  1. Thank you for the honest appraisal of my situation Sangie565. I will take note of your observations and advice. This will enable me to spend my weekend very differently. I do have a tendency to overthink, so, added to the rawness of my emotions currently, this trait could distract me from the process. Disciplinary action is the most likely outcome, I think I am marginally coming to terms with this, so I will try to make the best of the situation by asking for a formal, written performance management plan and regular scheduled reviews to check my progress. I currently don't get scheduled 1:1 time with my manager.
  2. Hi everyone, My manager has served me with a strange invite to a 'Formal Performance Management Hearing'. See the attached file. It was served with 4 working days notice, no issues there. I will be taking a colleague with me and have requested times on 25th and 26th September to accommodate the colleagues availability - within the bounds set out in the letter. I have informed my manager of who it will be. When my manager served me the invite, he said it will result in a stage 1 disciplinary which is first written warning. The letter clearly states 'could' result though. Can I make a point of saying this at the beginning of the hearing so as to state my concerns regarding the outcome being pre-determined? The letter also states my representative can take notes. I thought they could do more than this, I checked the Employee Regulations Act 1999, s ection 10 states that they can: Address the hearing to put my case Sum up the case Respond on my behalf to any view expressed at the hearing Confer with me during the hearing Do I understand correctly? I realise that they cannot answer questions for me. I intend to clarify this at the start of the hearing. If my clarification is rejected, what is my position if I'm served with a disciplinary notice? I do feel aggrieved by the accusations I'm comfortable I can defend 3 of them. The one I'm not as confident about is the Unsatisfactory team management. It's very broad and feels like if he throws enough at me, some of it will stick. Hearing letter.pdf
  3. I had the interview today with my boss and Coyote. My boss referred to my application for senior shift manager and said that this interview was for shift manager. Coyote "has been given" the senior role. My boss referenced Coyotes level of experience as being unmatched, hence no requirement to interview them. All the while Coyote was sat there looking like the cat who got the cream, that was just a side show and I reasoned that I had to take my medicine with a smile. On to the aptitude test results, interview and presentation. I was above 70th percentile for numerical and verbal reasoning in comparison to other management level candidates who have taken the aptitude test. Not stellar but doesn't show any weakness. The interview was lead by my boss and it was trickier than I imagined. I was expecting more of a technical interview but it was packed with scenario based questions. My boss made it harder because he knows I can people manage well and forced me to answer the questions without referencing that skillset. Two of my answers were weak due to this. Coyote kindly interjected occasionally to highlight omissions in my answers. The presentation went well - it was a set subject of what I'd do in the first 9 months in the role, 10 minute limit. I had practised thoroughly, it flowed well and was delivered clearly in 9min 30sec. A shortlist will now be created and if I'm successful, a 2nd HR/Finance led interview will take place around 30th Sept.
  4. I certainly will update. Interestingly, an internal candidate withdrew from the process yesterday and cited the reasons I stated in my initial post. I listened to their points but didn't pass comment and casually changed the subject. After all, it could just be smoke and mirrors
  5. Thank you for the reality check. I am following your advice and have kept my thoughts to myself. I am going through the interview process this week and have already completed the internal aptitude testing.
  6. My boss has 4 direct reports including myself - one of the roles is being made redundant, the person currently in this role I'll refer to as 'Coyote'. It is definitely Coyotes job that is being made redundant because they have a different job title to the other direct reports. Coyote currently has no direct reports but has responsibility for the work that myself and my 2 other colleagues produce, hence a need for restructuring. In the restructuring move, the remaining 3 positions would report into 3 new Shift Managers, who in turn will report in to my current boss. One of the 3 new Shift Managers will have senior ranking and will fill in for my boss when he is absent. In a 1:1 when I was first told about the restructure, my boss told me that Coyote would get the senior ranking job, a current colleague will get one of the others, which leaves one job up for grabs, this looked like it would be a permanent nightshift role to give the other 2 people more exposure to senior management in office hours. He reeled off a list of potential applicants who 'definitely wouldn't' get this role. He said he thought I should apply but needed to prepare for questions regarding my limited 1 year 3 months experience in the current role. I left my 1:1 feeling a bit begrudged that I would have to fight when others were being gifted and that my boss was potentially not doing things by the book. I did a lot of thinking and decided that I wouldn't allow myself to have to make any more difficult decisions and would put the onus of decision making back on to my boss. I applied for the Senior Shift Manager role. Today I received my invite for interview and noticed two things: Coyote (under her soon-to-be-redundant job title) would be interviewing me alongside my boss. I would be interviewed for the Shift Manager job, not the Senior Shift Manager job. As Coyotes job is being made redundant, this surely makes them a candidate for any one of the 3 Shift Manager roles? It makes no sense to me why they would be involved as an interviewer. In applying for the Senior Shift Manager role, I expected to come up against Coyote as a candidate, not be interviewed by them. I have not been formally told that I've been unsuccessful in applying for the Senior role. The interview is on Thursday 17th September, so I have 7 days in which to say something. I don't want to say anything after the event because it would be seen as sour grapes if I was unsuccessful. Does anyone have any advice on how I should proceed?

    Just pulling together the information I need for my N1 so that I'm ready to go, should Abbey not settle after my LBA but I have a quick question regarding the Value: The following is quoted from the "N1 - Particulars of Claim" that Bankfodder has created: Charges £170.00 Overdraft Interest £0 Interest under s.69 County Courts Act 1984 £19.25 Court Fee £30.00 TOTAL £ 219.25 Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day {(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day) }OR at such rate and for such periods as the court deems just. I'm pretty sure I understand the charges, overdraft interest, s.69 CCA 1984 and the court fee that apply to me. What I'm not so sure about is the last sentence; how do I perform the calculation in red, using my figures (in blue) from above?

    I agree there c-m; a sticky with where to send when you first letter would be an excellent addition to the site. Everything has been easy to find so far except for a definitive 'where to send' for the prelim and following correspondence, although common sense would suggest to reply to the address and person on the letter that you receive. I sent my LBA on 14th Feb to Andrew Stanton at the Milton Keynes address. I've drafted up a 'rejection of settlement' letter in case they try to settle for a lesser amount than I'm pursuing for. I'll accept their offer but pursue for the rest etc.

    I received a standard reply today ie.: 'Thanks for contacting us, we're sorry to hear that you're not happy.... here is a leaflet detailing our complaints procedure....we'll get back to you in 4 weeks' Yeah right! No Gesture Of Good Will (GOGW) either. The Preliminary Request deadline is 1pm on 13th Feb, so I'll draft up my Letter Before Action (LBA) over the weekend and have it ready to send on the 14th, recorded delivery. There don't seem to be any problems sending to the Milton Keynes Address as opposed to the Triton House one. Either one seems to work.

    Hi to all other like-minded people on here! This is my first post after reading through various areas of the site and I think I'm ready to start. I'm about to send my preliminary letter as per the one in the library - no need for the data request letter because I've kept my statements and I'm happy that they're complete. The only thing I've not succeeded in finding so far has been an address to send my correspondance to. Milton Keynes is all I seem to have found so far in the forum! Any help on where to send my preliminary letter would be greatly appreciated. For my background, I'm only claiming £170 but this money was taken from me when I was a jobless student in my final year at university. Prior to my final year, I used to work 12hrs a week in a supermarket for my social money. I set up a DD for £4.50 a month to pay for medical insurance ([problem]) and I forgot about it in my final year, which is where the charges come from. They way I look at this now is that the £170 was a months earnings after tax and if I compare that to my salary now, although I've not got a lot to gloat about, it'd be four figures. This is all about principal and the fact that Abbey would not stop the DD for me. My account is now closed and all I have with Abbey is a savings account with £0 in it, so they're not going to scare me with any of their usual tactics.
