  1. Thanks Andy, It's written into my lease that I pay his buildings insurance. It also says that as a Tenant I'll be exempt from the Landlord & Tenant Act 1954. It also states asbestos is his responsibility. Could you recommend a fixed fee solicitor please? It's only a small business so I don't have the funds in the bank & all my assets are in the shop (wedding dresses etc, some which belong to my customer's not me) As of this week there's no money coming in.   2. Hi, It was a 'forfeiture of lease' due to an outstanding balance of £160 owing in rent. Where rent is owed the landlord doesn't have to serve notice or get a court order, they simply instruct a bailiff to make 'peaceful entry' and change the locks. The landlord then takes possession of goods etc inside the premises to secure against the money owed. Its totally legal for a landlord to close a business down even for a small amount of money owed. You'd think that there would be a minimum ie £1000? But there isn't. I dont have a leg to stand on even though the building wasn't maintained etc. I'll apply for 'relief from forfeiture' to the court. It tends to be granted if the tenant remedies the situation which would be rent owed, bailiffs & solicitors fees. This then, if granted, reinstates the lease. My question now if you can help me is, now that the lease has been forfeited, am I still liable to pay the remainder of the rent, ie the 4 year lease that's left, as the lease has effectively been terminated. And if relief is granted & the lease restored, does that mean I will be liable for the remainder of the lease rent. Thanks

  4. Yes that's the same landlord (sorry the site keeps signing me out) apart from refusing to pay the extra £10 per week since July 2018 in up to date plus a month in front with the rent. And there are no other issues that I'm aware of.
  5. Hi, please I don't know where to start. I took on a 5 year commercial lease in July 2017 & I have paid the rent every month & on time, I'm also one month in front with it. But in July 2018 the rent was due to rise by app £10 per week, which I refused to pay because the landlord didn't address the buildings problems even though I was paying his buildings insurance. I arrived at the shop this morning & the locks had been changed & it had been repossessed. I hadn't received any correspondence whatsoever regarding this. The landlord had instructed his solicitors to employ bailiffs or sheriffs to do it. Can this be legal? When I'm a month in front with the rent. I haven't broken the lease in any other way, but he has. Thanks

  7. Sorry, my heads all over so i haven't explained very well.. The work was done, authorised and paid for by him, something that he now denies because it turns out it was asbestos even though he said it wasn't, so my customers & myself have been exposed. And the fact that power tools were used exacerbates the asbestos problem. I wrote to HSE who weren't interested, they said they would write to remind him of his responsibility as landlord. He had Bradley Environment come out & do tests, but neither they or him will tell me or email me the results. I messaged him to ask him to authorise them to give me the results but he hasnt replied. I dont know what grade it is and the landlord is bare faced lying about it.
  8. Sorry about the delay, and thank you everyone. Im just firing my laptop up because my tab has all of a sudden stopped downloading docs and my paper lease isnt here. It actually says in the emailed lease that the landlord is responsible for asbestos. Ill add a picture of my lease ok just to make sure because the wording is weird. this is what it says in the lease regarding asbestos... does that mean its his responsibility? The problem is he is denying ever paying the handyman to fix it, saying I paid him and contracted him which i didn't, I paid him on behalf of the landlord and the landlord then gave me the cash back, however im sure if it went to court I could prove this. He has now ordered me to dispose of the panels that were removed. But I said they were his responsibility. "To Comply with all matters relating to use of the Premises statutory or otherwise save in relation to matters relating to asbestos which remains the responsibility of the Landlord."
  9. Hi, I could really use some advice please Last summer I signed a five year lease on a commercial property. My own stipulation was that it didn't leak or flood after being in two weeks it did leak, feel conned, but that's not the worst of it. The leak was due to a crack in what looked like old corrugated asbestos sheets, I asked my landlord if they were asbestos & he said no they definitely weren't & that if I got a handyman to fix them he'd pay. I used the guy who had just moved me into the shop. I asked him if he thought they were concrete or asbestos & he said its just concrete, I went online to look at pictures but I couldn't tell the difference. later that week he replaced the broken panels using a circular saw amongst other tools. Fast farward to Dec 2017 & the other leak on the roof was still leaking the landlord got a roofer in for a quote, it was £450 which I thought was a lot for an afternoons work. Silly me trusting people.. It wasn't until the second roofer came & quoted the landlord £250 that the penny dropped, I asked the roofer why it was so expensive & he told me its because its asbestos. The landlord then came in to tell me he was going to have the work done that Thursday, while I'm open to the public, I wouldn't allow it, I said it was asbestos! it had to be sorted out in line with government guidlines etc. I contacted HSE who said they would write to him & remind him of his responsibilities. And that's it...The work hasn't been done, now the landlord has denied having anything to do with having the work done by the handyman in 2017, blatantly lying about it, and has told me I must pay for the two sheets disposing of. In between all this (Jan 2018) he had a company come in to take sample's but I don't know the outcome. Both my customers & myself were exposed to the asbestos in 2017 for sure as he used power tools. He's totally denying everything, im so angry & confused. Ps, this isn't about me getting out if my lease, I'd like to stay there but the landlord has turned nasty.

  11. Hi rory32, Thankyou for the welcome & thank you ver much for your advice & template. I will write the letter today & post it recorded delivery. I realize this is a very small problem,but not to me Im just very upset that no one involved did their job right or is bothered about sorting this out. I did read the OFT website & read with interest about the things you mentioned in the template ie unreasonable time lapses,disputes etc. This kind of thing always happens to me & i always just give up for lack of advice/knowledge/will power,but its very demoralizing.   12. Hello everyone, My name is Beverley & i have a small problem that is driving me crazy. I would really appreciate any advice anyone can put my way please.. Im not sure if i should post it here,iv found this welcome post hard to do because im terrible with these things,im sorry. A while ago i paid a debt in 3 installments to Rockford's debt collection agency,which i paid at the post office They were paid on time & i thought that would be the end of it. But 2 months later the agency telephoned me to say they hadnt recieved the last payment. I explained that it had been paid & that i would find the receipt ,the woman on the phone said she would call back that day to see if i had found it. I found the receipt, my sister paid it for me & had kept the receipt luckily. Well the woman never phoned back so stupidly i thought they must have located the payment. Then another two months later the woman phoned back, maybe even longer, and i couldnt believe it & i explained to her that i thought the issue had been resolved as she didnt phone back 2 months proir. In the meantime my sister moved house & the receipt has been lost (i know im stupid) So i went to the post office where i had paid it but they could only go back 2 months, by now it was 4/5. So i phoned the royal mail helpline but they were unwilling to help because i didnt have the exact date when it was paid. So then i filled in a form of complaint or query online, to which royal mail emailed me saying they were dealing with it. This was at the end of september & i havent had a reply since. Rockford's have now phoned me to say they can only keep the hold on this for 2 more weeks. I know this is a small amount of money compared to other peoples problems ,but its very annoying when it has already been paid & i am on a very low income. Please could anyone tell me if there is anything i can do before i roll over & payup again. I know i should have got the receipt & kept it safe but i thought it was safer with my sister. But if the woman had phoned back when she said she would this would have been sorted out then. Thankyou
