  1. To day I have heard back that they are not going to pay me anything for excessive charges at all, since they say the charges I have itemised, MAAF's and DD fees were not identified as having been inappropriately applied, following the FSA review. They enclosed details from the original lender and their own details where all charges are outlined and state that as I was contractually obliged to make payments, when I didn't, the charges applied as stated... there are number of issues in the letter I am not happy with. Is there anyone I could send a copy to to have a look for me? Thank you so much.
  2. Hello Yes, I have all of the statements now. I have just claimed first of all, the amount they sent to me for agents visits, though to the property they re-possessed the year before, so never received by me of course. Thought that was easiest since it had already been authorised. I received the payment, but for the original amount, not the extra years of interest as they tell me, as they have records showing they made all reasonable efforts to reach me at that time, they do not owe me further interest. Is this right? They expected me to have a mail forwarding address in place. I didn't since I had no idea where I would be. Now comes the claim for excess charges...
  3. I too am having difficulties with Redstone. Having waited 350 days for my SAR, now I have requested funds from them, first for the agents visits, something they sent a cheque for, to the property they repossessed 8 years ago. I have waited and waited for it and each time I write, i get a standard "complaints" letter from them saying they will investigate thoroughly and it will take 20 days... just stalling and stalling and never answering anything I ask them! There will then be the DD's and arrears payments to claim. So court it is for the first part I think.

  5. I truly appreciate your help. I have been reading through the Redstone/FSA document so feel fairly confident about my claims. I will get to the worksheet this weekend and see how it looks when I am finished with it. Not having used one before be prepared for further questions! Whatever I receive will be good of course but can never make up for the appalling treatment by them and their agents at the time. I was not given proper time to vacate and the estate agents were seen and filmed filling their cars with my belongings. The whole episode a utter horror story right up to the completion. Thank you again.
  6. Thank you. There is no PPI. Just the dd charges and the arrears charges and whatever interest there is to be claimed. Counsellor visits; they sent a cheque to me at the house they repossessed, a year after the event so of course didn't reach me. There is also an overpayment at the time of the sale so I have asked for clarification on that. I imagine that will have been taken up by a second charge on the property at the time. However, I would like to reclaim what I am entitled to of course. Thank you for your help. I am sorry I post in the wrong places, I don't mean to, I find navigation confusing here. Clearly I don't use it enough.
  7. Hello I have waited exactly a year for my SAR documents to come through from Redstone and have been going through them all these past few days. Can I claim for the whole of the arrears fee of £50.00 or just a portion of it? Same as with the DD charges. I am assuming the charge is 35.00, 1 0.00 is close to actual cost and 25.00 can be claimed from them? How does the figure for restitution work? Thank you so much.
  8. So all these years on, I held out and kept the house until Oct 2009. There was a purchase going through, until the last minute which fell through and then despite having an auction booked, four weeks hence, it was repossessed. Now, after a year of waiting, I have the paperwork to reclaim some of the funds that were overcharged at the time. Can anyone tell me the level of interest I can claim? I would like to get this going asap, of course. Thank you so much.

  11. Hello I have finally received the paperwork from my mortgage company after 12 months and my SAR. There is a mountain to wade through as you might imagine, but the first thing I have noticed is that having taken possession of my home, my mortgage company still charged me for my mortgage payments and arrears for the same until the property sold four months later. I am looking to see what I might be able to claim for. Obviously excessive charges for failed payments. Arrears charges too? I am just uncertain. Thank you.

  13. Hello Thank you for your reply. It is 50% of the original loan of £79k, from Affirmative Finance, according to my solicitor who received a settlement from them last week it was £126k, two days later in court, they tell me £128k. No there was no PPI. I am wading through the small print, but as is so often the case, it is as clear as mud!
  14. Hello Everyone Some months ago, amazing people on this group gave tremendous advice and support, that allowed me to avoid eviction and to remain in my home until I completed on a sale. Exchange is due this week.... My question this time is this; I have a bridging loan also on the property, run over time and paymants outstanding, because of illness, job loss etc. Now these people will be taking from me the amount of the original loan, which of course I owe; then the outstanding payments, which I owe, but then they want to add another 50% on top with no explanation why or breakdown of how they reach the sum they are asking for. They tell me it is negotiable, but before I even get into that, I want to know if they can just charge any figure. We have to agree of course, or there won't be any completion, but that will not be to their benefit I know because they won't get their money. I need to resolve this soonest and thought here was the best place to start. Many grateful thanks, Demelzza
