  1. Your GP may be wrong. What does your contract of employment state? In the industry where i work you cannot take annual leave outside the UK if you are off sick without permission of the company. Usually the leave will be granted if (as in your case) your GP thinks it will help. It may also depend on your pay, as mentioned earlier, are you getting full pay whilst off sick or SSP? Bookworms last post is very relevant too. It also depends on the type of sickness, if it was (for example) Deep Vein Thrombosis and you decided to fly they could question if you are really fit to fly.

  3. Hi matey, I am not looking at the grievance procedure, i'm looking at the dismissal process. Was she dismissed fairly, was a proper investigation carried out and so forth. I don't condone what she did however i have represented a few ex Tesco employees (all have settled the day before for some odd reason ) and they are notorious for not following procedures and being heavy handed.
  4. Would an ET treat her the same. Have they followed the correct procedures etc, if they haven't she could have a claim. Whilst i don't condone theft etc they are still obliged to follow some basic procedures.
  5. Ah but she is not the appeal manager. It will be for the appeal manager to decide. What do you have to lose, the worst they could do has happened. Have you asked for copies of the paperwork relating to this matter, ie statements, notes etc?
  6. Cheers Bookworm, i thought so. I've served a SARN on Solitaire, they have written to their solicitors asking what it is, lol. I said thanks for acknowledging it (mind, they claimed that the stapled cheque wasn't attached so i've asked for their account details, i'll transfer it to them) the SARN. It's nice to have the shoe on the other foot for a change, this company were a complete nightmare for the time i owned the property.
  7. Have you been given the chance to appeal? You could appeal against the severity of the sentence imposed on you. You could ask them to reinstate you based on your previous 15 years experience, maybe at another location so they don't lose face and maybe in a role where you do not have the opportunity to steal though this may be difficult since the theft could money or goods. Even a shelf stacking role involves handling goods. Are there any roles where you could work which doesn't involved handling goods or money, maybe collecting trolleys or something? We would usually dismiss where i work however we may also remove the employee from their position and reduce their grade so they don't handle cash etc if they have a good record. Just my 2p worth.

  9. Hi all. I had a CCJ registered against me last year. I knew nothing of it, it was served at an old address despite the property management company (Solitaire) knowing of my new address. Went to court last week, threatened with costs application of over £2100 by Solitaires counsel however the District Judge agreed with me that they hadn't served the papers correctly and set aside the judgment. The original invoice that started the court action involved late payment fees of just under £600 on a £350 invoice. The legal costs of the the CCJ/solicitors etc added over £800. Can i claim this money back? The Judge stated that that the papers were not served correctly, surely that means that i couldn't have paid late as they sent the paperwork to the wrong address. Further to this, what about the legal costs/court fees? If the invoice was sent to teh wrong address, there would be no late payment fees because i would have settled the invoice and secondly i wouldn't have been taken to court in my absence. Hope that makes sense.
  10. Update: Today i received a call from Thomson's solicitors. They have advised their client that they were wrong and we were right. They cannot give us the villa we wanted as they are booked out fully however they have compensated me (basically half the cost of the holiday) and my legal fees. This could have been avoided had they just listened. I feel we could have argued and got the whole cost of the holiday refunded however we are not greedy nor were we in it for the money. I guess the money we get back can count towards our holiday and we still get the holiday we booked in the same resort etc.
  11. Update: I tried speaking to the person who has been writing to me. She left the company. I spoke to another person who basically told me to go away, tough, you'll have to go through a third party such as ABTA if you want to take this further. I've taken legal action via the small claims court, they have 5 days left to respond. They wasn't prepared to even consider what i was saying, never again will i use them.
  12. I've included a notice that i will take legal action if they fail to investigate this matter. It really looks like they want this to either go away by continually stating that their website is correct (bearing in mind they are using/referring to a different one to the one we used) or they think we'll cancel which we won't. If this isn't sorted prior to the start of this holiday we will go however we will advise them that going on the holiday is not to be deemed as affirming the contract but that we are not in a position to change the holiday after booking it.
  13. Right, today i gave them one more chance and threatened legal action if they fail to properly investigate my claim. I am stunned that they simply quote the website they use and treat that site as being the correct one regardless of the fact that the site i actually used for the booking is clearly different. Ho hum, let's see how this goes.
  14. Thanks all. I'm going to ask them where they got thier 'web page' print out from and then use that as further evidence of my claim. I'll write to them once more and give them the chance to resolve it.
  15. Thanks 1011001, that was my thought, i'll go through the courts however i'm not sure which court to go though. We want the court to order Thomsons to perform the contract, we are not after money, we just want the holiday we paid for. Would the small claims court be the one to go through?
