  1. The tenancy agreement was never amended or updated by my new employer, they copied the original for reference, but I have a letter from the then HR team leader that states the percentage of my salary to be paid for rent. Nothing to do with the TUPE and my new working contract. The new amounts were deducted from my wages. This refers only to the tenancy agreement, the other details were just background info.
  2. Hi Guys, I'm looking for info or advice. In 2006 I was tupeed, I still have my original contract for reference, I also have a tenancy agreement that stated I needed to reside on site to perform my duties. My rent for the property would be based on a percentage of my basic salary. When my new employer updated staff contracts in 2010, they didn't update or renew the original tenancy agreement, but they took a copy for their reference, my rent went up 3 times between 2011 & 2017 being deducted directly from my wages by the payroll office. All three increases have been at a much higher percentage than the original agreement states. I have since discovered that a colleague that has now left, that held the same role and conditions, disputed the payments and only had one rent increase in line with his basic salary. What I am trying to find out is should I receive a refund of the paid amount over the set percentage, if so, could I expect to claim interest on the over payment. My current employer has never updated or renewed my tenancy agreement, only sent a letter each time stating the rent would be increasing. I would be most grateful for opinions on this.
  3. Hi I went to view a car at a local dealer yesterday after phoning first, they said on the phone that if I wanted the car after viewing there would be a £100 deposit to secure. I went and viewed it and although the advert said it had a full MOT, the dealer had to get it done after I had looked at it, it came back 30 mins later with a certificate and an advisory that said "brake pipe line corroded". The salesman also insisted the deposit would be £200 not £100. I left a deposit but on looking into the vehicle history when I got home, it showed that in 2015 it failed an MOT on, nearside & offside rear brake pipes were excessively corroded. Strangely the latest inspection doesn't state front/rear offside/nearside is at fault. As I want a car for taking my two young sons out, I feel maybe this car is not the one for me. Can anybody tell me as I only paid the deposit yesterday, due to the advisory, am I entitled to get my deposit back ?
  4. Hi maybe someone can advise. My niece who has adhd applied and got a job and she told them of her condition when she applied. The contracted hours were 12 per week, Tuesday 2 till 6, Wednesday 2 till 6 and Thursday 2 till 6. She was also told if she wanted she could also work 4 hours overtime on Mondays. She did her induction day on a thursday and started working the following tuesday, wednesday & thursday. When she went to work this tuesday, they said they were sacking her for being unreliable, when she asked in what way, she was told she didn't turn up on either of the mondays to do overtime. She explained that nobody had asked her to work the extra hours but they said she should have looked at the rota on the wall. Surely someone should have explained this to her after the first monday she missed instead of waiting for her to miss the second one. Can she do anyting about this ?

  6. Hi I bought a 2nd hand car from a dealer on 5th October, I asked for his best price as I didn't have p/ex and had cash, after some pushing he dropped the price by £195. I did a test drive, went back to his office paid him the cash and collected the paperwork. I drove to a fuel station no more than 500 yds away, put in some fuel, but it wouldn't start. I telephoned the dealer, who came out with a jump box, but even I knew the battery wasn't flat because the dash lights, windows etc. were still working, I told him I wasn't happy with the car now, but he said the deal was done. He recovered the car to get it repaired, and said it was a loose wire. I went back on 7th Oct, picked up the car and had to return again because the front of the stereo was missing. When I got home I put the face on the radio, but nothing happened and on investigation found that the unit wasn't wired in, there weren't even the leads to connect it! I bought new iso leads but no joy, took it and had it tested and the output had blown so the unit was useless. On 14th Oct the car went dead again and wouldn't start, I called the dealer and he said he couldn't do anything about it now, as I had had the car for a week. I called out RAC who said it needed a new starter motor. I again contacted the dealer who said if I took it back he would get his garage to have a look at it, also if I called round to his office he had another stereo I could have, (luckily my brother had lent me his spare) and the garage would need the car 2 days. I called the garage direct, and they seemed aware the starter had gone, I arranged to take it for the repair at the dealers expense. While the repair was being done I went for a walk and on my return the car was finished, but when I got in my car the dealer had been to it, taken out the stereo my brother had lent me and left it on the seat (a £200 unit) and put another in its place that still didn't work because he hadn't wired it in properly. To top things off I got 1/2 a mile along the road and the engine management light came on, I had to return to the garage to sort that as well. Do I have to accept what the dealer has done, or can I get a refund, I think there may be other problems that I haven't found yet. Any advice welcome. T
  7. Hi and thanks for the quick reply. No the envelope was delivered by hand, it was also addressed to me and marked private in the smallest handwriting ever (all words max 1" x 1/8"), but it was my 80 year old hubby that opened it because he was expecting a hand delivered letter himself. But as I have never contacted any DCA's, they couldn't even be sure I live here, and the house is rented from my employer.

  9. Hi, I have just discovered that wfs made an error. In September 2008 I cancelled my PPI, and they said they would refund the rebate of £388 to my account. A couple of months ago I heard from FSCS who said I had a valid claim for PPI. The refund cleared my remaing balance, but the original refund in 2008 was £110 less than the FSCS quoted on their calculation. Anyway to shorten the story a little, when I checked my 2008 statement, they had added the £388 on to my balance before deducting it off. This meant that I didn't get the rebate. They have just agreed that this was an administration error, and I am owed £388, and as my account is closed would send a cheque for what I am due. Can anyone tell me, would I be entitled to interest on the £388 since 2008, and if so would it be at the same rate listed on my agreement 44.7%, or would it be the basic 8% (I think called contractual interest). Any thoughts ?
  10. Hi. check your statement carefully. I had a similar problem where they supposedly refunded ppi to my account, but they had added the same amount on before applying the rebate. I have just queried this and they said it was an admin error and will send the amount to me as my account is closed. I hope they add the interest the mistake was in 2008 ! Good luck with your claim/complaint.

I paid for about 6 months, then didn't pay for a time, and started paying the reduced amount regularly as I stated earlier, but at no time has the agreement been re written or renewed, in fact if I use the auto payment line, it still asks for the original monthly payment. The opening balance is from a statement at the start of the reduced monthly payment. I didn't question the refund at the time because I didn't realise it had been added on first. Yes I have already decided to get an SAR, due to the charges that have been added too.

  13. Hi I had a loan for £3000 in 2007, and had problems making the repayments after about 6 months. In 2008 I came to an agreement where I would pay a reduced monthly amount, which I have kept to. At the time I started the reduced payment, I asked them to refund and cancel PPI as it was mis sold because I had pre existing medical conditions that wouldn't be covered, and nobody had explained this to me, it was an online application. They cancelled the PPI and said they would refund £388. They did, but only after they added the exact same amount on to my account balance first. On the original paperwork the total for PPI including interest was just over £2000. Should they have reduced my account by the amount on my original paperwork after they cancelled the PPI, less any refund they were supposed to have made? I would be grateful for any help given. T
  14. Hi, if I send a SAR to welcome, do they have to send everything to me including copies of letters that they have charged for etc.
  15. Hi I sent for cca, and they sent back an account statement that consisted of a page of fees for telephone calls etc. along with a copy of my agreement, which also came back quickly by recorded delivery.
