  1. my daughter paid £200 on a debit card for a £200 car for my grandson for christmas. it failed after 2 months and ride on cars said it was needing a new motor which they eventually sent. it did not fit and they said they would send another. eventually it seemed a new lead was needed. after waiting for her husband to comehome and fit it, it still does not work. the company refuse to do anything about it unless my daughter pays to return the car. having checked courier companies that seems to be costing a fortune as the car is enormous..it seems they have a 7 day return warranty. is there anything she can do? i have read reviews about cars being returned to them and never being seen again.
  2. i had a barclaycard loan in 2000 with ppi. to cut a long story short barclaycard refused to honour the ppi when i wa injured and i took them to the financial ombudsman who ruled in my favour in 2006. they had in the meantime sold the "debt" to a loan company. i have been hassled ever since from various debt companies. the "debt" would now be statute barred and i have paperwork from the fo to prove my case. no payments were made on the loan since 2005 as i was injured and claiming the ppi. barclaycard were ordered to pay me but never did and just said case closed as they had sold it. however now "first direct" have got on the case and today i received a letter seeming to be from barclaycard saying they sold the debt to first direct in 2007 and i should now address all correspondence to first direct. the paper is very poor as is the printing and i am sure it is not from barclaycard...anyone else had a dodgy letter from first direct? i have no intention of communicating with them of course...but i wonder if this is a major fraudulent letter and actionable?

  4. only prob with that is he probably made payments with cash or from the business acc we had at the time(. in an effort to get my signature from that time 2003 i have been told by the bank that they dont keep records earlier than 2007, so i would think they are unable to provide this information) mbna have provided no evidence as to where the payments came from so i guess they would be unable to access this as well?
  5. dragging on....my sol says the letters written by my ex dont mean a thing as i could have asked him to write them..counsel found several faults in their paperwork but she says they are no defence either...s62 (2) cca as the right to cancel was not sent at the same time, in face they said it would be sent later..s61, 64 127,..countersigning breaches . unfortunately i have no record of my signature beyond 2007 and she says only my current signature will have to do for the handwriting expert and that probably wont wash. she says i really have no defence . the handwriting expert is my last hope but as i told her it is a brilliant copy and my ex had a programme to help copy signatures from his friend who did time for fraud! i dont think she is on my side any more and feel like throwing the towel in..to follow the money i have spent already. i cant afford to plod on with this.
  6. no there was no inventory, and the issues include stains on the carpet (new one needed ) which he had professionally cleaned before leaving, egg boiler in the cupboard broken which he wouldnt have a clue how to use, rug by fire already burned,mattress yellowed,oven tin used! chopping board scored....... house plants outside.... Also when he was there the bath sprung a leak and went into the kitchen which he told her about but she didnt fix so there is water damage to a cupboard door...she is a donut! and he is not a slob. so i told him not to worry and to tell her see you in court! ( just a clue, she has a bedroom just for her Jimmy choo shoes!) He was going to offer her something but I said not to as that could have implications..oh yes and he also has a text from her partner saying thanks for leaving the house in good order... she also states on the bill that he was a house sitter not a tenant so I said well house sitting is a minimum of £10 a day so send her a bill!
  7. Hi Guys My son was house sitting for a friend in a lovely house for a year. There was no contract written or deposit taken. He recently left and left the property in a decent condition. However the owner has now presented him with a bill for 2k! This includes a new mattress (stained), chocolate behind a settee, egg slicer dirty etc etc etc! He is now climbing the walls! Any advice please?

Yes thats great..... i dont have anything though ( all destroyed with great feeling!)i was thinking of forms i could apply for copies of, altho if its going crim i guess they can get access to that sort of thing. yes i cant imagine what else he may have done...... and his writing is totally different to mine so ive no worries there.

Well guys we have a development!! mbna have kindly sent two letters written to them in 2007 from"me" and totally they're in the ex's handwriting!! methinks thats very kind of them! have told sol and i guess the criminal route is looking pretty good! cant find a sample of his writing but i know its his ok complete with bad spelling..racking my brains to think what forms i could possibly get a copy of that he might have filled in somewhere..any bright ideas?

  13. well it seems to have gone from ..no way is this paperwork acceptable..to it looks like it is ok . i'm about ready to give up i think icant stand the stress but thanks anyway peeps
