  1. I am employed by a tourist attraction in a season position, and my working pattern depends on when the attraction is open. During full season I would work 5 out of 7 days, however at the moment the attraction is only open 3 days per week, for which my contract expects me to work these days. My contract is for a set amount per hour (lets say £6.00 per hour). I have been offered for the last few weeks now extra work for days when the attraction is closed, however upon recieving my payslip I have been paid national minimum wage (£4.77 as I'm 21). This was never agreed on, and I only knew about it when I recieved my payslip. I have worked in the same place for the last 5 years and previously I have always been paid the £6.00 per hour regardless of if the attraction is open or not when I am working. However, due to recent changes the company I work for is under a new name (I started my contract with the new company in April after my contract with the previous company finished in November). I understand that my employer does not have to offer me these extra days work, however, when I am asked to work am I correct in thinking that I am entitled to be paid the £6.00 and that they have no right to pay me less for this. Also, am If I am correct, am I entitled to be paid the money I am owed for the last few weeks? What if I am correct and my employer refuses to move on this? Can I take this up with a grievance procedure (I'm not sure if they actually have one...) Many thanks Edit: I have now worked for the company for around 2 months, and don't actually have a written contract or anything.

  3. Just had a letter today mentioning the test case. Theres a paragraph in it that states: "Similarly, you should be aware that if you choose to issue a claim in the County Courts (bit late, done already), "the Master of the Rolls" (in England & Walkes) or "The Lord Chief Justice" (Norther Ireland) has, at our request issued a notification to the County Courts suggesting they stay proceedings about bank charges until resolution of the banks' proceedings with the OFT. Alternativley, the bank will immediatley apply to the Court for an order to stay your action until resolution of the banks' proceedings with the OFT". RBS have expressed their intention to defend already, but not filed defence. What does this mean for us now? The letter has a link to here in it also: RBS: Test case - Overdraft Charges – Update Neil
  4. Issued a court claim for the first (Joint) account. Claim is for £4000. Recieved a letter from Cobbets today saying they will defend. What happens next??
  5. Hi All, Sent in my claim with the letter from the templates section for charges on 3 accounts (mine, joint account and husbands account) totalling around £8k. Sent 3 seperate letters in 3 seperate envelopes. Received 3 responses today, all in my husbands name (well, didn't have his surname on, just his first and middle name?!?!) saying that it could take 6-7 weeks while they investigate. Two questions: From reading around here, I'm guessing I ignore this and continue with my LBA after the 14 days has passed? If it comes to filing for court, should I do that 3 times, once for each account and pay £360 fees? I realise I will get these back. Itl be 3 claims for 3.3, 2.7, and 2k. I presume this way I will stay in the small claims track? Advice appreciated. Cheers...

  7. Hi All, Got my bank statements and I'm just starting to put together my summary of charges. For the period between 01/09/2003 and 31/09/2003 I have been charged 4.34 interest, however at the time of charging my balance was 1019.89, although I suspect it was charged on my lowest balance durng that period which was -486.68. How exactly does this work in the process of reclaming bank charges? Because on 30/09/2003 I was not overdrawn the advanced table doesn't seem to work it out right. Next steps anyone? Thanks Also posted a similar message in the RBS area, think this may be a better place however, so sorry!!!
  8. Hi All, Got my bank statements and I'm just starting to put together my summary of charges. I have been inputting interest charges into the table, however it does not seem to be working. I have been charged interest of 3.18, when my balance was -214.63, but I had an interest free overdraft of 500. How does this work, do I list it as a charge, or count it in my final amount? Edit: I have also been charged interest when the account balance is not even minus. Do I include interest charges in the first schedule I send them? Many thanks
