  2. I went down the court route with both Natwest and RBS, and although there were no complications I had to spend hours and hours researching everything so that I'd be ready if it did go to court. I suppose as more of us start going down the FO route we'll see how it compares to the tried and tested method of using the courts. I believe initially it was taking the ombudsman months to look into the complaints but it seems they are now on top of it. To be honest I can't be bothered with the courts this time so if I can get my money back this will be very pleased!!

After reading this thread I've had a look around and decided I'm going to go down the ombudsman route with my Barclays claim, as its only for a small amount and I can't be bothered with all the stress and work of going through the courts again! Had my final response from Barclays so submitting my complaint today!

  8. hiya I'm in exactly the same boat as you last year I signed an agreement after my first claim and have now just started the 2nd claim, I am fully expecting it to take forever because they will drag it out and I think are much less likely to settle before filing the court claim. When they write re the agreement I am just going to point out that its an unfair contract term as per the UCTA 1977 and that you can't sign away a legal right! I'm sure they'll pay up eventually they'll just take their time about it, I'm about 2 weeks in front of you as I've just sent LBA so keep me up to date with how you get on! Stacy x

Hi all, I have already had a previous claim with Natwest early last year and they settled straight away, and I ( Stupidly I know) just signed the form they sent with the refund, effectively signing to never claim for future charges, I was new to the forum etc! So have been putting off claiming for charges since last year as it will be slightly messier, UCTA 1977 etc. Anyway after they charged me £114 in one day last week I have decided to finally do something about it! So prelim sent 08/03/07 for £456! Stacy x

Hi demon, If your partner submits his tax return before 30th September he will be able to pay any underpaid tax via his tax code, so he will pay a little more tax through his employment every payday until the amount is cleared, this is usually quite a manageable amount and is what I'd avise and what the revenue would prob advise as well.   11. I think they only tend to close accounts if you claim against them more than once, but as me says best to be prepared!
