Anyone claiming for a second (or more) time?
fruitycar replied to illonavamp's topic in Halifax Bank and Bank of Scotland
I have a third claim underway against Bank of Scotland. I shall be following the summary cause route this time if necessary, although I am still going to have to make a fourth claim to get it all back. -
Thanks Roadrunner. its such a pain having to make multiple claims. I keep hoping they will just settle in full each time, but both previous claims I have had to raise small claims so it costs them more as they then have to pay the interest and the court costs.

Here we go again! Finally pulled my finger out and got round to sending off my prelim letter (recorded delivery) yesterday for the outstanding charges on my account.

Do you think they move around en masse? coz the lot outside Aberdeen Sheriff court where very intimidating!

What I did.....preliminary letter asked for full amount back, enclosed spreadsheet showing charges and dates, but not interest. LBA, Letter Before Action, asked for full amount back, enclosed spreadsheet etc.as above. In conversation as a result of letters, indicated that would be severing claim and that each claim would include 8% interest. 1st claim: filed small claim for £740 plus interest and costs, spreadsheet including days since offence and 8% interest, got £740 plus costs but not interest. 2nd claim: filed small claim for £629 and 8% interest plus costs (worded claim differently) spreadsheet including days since offence plus 8% interest, got £769.15 3rd claim about to begin -
Handed in to local branch.

Court Hearing Thursday 14th September
fruitycar replied to dannybhoy's topic in Scotland Banks & Finance
Hi DB sorry not have picked this thread up before, wont answer much now as on the other side of a couple of ciders and now onto the vino! Well done so far will get back to you as I pursued BoS to hearing for my 8% interest and got unsympathetic sheriff and probably crossed wires. Cheers! Fruitycar -
Just had my 2nd claim against BoS settled and once again the settlement letter has not asked me to sign 'in full and final settlement'. Is this an oversight on their part or standard for BoS?

Got another £1639 to claim back, which would be 3 small claims or 1 summary cause + 1 small claim or as you say MCOL. Not sure how it would be having made 2 claims under Scottish system to then go for an English claim. My hope is that when they receive next prelim letter asking for the full amount they will just cough up, will save them paying the interest and costs. You have to wonder why when they state in their settlement letter that it is not financially viable for them to defend, they go all the way to the claims stage and have to pay out interest and costs when they could just refund the amount asked for?
