  1. Sorry about the link, i didnt know - accept my apologies. My claim went to court was 'stayed' until the end of the test case. It was decided the charges are unfair, however the banks involved in that test case appealled. I am now awaiting the outcome of the appeal. It's already gone to court.
  2. Hi all, Am i right in thinking we're (us all) are still waiting to hear the outcome of the banks appeal to the test case? I ask because after not hearing anything for a while since hearing the banks are appealing to the outcome of the test case ie the decision the charges are unfair. I had a phone call yesterday from a company called Capitol Plus Edit, they said that the banks are legally obliged to pay you your charges, i would not hear anything from the banks from now on and if i paid a £69 fee they'd send me some documents to fill out and in 12-16 weeks i'd have my money. They also said they were regulated by the Ministry of Justice and they gave me their Registration number (CRM no.) Has anyone else had a company ring them saying the same, are they to be trusted, cant i continue to claim on my own and that no money is YET to be received from the banks as we're still awaiting the outcome?   3. Yeah, im used to wearing a shirt for work but dont normally do ties. I got the impression the banks solicitors were not very experienced though, made a few errors and they didnt seem that much (if at all) older then me (24). They didnt seem that long out of uni. To be honest, because the court has put a stay on the barclays claims until the OFT test case, i cant see the bank settling before the test case. The banks could be a little more confident now that the judge has postponed the decision until jan. Although its not over yet by a long shot.
  4. Well good luck with the cheque business, at least a handful of people will/should be getting what they went in there for. Jess - Dressed all in black by any chance? No i didnt stand up and talk. I was in a blue shirt and tie about 5ft 5, mind 20s, sat next to a bloke in a pink shirt in the area on the right you walk in the door. I didnt realise there were going to be so many people in one hearing, and how disorganised could they have been at the beginning. I found some of the language the bank representatives used was a bit over my head at times. I got kind of confused towards the end. So, due to our claims been stayed until the OFT have had the test case, do we have to go back to court at all/until after that has taken place?
  5. Yes have to agree with you there Jess, us Barclays claiments were disappointed. What time did you end up getting out, as i left after talking to the Barclays representative - who was applying for a stay on our claims. So we didnt necessarily have to go back in? out of interest which one was you lol?
  6. Our Claims have been 'stayed'. Its all going to pivot on what's decided at the test trail with the OFT.
  7. Jess124 - So am i, we're all in the same boat on the same date, so you're not on your own. Its a group hearing so its not just you versus the judge. Noodles 3 - Could you elaborate on what you just said? Are you saying the outcome of our cases could be decided on what happens in the test case? ( i presume you mean the case where Barclays, cap one and others have been pulled by the OFT?) I'm basically taking my statements and the Mercentile Form down with me, anything else i should take?   10. Hi guys, Im new to the forum so hi to you all. Need some advise though. Ive received a letter with a hearing date stated within (mercentile court). However have received a questionnaire with some questions i do not understand, hoping someone can help me out here and put it into plain english? here goes... Parties- -Are all parties still effective? - do you intend to add any further party? Disclosure- - By what date can you give standard disclosure? - Do you contend that to search for any type of document failling within CPR 31.6 (b) would be unreasonable within CPR 31.7(2); if so, what type and on what grounds? -Is any specific disclosure required- DPR 31.12? - Is a full disclosure order appropriate? - by what dates could you give: a) any specific disclosure referred to at 8; and b) full disclosure? preliminary issues- -Are any issues suitable for trial as preliminary issues? if yes, what? Trail- -What are the advocaates' present estimate of the length of the trail? - what is the earliest date that you think the case can be ready for trail? - Where should the trail be held? - is a pre0trail review advisable? Can someone please explain these for me as i need to fill out the form and send it back 7 days prior to hearing. Now this questionnaire was just a photocopy and has no form number. It just says "case management information sheet- mercentil court" on the top and thats it. HEEELP PLEEEASE!? Thank you.
