  1. Hi I successfully got all my charges refunded last year from HBOS, with standard letter saying "future charges will stand". However due to a recent stay in hospital, i unfortunately went overdrawn and got charges to the sum of £350. I wrote to them and explained, they offered £90 refund. I said No and started with the Letters Before action etc... They have sent me a letter saying they noted i had received a refund last year and quoted letter saying "future charges will stand" Is this a bluff, can I still proceed with this to the Small Claims route? Any input would be great. Ta Dale

Hi Just a quick stupid question I'm going to make a couple of claims as my amount adds up to just over £1300 However I noted on Scotia's instructions where he kindly tells us how to fill in forms 1 and 1b with regarding small claims forms that in Details of Claims (7) it says " has held a bank account with the defendant since on or before DATE HERE the account number" What date exactly should be put here? Particularly if your not one hundred percent sure the opening date of account? Also can i submit more than one claim at the same time? Taking into consideration the £750 limit. (Does that limit include interest or not?) Regards Dale
  3. Hi I've done the Preliminary Approach and got overed 1/3 of charges. I sent LBA and got a flat NO! I now need to proceed to Scottish Small Claims Court. (Thanks to Scotia for Thread on Scottish procedures) But who do I put down as the defender, for the Bank? Head Office in Leeds? Local Branch? Or name of last correspondance who said NO to LBA? Any assistance would be appreciated. Dale
  4. Hi I'm new to all of this, but I followed the procedure and sent preliminary approach for payment. HBos owe me £1242. I got a phone call offering me £120 which I declined, he then offered me £360 and put that in writing with a standard letter saying it costs them , blah blah blah. I'm obviously going to reject this and sent the next letter the LBA and give them the next 14 days. Here's hoping this will aid them to a quick refund or it's off to the Scottish Courts! Anyone had success with Bank of Scotland?
