  3. Just found this ; please excuse me Do I actually need to complete a questionnaire? Can’t I just send in a letter to claim? The simple answer is that you don’t need to complete a questionnaire…it is not compulsory but will probably speed up proceedings. Also, if a questionnaire is not completed, most banks will send one out to you anyway. It is better to go for a “belt and braces” approach ad so the initial approach to the bank should comprise a Schedule of Claim (see above), a completed questionnaire and a covering letter outlining the reasons why you believe you were mis-sold the PPI.
  4. Hi I have started with SAR's with the lenders who have attached PPI to my and my parents accounts we know exactly where we are - however my question is , would you recommend using the template letter 1 on this section or should I be filling in the template questionnaire from the FSA? is a filled in version of that template questionnaire a necessity or is it a waste of time and I should go straight into my claim direct with the lender? Again - apologies if this is already mentioned elsewhere and MODS please feel free to move to the correct location. Thanks in advance. James.
  5. Hi helpful friends! , not posted for a while , just spoke to my mum who has a credit card with mbna........ they phoned her WORK landline today and left an automated message saying....please input your security number which is your date of birth- any member of staff could have found this out and accessed private details about my mothers finances. More to the point where does she stand at being contacted at work, this was being contacted for a payment that hasnt gone out on time - the first in 14 months ! Is there a regulation on calling peoples places of work! how embarrassing it could have been for her? What would everyone else do in this situation..? Many thanks in advance. Taff
  6. sequenci vbmenu_register("postmenu_575488", true); wrote.... "If he is working it is highly likely that he will need to pay a percentage of his disposable income towards his creditors, typically this is 50-66% and would last for up to three years" is this on all debts or just "priority debts" such as mortgage and rents arrears , ccjs etc? He has no priority debts, no secured loans. he has 2 credit cards , a car on hp and a bank loan. vbmenu_register("postmenu_575488", true);
  7. Thanks BB very helpful. a few more questions for you, If he decided to go bankrupt, i see it is discharged after 1 year if its your 1st Bankruptcy, how long would this remain on his credit file and how might he find getting a mortgage say 5 years down the line? He will never be a MD , never wants credit again (apart from maybe a mortgage if circumstances changed) What other pitfalls are there please? Also what factors could stop him becoming bankrupt if it was the option he chose to take?
  8. Hi, My brother has run up debts over the past eight years of around 30k, he works full time and has never missed a payment. The bulk of the money owed is from a failed relationship he got out of but came off worse financisally. He is paying out a huge £950 a month out of his monthly earnings leaving him to live on hardly anything after working so hard. He is looking to move out into rented accomodation but with this regime will never afford it . Can anyone advise his best plan of action- apart from debt consolidation? Can somebody tell me what this new government legislation is regarding debt and writing it off? What are the factors to consider regarding bankruptcy? All help is very much appreciated!

  12. yer i know with regards to the aq and cpr 18. ok so i could put this could i?..... BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. Dear Sir / Madam Thank you for your letter dated 09-11-06 I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £960.43 which includes interest at 8% as shown on my charges schedule , I also request the amount of £80 which filing this claim cost me. Grand Total £1040.43 I trust this clarifies my position. Many Thanks
  13. hi folks im writing my rejection of settlement (well copy and pasting most of it from the template) it says in it something like please refund me all charges against my account, but nothing about the interest im now claiming as it is filed with the courts and nothing about the filing fee with mcol (80 quid) do i just add these to what i want paid back to me.... my cpr 18 answer is due back end of this week along with my aq if that matters in anyway to your answer.... can i also flat refuse the whole thing i dont want to take any in partial settlement i want the whole lot in one to save confusion, ??????? thanks.
