  2. Geri53, Don't worry. I've succesfully claimed £400 from Lloyds this year and they defended their claim as well. They sent a cheque before going to court - most banks will say they defend claims but never go to court. I found the stuff on Consumer Action Group site invaluable and I was scared as well when I started. Since my success with Lloyds, I've claimed back £1047 from Nat West for an account I closed three years ago. Again, Nat West acknowledged the claim and gained 28 days to file a defence but they never did. On the 26th day I got a nice fat cheque from their solicitors. The funny thing was that the day after, I got a letter ffrom Nat West customer services offering me a £900 settlement. Left hand and right hand I think - some things never change. Currently got a claim in for £2800 for my wife from Nat West but not heard anything from them yet. The Lloyds success doesn't mean anything. It's not binding on any other court and they may lose on appeal - I suspect the bloke involved will dot i's and cross t's for the appeal. Don't forget also that the OFT are investigating charges at the minute as well so the ball is stil in our court. Keep your chin up - and good luck.
  3. Started taking Lloyds to court in early January using MCOL. They put in a defence and then I sent in Allocation Questionaire on the last date it was due. Three days later, claimed money, £400, credited to my account plus £50 MCOL fee. Three days after that, court hearing date received with letter from SCM saying Lloyds were settling. All in all it took just over a month to get MY money back. I couldn't have done this without the help of CAG - HUGE Thankyou. It wasn't as easy as I thought and needed a bit of work doing for it - mostly scouring CAG web site. But it worked. Comments - It could be organised a bit better and logically but it's worth spending time looking through the stuff so you know what to do and when.
  4. Cancelled mobile contract with Carphone Warehouse in January. Cancelled DD with bank. CW attempted to get DD. Same in Jan then Feb then March. Then I got debt collectors letters so wrote to cancel again. Still trying to collect money from DD. I've now paid debt collectors £58 to complete closure BUT CW still say account live and that I hadn't sent the closure letter by registered mail!!!!! Thety've now added another £20 to account. What can I do?
