It will take parkingeye a few days/ weeks to reply, they will 99.9999% probably refuse your appeal. They must send you a POPLA code with their reply, you then have 28 days to get your POPLA appeal in, the POpLA time lines are strict so you must abide by them. Don't appeal on mitigation to POPLA, you will loose. The killer is Genuine pre-estimate of lose, (GPEOL) http://parking-prankster.blogspot.co.uk/ for all the up to date info and a guide to winning at POPLA, or at court. But don't worry about court, a good POPLA appeal will end this for you Martin g

I agree with Armadillo, life is too short to get into a technical argument with parkingeye. Please make sure that you do not appeal on mitigation but on winning points, the killer being GPEOL. There are lots of winning examples here and elsewhere on the net. I wish that everyone who gets a PCN would complain long and loud to their MP, it was Parliament that passed a badly draft, badly considered law and the only way to get real action is to make your MP aware of your anger. You could also ask why parkingeye's owner, Capita who are largely dependant on public sector contracts think it is OK to [problem] the public. If you want tell Capita what a rubbish company they own their new CEO is Andy Parker, I am sure he would be pleased to hear from you. Martin g -

Good Morning, Have you appealed in writing to Parking Eye? If you have and they have refused to listen to you use the POPLA code that they should have given you. Now get in an appeal based on genuine pre- estimate of loss ( none), and you can raise numerous other points, signage, right in law to sue, etc. All of these will cost PE money and you should win if POPLA are even handed. Good morning and well done!!! I am sure that you have enough evidence to go to the Police and to ask them to investigate under the Fraud Act 2006, the main headings of the offence are below. It was announced on the radio this morning that benefit cheats will be prosecuted under the Fraud Act and I can see no reason why a company that lies and makes misleading statements for gain should not be treated in the same manner. Finding someone in the Police who will take this on board may be difficult but I think it is well worth trying, possibly with the support of an MP who is interested in Consumer Credit and mabe a letter to the director of the CPS wouldn't hurt. I have shot down on this forum before for suggesting that the Fraud Act is a possibility, mainly due to the burden of proof, but you seem to have both documentation and a won court case with costs behind you. 1 Fraud (1)A person is guilty of fraud if he is in breach of any of the sections listed in subsection (2) (which provide for different ways of committing the offence). (2)The sections are— (a)section 2 (fraud by false representation), (b)section 3 (fraud by failing to disclose information), and ©section 4 (fraud by abuse of position). (3)A person who is guilty of fraud is liable— (a)on summary conviction, to imprisonment for a term not exceeding 12 months or to a fine not exceeding the statutory maximum (or to both); (b)on conviction on indictment, to imprisonment for a term not exceeding 10 years or to a fine (or to both). Good morning, Please appeal to POPLA, as is your legal right, because this will cost PE £27.00 directly plus a further sum in answering your appeal. It will also cost their trade body BPA Ltd a further £100 or so because the true cost of your appeal is about £130. I urge everyone to appeal, and everyone will have valid grounds, because the more appeals the more it will cost the "industry". It would appear that POPLA are very far from being an independent appeals body, and will lean over backwards to assist their paymasters, the parking scamsters. Obviously you are not bound by POPLA's ruling, and you can keep the whole thing running by further appeals to The Lead Adjudicator. And then let PE try and take your to court if they wish. I know that the site is not keen on posting external links, but I urge you to google the Parking Prankster blogspot for a good laugh and for the knowledge in his posts. SOGA problem with Sony TV purchased from Comet

Hello, I need some help from a SOGA expert. My Sony Bravia failed after almost exactly 3 years needing a new circuit board at a total cost of £122. The TV new was over £600. SOGA suggests that it should have lasted at least 6 years. Obviously I cannot go after Comet so my question is can I pursue Sony through SOGA, to the courts if needed. Their so called customer service is based off shore with very poor english and they were most unhelpful. I certainly won't buy Sony again. Any advce would be welcome. I will write to them suggesting they cough up as a good will gesture but, given their attitude on the phone, I am not too hopeful. Thanks Martin g

You need to go to the Council Highways dept, they keep maps showing any land that is part of the Highway. My friend , in Wiltshire, was in a similar position and the Council confirmed that the vehicle was on private land although it was next to the road. He wrote to the DVLA with this proof and they withdrew the summons. Martin g
