  1. thanks, DX. I know exactly what you mean but unless i am missing something i don't see what difference it makes? OK, you have an old defaulted debt. It drops off after 6 years never to reappear. All understood. But the debt owner goes for a CCJ which shows for a further 6 years in the judgements section of your credit report. Let's just imagine they win and you can't pay. Your credit report is then ruined for a further 6 years. The original point of my first post was just to ask the question as i was unsure if after the 6 year period of a defaulted account a CCJ would actually show. I now know the answer, many thanks.
  2. Thanks for reply. Just to add more details. I am unfortunately well aware of exactly what a CCJ is and agree with all of your comments above. I am probably being over cautious but just wanted to make sure of a few points which DX answered such as how a CCJ for an old defaulted debt over 6 years old can reappear on a credit report. I take all of your points above on board but in the back of my mind there was that chance the owner of the debt can still go for a CCJ after 10 years. If they then win and i cant afford the full amount, my good record is scuppered for another 6 years! To give you a fuller story. I have 7 of these old debts and still 'owe' approximately £20K. Most of the debts weren't even mine but are in my name so that bit is irrelevant although it makes me feel better that i am no longer paying money i never even had to a toerag DCA who bought the debt for pennies. All but 2 of them were pre 2006 and after CCA requests i was informed that the paperwork wasn't available and collection would no longer be pursued. Although apparently they still 'legally remain' and i get offers of FFS from time to time, last one was 50% a few weeks ago. I obviously ignore these. If they haven't found the signed agreement in 3 years it is unlikely they will find it? The other 2 debts total approx £5K were post 2007 and i have recons for these. I have checked them and all details unfortunately look spot on. I have been paying nominal payments for these for as long as i can remember. I recently received 50% FFS offers on both of these (different DCAs) so i am assuming if they are willing to offer this the likelihood of them being confident of going back to court for the full amount is unlikely. I will continue to ignore the debts with no CCA and tread slightly more carefully with the other 2, again probably being over cautious! With my new clean credit report i am now a house owner with a mortgage so that aspect is also a bit worrying but again they would need to follow the same unlikely process to get any kind of attachment. All of the expert help on here is greatly appreciated. I would still be in a complete mess without it. I don't like the fact i have the outstanding balances but i am now in a much better place. The over cautiousness is probably born out of a desire of wanting to stay there.

  4. Hi DX, Thanks for quick reply. There probably isn't a direct thread, i just used all the great advice on here to sort everything out myself. So the CCJ would still show and ruin my decent credit report if they went down this line? I probably just assumed the recons were enforceable as they were after 2008. It is a copy of the agreement with my name and address on plus a copy of the T&C's for the old account. There was also an accompanying letter saying they have complied with relevant sections of the CCA 1974 etc and the agreement is enforceable and they are able to obtain a CCJ against me etc. I just continued the same nominal payments of a few pounds a month and have heard nothing for a few years until a few recent calls and a letter giving exactly the same recon agreement that they sent out 2 years ago. They are probably just fishing but i wanted to know if the CCJ could come back to haunt me after all this time.
  5. Good Evening, Can i check something with experts on here. I now have a clear Credit Report with lots of nasties now dropped off. Some of my old debts were pre 2007 and are no longer pursued after a CCA request, apart from the odd call and letter telling me i am morally obliged to pay them and i am a bad person etc etc. I have 2 debts from 2008 which were defaulted but have now dropped off. I have the standard re-constituted CCA and have made nominal payments for 10 years. My question is can a defaulted debt re-appear on your credit report if the DCA decides to go for a CCJ for money i still owe? Will the CCJ show on the credit report even though the debt has long since dropped off nearly 2 years ago? Many thanks.
  6. OK, it was a long time ago but BC are still going to know it was me. I assume that they just forget these things when they sell them on and they are no longer concerned with my financial position 18 years ago? I hope so as it means there won't be a CCA when the good old DCA asks for it
  7. Not worried at all about the CCA requests as they are going well and i will not be making any payments until i have proper CCA's. My post was about 2 things. 1) You asked who the old forgotten debt was for - It was A/L, now part of Santander 2) I asked if the DCA searching for an old Barclaycard agreement would affect my current good standing Barclaycard agreement Thanks..
  8. Hi dx, It was a very old Alliance and Leicester debt who i believe were swallowed up by Santander. It was A/L that obtained the judgement. I checked out why payments stopped and my bank did not know but they did try and pay the SO's. I have had replies back from my CCA requests. I sent off 8 CCA requests. All have now replied, 3 have given up and said they will not be pursuing the debt. The other 5 have said give us more time and we 'should' be able to provide a credit agreement. They are all between 8 and 18 years old so i will wait patiently Another quick question. One of the DCA's are going back to Barclaycard for an 18 year old debt. I currently have a clean credit report which includes a well managed current Barclaycard. Will the DCA request have any affect on my current well maintained Barclaycard? I am concerned that this old debt will affect my current standing with Barclaycard when they search for the old agreement? Thanks.
  9. Thanks for your replies. The only thing that bothers me about this debt is that I have moved twice since I last heard from the DCA 7 years ago and for obvious reasons I don't want to bring it to their attention. If they did manage to convince a judge to enforce it I would never know so I am assuming that it will never reappear on my credit report (dropped off years ago) and they would have to enforce it at my new address? If it gets enforced or they come looking for me I can sort it out if and when it happens. My main concern is that it doesn't damage my credit report as I am in the process of buying a house.
  10. Hi All, Recently been tidying up my old debts including CCAing a few who have 'cashcowed' me for years. Currently have a clear credit report as all debts are long gone although most are still outstanding! There is 1 debt left that i am not sure what do with, actually thats not true as i intend to continue ignoring it but i just wondered what others views are on this. I won't mention names in case they trawl these sites and i don't want them to start looking for it The debt was with an old bank that has since been swallowed up by another. It was a credit card and a current account both of which defaulted. The debts were added together and i received a CCJ back in 1999. The debt was taken over by a DCA who continued taking my £10/month by SO until payments suddenly stopped in 2009. Nothing that i did, they just stopped taking the SO payment and i never heard a thing from them again? The DCA is still around i wonder if anyone has any views as to what happened. I am assuming it is gathering dust somewhere waiting to be sold on. I would totally ignore it but as it was a CCJ there are still possibilities that it could resurface somewhere else?
  11. Hi dx, Thanks for your advice on this. I agree with what you are saying - After a default has dropped off the credit file it cannot be re-added but what if the DCA decides it wants more money then adds a CCJ. This will then show as a separate entry. If they have a copy of the CCA then surely there is nothing stopping them doing this? Hi dx, Can you explain what you mean by 'F&F' wont prevent court. Surely if you have a letter saying it's a full and final payment and wont be chased by them or anyone else in the future then they can't do this? Also 2 of my very old debts (18 years) are already CCJs so this would make a charge much easier? Thanks again
  12. Hi Stan, Thanks for the reply. I have no doubt at all that i can get this to the 'formal offer' stage. What worries me is further down the line the offer gets withdrawn when 'further checks' reveal this very old debt. If this is after exchange of contracts i will probably lose a deposit of £20,000 as i am contractually bound at this stage. We are looking at a new build with nearly 6 months between exchange and completion so lots of time for circumstances to change etc.... I know that offers being withdrawn after exchange are rare but 'we found some old debt that you didn't tell us about' would certainly be a valid reason. There again if it's not on my credit file they wouldn't find it, unless of course the DCA's do something to my file which is possible. Did they not even question your payslips? That was a result, is it fairly obvious on the payslips?
  13. Thanks for reply, dx I agree that your suggestion would be nice but it comes with risks. We are looking at a new build so there will be 5 months between exchange and completion so plenty of time for the BS to find a problem and pull their offer. I suppose that if my credit file doesn't change there will be nothing for them to find? Do we not also run the risk of the DCA's getting an attachment order to my new house now that i own one. I am also assuming that the DCA's still look at my credit file for any chages after all these years? I still favor the full and final but they would need to accept very low offers very old debts. What are the chances? Maybe i will stop the SO's and find another way to pay so not affecting any change in the short term. More confused than ever about the best way forward.
  14. Hi All, I have spent the last few days reading thousands of posts and trying to get a grasp on things but i can't find anything similar to my dilemma. Will try and keep it brief as poss. We have a decision in principle with our BS. We went directly to them as the OH banks with them, they have the best rates and they are are by far the best fit for our needs. The DIP went through fine with the credit check as both of our credit files are spotless. The problem is i still have old debts totaling approx £30K from between 8 and 18 years ago. Yes, the large percentage of this debt goes back to 1998! I have somehow got away with minuscule payments for several years which i negotiated myself, approx £20/month in total. There are a total of 7 debts (mostly now with Cabot) with 2 of the early ones having CCJ's and the rest defaults. We now need to make an appointment to process the full application and i know one of the questions will be regarding Outstanding Debt'. Although the aforementioned old debts are no longer showing on my credit report they are of course technically still outstanding. I will have to mention them and this will obviously go against us!! I can of course not mention them but this will be dishonest and could lead to the mortgage being withdrawn after exchange (if they found out) which will mean the possible loss of a large deposit. Although no longer showing on my credit report the payments to the DCA's will show up on my bank statement. They only require to see 1 months statements so i could of course stop paying by SO/DD so i have a 'clean' month but again this is dishonest and i wouldn't chance it. Maybe they wont care about the old debts or maybe they won't notice (clutching at straws here!). The only solution i can see is to try and get low F&F settlements but i only have approximately £2-3,000 spare at the moment. If they accept i cant see any problems but the chances of all of them accepting 10% seems remote. Would welcome any thoughts from the experienced members. Many thanks. PS - I know i have been 'cashcowed' for several years and have never asked for CCA's. Unfortunately finding a way not to pay the debt wouldn't stop it being outstanding so wouldn't help my problem.
