got a letter today from DG reffering to the previous correspondence (not sure which) Asking me to forward my proposal regarding the account I have 14 days upon which normal recovery will continue. So what should I do so far Ive had the following ideas; 1 Do nothing, they are just fishing and reminding me they are there, this is the first letter since november. 2 Send off a CCA request to them to highlight the fact I know there isnt one and they know I know there isnt one 3 Send a letter highlighting the "prior consent" clause in the oft guidelines and telling them I will be taking it further. Any other ideas or what way would you informally reccomend? Thanks all.

  11. Hi all here we are a year on from starting this thread has there been a change in the law regarding CCA's etc? I instructed a company to take this over from me due to health problems but have got nowhere and there latest communication has stated that they are having insurance issues and I should start making payments on the balance. Where should I go from here? On a side note can ppi still be reclaimed? thanks
  12. MY wife has had a amount of around £350 owing to next this debt was originally passed to moorcroft. We requested a cca from moorcroft who eventually wrote back explaining that they couldn't find one and in that respect they would be no longer persuing the debt and were passing it back to next. Nothing happend until around six weeks ago when Roxburghe started to persue the debt we have ignored there letters today received a letter before action from Graham white solicitors and now dont know what to do should we send a another cca request? to who? is there another better letter to send? thanks
